GILANI J.\n<\/p>\n<p>                                                        DATE     :  16.6.2011.\n<\/p>\n<p>                                                                      This   is   an   application   under   section   378(4)   of   the <\/p>\n<p>                                                        Criminal   Procedure   Code   seeking   leave   to   file   an   appeal <\/p>\n<p>                                                        against   the   order   of   acquittal   passed   by   learned   Judicial <\/p>\n<p>                                                        Magistrate,   First   Class   (24th  Court),   Nagpur   in   Summary <\/p>\n<p>                                                        Criminal Case No.13119\/2008.\n<\/p>\n<p>                                                                      Mr.   Dawada,   learned   counsel   appearing   for   the <\/p>\n<p>                                                        respondents,   raised   a   preliminary   objection   about   the <\/p>\n<p>                                                        maintainability of the appeal before this Court.  According to <\/p>\n<p>                                                        him proviso to section 372, inserted by the Code of Criminal <\/p>\n<p>                                                        Procedure   Amendment   Act,   2008   (for   short   Act   of   2008), <\/p>\n<p>                                                        which   came   into   force   with   effect   from   31st  of   December <\/p>\n<p>                                                        2009, the forum for appeal would be the Sessions Court and <\/p>\n<p>                                                        not the High Court.  Proviso to section 372 reads as under :-\n<\/p>\n<p>                                                                                 &#8220;Provided that the victim shall have a right to<br \/>\n                                                                   prefer   an   appeal   against   any   order   passed   by   the  <\/p>\n<p><span class=\"hidden_text\">                                                                                                                                ::: Downloaded on &#8211; 09\/06\/2013 17:21:42 :::<\/span><br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>            Court   acquitting   the   accused   or   convicting   for   a  <\/p>\n<p>            lesser offence or imposing inadequate compensation,<br \/>\n            and such appeal shall lie to the Court to which an  <\/p>\n<p>            appeal ordinarily lies against the order of conviction<br \/>\n            of such Court.&#8221;\n<\/p>\n<p>              While inserting the aforesaid provision the definition of <\/p>\n<p>      &#8216;victim&#8217; has also been incorporated as section   2(wa) which <\/p>\n<p>      reads as under :-\n<\/p>\n<blockquote><p>                      &#8220;victim&#8221; means a person who has suffered  <\/p>\n<p>              any loss or injury caused by reason of the act or<br \/>\n              omission for which the accused person has been  <\/p>\n<p>              charged and the expression &#8220;victim&#8221; includes his<br \/>\n              or her guardian or legal heir.<\/p><\/blockquote>\n<p>              According   to   learned   counsel   for   the   respondents <\/p>\n<p>      expression  &#8216;victim&#8217; has to be given wider meaning to include <\/p>\n<p>      complainant in a complaint case.  Being a victim he chooses <\/p>\n<p>      to   file   complaint   case   as   such,   the   complainant   cannot   be <\/p>\n<p>      excluded from the term &#8216;victim&#8217; occurring under section 2(wa) <\/p>\n<p>      of the Code of Criminal Procedure.     Whenever there is an <\/p>\n<p>      order   of   acquittal   and   if   victim,   may   be   in   the   capacity   of <\/p>\n<p>      complainant, is not satisfied with the said order,  he has been <\/p>\n<p>      conferred   with   a   right   to   question   the   judgment   and   the <\/p>\n<p>      forum has also been specified in the proviso to section 372 of <\/p>\n<p>      the Criminal Procedure Code. According to him, forum would <\/p>\n<p>      be   the   Court   where   ordinarily   the   appeal   lies   against   the <\/p>\n<p>      order   of   conviction   of   such   Court.     Admittedly,   appeals <\/p>\n<p><span class=\"hidden_text\">                                                 ::: Downloaded on &#8211; 09\/06\/2013 17:21:42 :::<\/span><br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>      against the order of conviction, recorded under section 138 of <\/p>\n<p>      the Negotiable Installments Act, are filed before the Court of <\/p>\n<p>      Sessions.  Therefore, an appeal against the order of acquittal <\/p>\n<p>      should also lie before the Court of Sessions, he urged.\n<\/p>\n<p>             I am not in agreement with the contention raised by <\/p>\n<p>      learned counsel for the respondents.  Section 378 exclusively <\/p>\n<p>      deals with appeal in case of acquittal.   Because of the recent <\/p>\n<p>      amendment which has come into force from 23\/6\/2006 two <\/p>\n<p>      forums are available  for filing an appeal against the order of <\/p>\n<p>      acquittal.   In   respect   of   a   cognizable   and   non-bailable <\/p>\n<p>      offences,   the   District   Magistrate   may   direct   the   Public <\/p>\n<p>      Prosecutor to present an appeal to the Court of Sessions.  In <\/p>\n<p>      other   cases,   the   State   Government   or   the   Central <\/p>\n<p>      Government,   as   the   case   may   be,     may   direct   the   Public <\/p>\n<p>      Prosecutor   to   present   an   appeal   to   the   High   Court.     The <\/p>\n<p>      Criminal Procedure Code makes distinction between the case <\/p>\n<p>      filed   by   the   complainant   and   the   case   filed   on   the   police <\/p>\n<p>      report.   