JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Mr.Rashesh Rindani, learned Assistant Government Pleader, waives<br \/>\nservice of notice of Rule for the respondents.\n<\/p>\n<p>2.\tThis<br \/>\napplication has been filed with the prayer to permit amendment of the<br \/>\nMemorandum of Special Civil Application  No.6998 of 2011 and to add<br \/>\ncertain annexures as detailed in  paragraph 2 of the application and<br \/>\nprayer paragraph  4(B) thereof.\n<\/p>\n<p>3.\tHeard<br \/>\nMr.Kunal Shah, learned advocate for Mr.B.A.Surti, learned advocate<br \/>\nfor the applicant (origami petitioner) and Mr.Rashesh Rindani,<br \/>\nlearned Assistant Government Pleader for the respondents.\n<\/p>\n<p>4.\tIt<br \/>\nis submitted by the learned advocate for the applicant that the<br \/>\napplicant is desirous of adding certain grounds in the Memorandum of<br \/>\nthe application as the said grounds and documents proposed to be<br \/>\nannexed would supplement the averments made in the petition.\n<\/p>\n<p>5.\tMr.Rashesh<br \/>\nRindani, learned Assistant Government Pleader has not raised any<br \/>\nobjection to amendment of the petition, as prayed for.\n<\/p>\n<p>6.\tLooking<br \/>\nto the nature of the amendment, the prayers made in the application<br \/>\ndeserve to be granted.\n<\/p>\n<p>7.\tThe<br \/>\nrequirement of filing an affidavit with this application is dispensed<br \/>\nwith.\n<\/p>\n<p>8.\tThe<br \/>\napplication is allowed. The applicant is permitted to amend the<br \/>\nMemorandum of Special Civil Application No.6998 of 2011, within a<br \/>\nperiod of one week from today, as per the amendment proposed in<br \/>\nparagraph 2 of the application and prayer paragraph 4(B) thereof.\n<\/p>\n<p>9.\tThe<br \/>\napplication is allowed in the above terms. Rule is made absolute,<br \/>\naccordingly.
