Heard learned counsel for the appellant and<\/p>\n<p>                     learned counsel for the State.\n<\/p>\n<p>                                2. Sagar Chaudhary, the appellant has been<\/p>\n<p>                     convicted under Sections 326 and 307 of the Indian Penal<\/p>\n<p>                     Code      and has been sentenced to undergo rigorous<\/p>\n<p>                     imprisonment for seven years for offence under Section<\/p>\n<p>                     307 I.P.C. and further sentenced to undergo rigorous<\/p>\n<p>                     imprisonment for seven years for offence under Section<\/p>\n<p>                     326 of the Indian Penal Code.               However, it has been<\/p>\n<p>                     ordered that both the sentences shall run concurrently.<\/p>\n<p>                                3. The prosecution case as alleged in the<\/p>\n<p>                     Fardbeyan of the informant Rajendra Chaudhary that while<br \/>\n<span class=\"hidden_text\">                2<\/span><\/p>\n<p>he was going to market from his house then he met Sagar<\/p>\n<p>Chaudhary on the road and he enquired from Sagar<\/p>\n<p>Chaudhary about collection on the eve of Durga Puja and<\/p>\n<p>expenses then Sagar Chaudhary abused and on protest he<\/p>\n<p>went toward his house and returned with a Farsa along<\/p>\n<p>with his father Ram Bhajju Chaudhary and his mother<\/p>\n<p>Ritia Devi who were also armed with lathi and assaulted.<\/p>\n<p>Ram Bhajju Chaudhary gave farsa blow which hit left<\/p>\n<p>hand thumb causing amputation of his thumb and he fell<\/p>\n<p>unconscious.   It is alleged that accused persons have<\/p>\n<p>injured him by lathi and farsa. On the basis of Fardbeyan,<\/p>\n<p>F.I.R. was lodged.     After investigation charge sheet<\/p>\n<p>submitted and cognizance has been taken for offence<\/p>\n<p>under Section 324, 326 and 307 I.P.C. and the case was<\/p>\n<p>committed to the Court of Sessions. Charges were framed<\/p>\n<p>for offence under Section 307 I.P.C. against three accused<\/p>\n<p>Ram Bhajju Chaudhary, Sagar Chaudhary and Mitia Devi.<\/p>\n<p>Further charge was framed for offence under Section 326<\/p>\n<p>against Sagar Chaudhary and charge under Section 323<\/p>\n<p>was framed against Mitia Devi.\n<\/p>\n<p>         4. However, during trial nine witnesses were<\/p>\n<p>examined as P.W. 1 Surajdeo Choudhary, P.W. 2 Satya<br \/>\n<span class=\"hidden_text\">                3<\/span><\/p>\n<p>Narayan Chaudhary, P.W. 3 Gagandeo Chaudhary, P.W.<\/p>\n<p>4, Ram Karan Chaudhary, P.W. 5 Kapil Prasad Sinha,<\/p>\n<p>P.W.6 Rajendra Chaudhary, P.W. 7, Hardeo Roy, P.W. 8<\/p>\n<p>Ramdhari Dinkar and P.W. 9 Dr. Sudhir Kumar Sinha.<\/p>\n<p>         5. The defence has adduced evidence three<\/p>\n<p>witnesses as D.W. 1, Mostmat Bhagiga Devi, D.W. 2,<\/p>\n<p>Mitto Devi and D.W. 3 Sagar Chaudhary.\n<\/p>\n<p>         6. On considering both oral and documentary<\/p>\n<p>evidence, appellant Sagar chaudhary convicted for offence<\/p>\n<p>under Sections 326 and 307 I.P.C. Other accused persons<\/p>\n<p>Ram Bhajju Chaudhary was died during trial and Mitia<\/p>\n<p>Devi was acquitted for offence under Section 307 and<\/p>\n<p>allied Sections.\n<\/p>\n<p>         7. Learned counsel for the appellant however,<\/p>\n<p>contends that prosecution has not been able to prove the<\/p>\n<p>charge with regard to the date and time of occurrence. He<\/p>\n<p>has also filed a complaint case and in the said complaint<\/p>\n<p>case he was filed a petition for calling the Station Diary<\/p>\n<p>dated 16. 10. 1984 from the Katihar and Injury Register<\/p>\n<p>dated 16. 10. 1984 from Katihar Sadar Hospital which was<\/p>\n<p>allowed on 03. 03. 1990, but the same was not received.<\/p>\n<p>Further contends that there is allegation of assault by farsa,<br \/>\n<span class=\"hidden_text\">                 4<\/span><\/p>\n<p>but there is no mention that farsa was inflicted on the neck<\/p>\n<p>for which offence under Section 307 is not made out. It<\/p>\n<p>has further been contended that occurrence is of the year<\/p>\n<p>1984 and more than twenty five years has elapsed and the<\/p>\n<p>appellant had face trial and appeal and hence lenient view<\/p>\n<p>may be taken.