If the case is instituted otherwise than upon a police <\/p>\n<p>      report that means if it is a complaint case and the accused is <\/p>\n<p>      acquitted, the complainant has a remedy to assail   an order <\/p>\n<p>      by   resorting   to   the   provisions   of   section   378   (4)   of   the <\/p>\n<p>      Criminal Procedure Code which reads as under :-\n<\/p>\n<blockquote><p>              &#8221; If such an order of acquittal is passed in any<br \/>\n              case   instituted   upon   complaint   and   the   High <\/p>\n<p><span class=\"hidden_text\">                                               ::: Downloaded on &#8211; 09\/06\/2013 17:21:42 :::<\/span><br \/>\n<span class=\"hidden_text\">                            4<\/span><\/p>\n<p>              Court,   on   an   application   made   to   it   by   the  <\/p>\n<p>              complainant in this behalf, grants special leave to<br \/>\n              appeal   from   the   order   of   acquittal,   the  <\/p>\n<p>              complainant may present such an appeal to the<br \/>\n              High Court.&#8221;<\/p><\/blockquote>\n<p>              Before   Act   of   2008   came   into   force,   &#8220;victim&#8221;   in   a <\/p>\n<p>      criminal case, instituted on a police report, had no right to <\/p>\n<p>      file   an   appeal   against   the   order   of   acquittal   to   any   Court.\n<\/p>\n<p>      However, in a complaint case, right in the form of provisions <\/p>\n<p>      under   section   378(4)   of   the   Criminal   Procedure   Code   was <\/p>\n<p>      already in existence.  The Law Commission in its 154th  report <\/p>\n<p>      recommended   comprehensive   amendments   to   the   Code   of <\/p>\n<p>      Criminal Procedure relating to various provisions concerning <\/p>\n<p>      arrest, custody, compounding of offences, victimology etc.  In <\/p>\n<p>      the   statement   of   objects   and   reasons   of   Act   of   2008   it   is <\/p>\n<p>      mentioned in para 2 that &#8220;at present, the victims are the worst  <\/p>\n<p>      sufferers in a crime and they don&#8217;t have much role in the court  <\/p>\n<p>      proceedings.   They   need   to   be   given   certain   rights   and  <\/p>\n<p>      compensation,   so   that   there   is   no   distortion   of   the   criminal  <\/p>\n<p>      justice system.&#8221;\n<\/p>\n<p>              Thus based on the &#8216;doctrine of victimology&#8217;   proviso to <\/p>\n<p>      section   372   and   the   definition   of   &#8216;victim&#8217;   have   been <\/p>\n<p>      incorporated w.e.f. 31st  December 2009 thereby the victims <\/p>\n<p>      have not been left at the mercy of the State Government or <\/p>\n<p>      the Central Government (as the case may be) or the District <\/p>\n<p><span class=\"hidden_text\">                                                ::: Downloaded on &#8211; 09\/06\/2013 17:21:42 :::<\/span><br \/>\n<span class=\"hidden_text\">                                                                                          5<\/span><\/p>\n<p>                                                       Magistrate.   The aforesaid provision does not in any manner <\/p>\n<p>                                                       affect provisions of section 378(4) of the Criminal Procedure <\/p>\n<p>                                                       Code dealing with the appeal against the order of acquittal in <\/p>\n<p>                                                       any case instituted upon complaint.\n<\/p>\n<p>                                                                    In this view of the matter, appeal against an order of <\/p>\n<p>                                                       acquittal, passed in the case instituted by the appellant, for <\/p>\n<p>                                                       the offence punishable under section 138 of the Negotiable <\/p>\n<p>                                                       Instruments Act would lie to this Court.  I, therefore, do not <\/p>\n<p>                                                       find   any   force   in   the   preliminary   objection,   raised   by   the <\/p>\n<p>                                                       learned counsel for the respondents.\n<\/p>\n<p>                                                                    Turning to the facts of the case, learned Magistrate in <\/p>\n<p>                                                       para 11 of his judgment observed :\n<\/p>\n<blockquote><p>                                                                           &#8220;It   would   be   appropriate   to   mention   the   admitted  <\/p>\n<p>                                                                         facts on record.  It is admitted by the accused persons<br \/>\n                                                                         that   they   used   to   purchase   materials   from   the<br \/>\n                                                                         complainant.   The  signature  on  cheque   at Exh.24  is  <\/p>\n<p>                                                                         admitted by the accused person.   Issuance of demand<br \/>\n                                                                         notice by the complainant is also admitted and reply to<br \/>\n                                                                         said notice by the accused persons is also admitted by<br \/>\n                                                                         the complainant.&#8221;<\/p><\/blockquote>\n<p>                                                                    In   this   view   of   the   matter,   I   find   that   the   arguable <\/p>\n<p>                                                       points are involved.
