Shri Gautam Bhaduri, counsel for the appellants\n\n\n\n\n\n^               Shri  B P Sharma with Shri Manilal Sakat, counsel for the respondents\n\n\n\n\n             Honble Shri Dilip Raosaheb Deshmukh, J\n\n\n\n\n\n               Dated: 13\/10\/2008\n\n\n\n\n:               Judgment\n\n\n\n        Appeal under Section 100 of the Code of Civil Procedure, 1908\n\n\n\n\n                          JUDGMENT\n<\/pre>\n<p>        (Delivered on this 13th day of October, 2008)<\/p>\n<p>     In this appeal by the legal representatives of<\/p>\n<p>the  deceased  sole respondent\/tenant  Ram  Chandra <\/p>\n<p>Ballaya in the lower appellate Court, the following<\/p>\n<p>question of law arises for determination:<\/p>\n<blockquote><p>         &#8220;Whether  the  decree of  the  lower<br \/>\n         appellate  Court was  executable  in<br \/>\n         view  of  the  fact that  Ramchandra<br \/>\n         Balaiya, the original defendant died<br \/>\n         during the pendency of the appeal?&#8221;\n<\/p><\/blockquote>\n<p>(2)  Brief facts are that in Civil Suit No.74-A\/89,<\/p>\n<p>the  IVth Civil Judge Class-I, Raipur dismissed the<\/p>\n<p>suit  for  eviction  of  Ram Chandra  Ballaya,  the<\/p>\n<p>tenant  from  the suit accommodation vide  judgment<\/p>\n<p>and  decree dated 24-07-1990.  Being aggrieved, the<\/p>\n<p>plaintiff  Baldeo  Prasad  Gupta  preferred   Civil<\/p>\n<p>Appeal   No.101-A\/95  before  the  District  Judge,<\/p>\n<p>Raipur.  During pendency of the civil appeal,  Shri<\/p>\n<p>Bhaduri,    learned   counsel    for    the    sole<\/p>\n<p>respondent\/tenant informed the Court on  01-04-1992<\/p>\n<p>about  the death of Ram Chandra Ballaya.  On 16-06-<\/p>\n<p>1992,  Baldeo Prasad Gupta, the appellant moved  an <\/p>\n<p>application  under Order 22 Rule 4 of the  Code  of<\/p>\n<p>Civil Procedure for substitution of the widow  Smt.<\/p>\n<p>Laxmi  Ballaya and minor son Premrao,  i.e.,  legal<\/p>\n<p>representatives  of Ram Chandra  Ballaya.   Another<\/p>\n<p>application  under Order 32 Rule 3 of the  Code  of<\/p>\n<p>Civil  Procedure was also filed for appointment  of<\/p>\n<p>Smt.   Laxmi  Ballaya  as  the  guardian  of  minor<\/p>\n<p>Premrao.   Both  the applications  mentioned  above<\/p>\n<p>were  not  decided by the learned  District  Judge,<\/p>\n<p>Raipur and the appeal was allowed by judgment dated <\/p>\n<p>06-02-1997.    Before   this   Court,   the   legal<\/p>\n<p>representatives  of Ram Chandra  Ballaya  moved  an<\/p>\n<p>application I.A.No.1975\/1997 seeking permission  to<\/p>\n<p>file second appeal as legal representatives of  Ram<\/p>\n<p>Chandra Ballaya, which was granted. <\/p>\n<p>(3)   Shri Gautam Bhaduri, learned counsel for  the<\/p>\n<p>appellants  has argued that in the  absence  of  an<\/p>\n<p>order of substitution the legal representatives  of<\/p>\n<p>Ram  Chandra Ballaya were not heard in Civil Appeal<\/p>\n<p>No.101-A\/1995 and, therefore, the impugned judgment <\/p>\n<p>and  decree dated 06-02-1997 passed by the District<\/p>\n<p>Judge,   Raipur   in  Civil  Appeal   No.101-A\/1995<\/p>\n<p>deserves to be set aside and the matter remanded to<\/p>\n<p>the  lower appellate Court for proceeding from  the<\/p>\n<p>stage  of  consideration of the applications  under<\/p>\n<p>Order  22 Rule 4 and under Order 32 Rule 3  of  the<\/p>\n<p>Code of Civil Procedure.\n<\/p>\n<p>\n(4)   On  the other hand, Shri B.P.Sharma,  learned<\/p>\n<p>counsel  appearing for the respondents argued  that<\/p>\n<p>the respondents herein could not have done anything<\/p>\n<p>more than filing applications under Order 22 Rule 4<\/p>\n<p>and  under  Order 32 Rule 3 of the  Code  of  Civil<\/p>\n<p>Procedure  and,  therefore, the respondents  herein<\/p>\n<p>cannot  be  made to suffer for the default  of  the<\/p>\n<p>lower  appellate Court in deciding the applications<\/p>\n<p>mentioned above.\n<\/p>\n<p>\n(5)   Having  considered the rival  submissions,  I<\/p>\n<p>have  perused the record.  There is no  element  of<\/p>\n<p>doubt  that the judgment and decree passed  by  the<\/p>\n<p>lower  appellate Court is a nullity as it has  been<\/p>\n<p>passed  against  a dead person.   It  is  also  not<\/p>\n<p>executable  because in the absence of an  order  of<\/p>\n<p>substitution  the  legal  representatives  of   the<\/p>\n<p>deceased  Ram  Chandra Ballaya were  not  heard  in <\/p>\n<p>Civil  Appeal  No.101-A\/1995 and the  authority  of<\/p>\n<p>Shri  Bhaduri,  learned  counsel  for  Ram  Chandra<\/p>\n<p>Ballaya   to   appear  on  behalf   of   the   sole<\/p>\n<p>respondent\/tenant Ram Chandra Ballaya ceased on the  <\/p>\n<p>date  of his giving intimation of the death of  Ram<\/p>\n<p>Chandra  Ballaya.  In this view of the matter,  the<\/p>\n<p>appeal deserves to be allowed.\n<\/p>\n<p>\n(6)   In  the  result, the appeal is allowed.   The<\/p>\n<p>impugned   judgment  and  decree  dated  06-02-1997 <\/p>\n<p>passed  by  the  District Judge,  Raipur  in  Civil<\/p>\n<p>Appeal  No.101-A\/1995 is set aside.  The matter  is<\/p>\n<p>remanded  to  the  lower  appellate  Court  with  a<\/p>\n<p>direction  to proceed in accordance with  law  from<\/p>\n<p>the  stage  of  consideration of  the  applications<\/p>\n<p>filed  by the appellant under Order 22 Rule  4  and<\/p>\n<p>under  Order  32  Rule  3  of  the  Code  of  Civil<\/p>\n<p>Procedure.