\n<\/p>\n<p>         8. However, learned counsel for the State,<\/p>\n<p>contends that witnesses have supported the prosecution<\/p>\n<p>case and the evidence of the Doctor has also support the<\/p>\n<p>amputation of the thumb of the informant and hence<\/p>\n<p>prosecution as alleged has been established.<\/p>\n<p>         9. However, taking into consideration the<\/p>\n<p>prosecution case as alleged in the Fardbeyan that<\/p>\n<p>occurrence took place when the informant asked Sagar<\/p>\n<p>Chaudhary about collection of fund on the eve of Durga<\/p>\n<p>Puja and its expenses, then there was verbal altercation<\/p>\n<p>and then Sagar went into the house and took the farsa and<\/p>\n<p>gave farsa blow which hit on the thumb causing<\/p>\n<p>amputation of the informant. However, Doctor found only<\/p>\n<p>injury of amputation of thumb and no other injury was<\/p>\n<p>found.\n<\/p>\n<p>         10. However, P.W. 6 has supported the<br \/>\n<span class=\"hidden_text\">               5<\/span><\/p>\n<p>prosecution case and in his evidence has stated that when<\/p>\n<p>the informant asked Sagar for collection and expense of<\/p>\n<p>Durga Puja, then Sagar abused and went into the house<\/p>\n<p>and brought with Farsa along with mother and father who<\/p>\n<p>were also armed with lathi and Sagar gave farsa blow on<\/p>\n<p>his neck which the informant tried to save the blow on him<\/p>\n<p>which caused injury on his thumb and amputated the<\/p>\n<p>thumb. However, P.W. 1, 2 and 4 has also supported P.W.<\/p>\n<p>6 in same and similar manner. However, in Fardbeyan,<\/p>\n<p>(Ext.1) there is specifically mentioned that on asking for<\/p>\n<p>income and expense of Durga Puja , Sagar abused and<\/p>\n<p>went to the house and brought farsa and assaulted him by<\/p>\n<p>farsa which hit on his left hand. However, there is no<\/p>\n<p>averment in the Fardbeyan that farsa was brandish on the<\/p>\n<p>neck while he was asking for collection of Durga Puja, he<\/p>\n<p>raised his thumb on which he got injury. Hence this is<\/p>\n<p>development in the prosecution case that Farsa was<\/p>\n<p>brandish on the neck. Attention of the statement of P.W. 6<\/p>\n<p>has been drawn in para 10 of his evidence that he has<\/p>\n<p>stated before Daroga which is not correct and he has not<\/p>\n<p>stated before Daroga that Sagar brandish farsa on the neck.<\/p>\n<p>However,    Daroga    has   not   been    examined    after<br \/>\n<span class=\"hidden_text\">                6<\/span><\/p>\n<p>examination of this witness and so contradiction not from<\/p>\n<p>Daroga, though, the Fardbeyan which is Ext. 1 which is<\/p>\n<p>apparently contradiction to the evidence of P.W. 6 in trial<\/p>\n<p>as in the Fardbeyan there is not mentioned of assault by<\/p>\n<p>Farsa on the neck and there is nothing mentioned the farsa<\/p>\n<p>was inflicted on the neck and in saving neck, thumb was<\/p>\n<p>amputated and hence this part of evidence that farsa blow<\/p>\n<p>given on the neck suffer from development and leading to<\/p>\n<p>contradiction and hence conviction under Section 307<\/p>\n<p>I.P.C. is not reliable and sustainable as there is only one<\/p>\n<p>injury as alleged to have been given on the thumb. There<\/p>\n<p>is no other injury except amputation of the thumb and on<\/p>\n<p>the Fardbeyan there is not mentioned that assault was<\/p>\n<p>made with intention to kill.\n<\/p>\n<p>         11. Hence taking into consideration the entire<\/p>\n<p>evidence and all material witnesses, who are eye<\/p>\n<p>witnesses, there is nothing in the evidence to suggest that<\/p>\n<p>assault was made with intention to kill even the injury of<\/p>\n<p>amputation of thumb is established and hence order of<\/p>\n<p>conviction and sentence recorded under Section 307 I.P.C.<\/p>\n<p>is not sustainable and is hereby set aside.<\/p>\n<p>         12. However, having regard to the facts and<br \/>\n<span class=\"hidden_text\">                 7<\/span><\/p>\n<p>circumstances, witnesses have supported the prosecution<\/p>\n<p>about assault by farsa causing injury on the thumb which<\/p>\n<p>caused amputation of thumb and Doctor has also<\/p>\n<p>supported the prosecution case about injury and even<\/p>\n<p>amputation of thumb and injury report has been proved.<\/p>\n<p>         13. Learned counsel for the appellant however,<\/p>\n<p>submitted that he has also filed a petition to call for Station<\/p>\n<p>Diary and Injury Register and even order dated 01. 03.<\/p>\n<p>1990 and 03. 03. 1990, to show that Station Diary entry<\/p>\n<p>and Injury Register was called for. However, neither the<\/p>\n<p>Station Diary entry nor Injury Register received in the case<\/p>\n<p>and Doctor who has proved the injury of the informant in<\/p>\n<p>his evidence has stated in his cross-examination. that he<\/p>\n<p>has no knowledge about any order has been passed by trial<\/p>\n<p>court, though, he has stated that he examined Ram Bhajju<\/p>\n<p>Chaudhary. However, this witness has stated that he has<\/p>\n<p>examined Ram Bhajju Chaudhary and Mitia Devi and<\/p>\n<p>found injury.\n<\/p>\n<p>         14. However, there is not mentioned about nature<\/p>\n<p>of injury and evidence of Doctor on the basis of photo<\/p>\n<p>copy has got no significance about nature of injury is<\/p>\n<p>simple or superficial.\n<\/p>\n<p><span class=\"hidden_text\">                8<\/span><\/p>\n<p>         15. However, defence has examined in the case<\/p>\n<p>that Rajendra Chaudhary entered into courtyard and<\/p>\n<p>assaulted mother and father of Sagar Chaudhary.<\/p>\n<p>However, evidence of witnesses have also supported that<\/p>\n<p>there was altercation between Sagar and Rajendra<\/p>\n<p>Chaudhary with regard to collection of Durga Puja.<\/p>\n<p>However, claimed that occurrence took place in the<\/p>\n<p>courtyard. However, it is stated that father and mother has<\/p>\n<p>been injured, but the injury report was not called for.<\/p>\n<p>However, injury has not been proved in the case and father<\/p>\n<p>and mother of the defence emphatically stated a petition<\/p>\n<p>has been filed which was submitted in the court.<\/p>\n<p>However, from perusal of the record, it appears that a<\/p>\n<p>petition was filed only 1990 which was allowed by the<\/p>\n<p>court on 03. 03. 1990, but the appellant did not press it and<\/p>\n<p>there is nothing on the record to show the appellant pursue<\/p>\n<p>the matter, though, the case was disposed of in the year<\/p>\n<p>1996 after five years of the filing of the petition. But the<\/p>\n<p>appellant did not pursue the same and hence there is no<\/p>\n<p>merit in the submission and prejudice when the appellant<\/p>\n<p>convicted and slumber was made.\n<\/p>\n<p>         16. However, taking into consideration the<br \/>\n<span class=\"hidden_text\">                                   9<\/span><\/p>\n<p>                   evidence that witnesses have supported the prosecution<\/p>\n<p>                   case and P.W. 2, 4 and 6 are material witnesses who are<\/p>\n<p>                   also supported the prosecution case and the allegation of<\/p>\n<p>                   assault corroborated by the medical evidence of P.W. 6.<\/p>\n<p>                   Hence, I find and hold that prosecution has been able to<\/p>\n<p>                   prove the charges under Section 326 of Penal Code for<\/p>\n<p>                   alleged injury causing amputation of thumb.<\/p>\n<p>                            17. However, taking into consideration the fact<\/p>\n<p>                   that occurrence is of the year 1984 and the appellant suffer<\/p>\n<p>                   a lot during trial and appeal and during trial the appellant<\/p>\n<p>                   remained in jail four about ten months from 10.11. 1984 to<\/p>\n<p>                   12. 09. 1985 and from 01. 12. 1995 to 26. 08. 1996.<\/p>\n<p>                   Hence, the end of justice shall meet by sentencing the<\/p>\n<p>                   appellant for period already undergone and spent in jail<\/p>\n<p>                   during investigation and after conviction.
