MEHTA)<\/p>\n<p>1.\t\tThe present<br \/>\nappeal calls into question the judgment and order dated 17.06.1999<br \/>\npassed by the learned Additional Sessions Judge, Banaskantha-Palanpur<br \/>\nin Sessions Case No.23 of 1999 convicting the appellant for offence<br \/>\npunishable under Section 302 of the Indian Penal Code [?SIPC?? for<br \/>\nshort] and sentencing him to suffer imprisonment for life and pay<br \/>\nfine of Rs.500=00, in default to suffer S.I. for one month.\n<\/p>\n<p>2.\t\tThe case of the<br \/>\nprosecution as unfolded before the trial Court is as follows:\n<\/p>\n<p>\t\tOne Motibhai had<br \/>\ntwo sons namely, Premjibhai (deceased) and Bhemjibhai (accused). Said<br \/>\nMotibhai passed away about four years prior to the incident. Before<br \/>\nhis death, he had divided his 6 vighas of lands in equal parts<br \/>\nand had given about 3 vighas each to both his sons. Deceased<br \/>\nPremjibhai was a believer of Radhaswami Sect and would often<br \/>\nvisit Beas (Punjab). Therefore, instead of cultivating his<br \/>\nland personally, he would give out his land for cultivation to other<br \/>\npersons of the village in return of a lump sum amount. This had<br \/>\nremained a bone of contention between the two brothers; Bhemjibhai<br \/>\nwanting to have his brother gave the land to him for cultivation. On<br \/>\nhis insistence, deceased Premjibhai gave his share of the land to his<br \/>\nbrother Bhemjibhai for cultivation against a lump sum amount of<br \/>\nRs.1500=00 in year 1998. It is the case of the prosecution that out<br \/>\nof this amount, Rs.300=00 had remained outstanding and for recovery<br \/>\nof the said amount, Premjibhai often used to visit Bhemjibhai and ask<br \/>\nfor the money. On 22.03.1998 at about 8.00 O&#8217; clock in the evening,<br \/>\nPremjibhai had gone to the house of Bhemjibhai for getting back his<br \/>\noutstanding amount. At that time, Vaghjibhai Virsangbhai-complainant<br \/>\n(P.W.-7), Sardarbhai Nathuhai (P.W.-8), Bhagwanbhai Dalsangbhai<br \/>\n(P.W.-9) and Manjibhai Virsangbhai (P.W.-10) were also present. It is<br \/>\nfurther the case of the prosecution that a quarrel took place between<br \/>\ndeceased Premjibhai and appellant Bhemjibhai over repayment of money<br \/>\nand Bhemjibhai gave a threat to Premjibhai to kill him at night.<br \/>\nThereafter, deceased Premjibhai went to his house. Next morning, when<br \/>\nVaghjibhai Virsangbhai returned from his farm, he was informed about<br \/>\nthe death of his cousin Premjibhai. Therefore, Vaghjibhai lodged a<br \/>\ncomplaint with the Police. After the investigation, charge-sheet came<br \/>\nto be filed against accused Bhemjibhai for the offence under Section<br \/>\n302 IPC. As the offence was exclusively triable by Court of Sessions,<br \/>\nit was committed to Sessions Court where it was numbered as Sessions<br \/>\nCase No.23 of 1999. The learned Additional Sessions Judge,<br \/>\nBanaskantha at Palanpur, framed charge at Exhibit 4 for the aforesaid<br \/>\noffence. The charge was read over and explained to the accused, who<br \/>\npleaded not guilty to the charge and claimed to be tried. Therefore,<br \/>\nthe prosecution led the evidence. After recording of evidence was<br \/>\nover, the learned trial Judge explained to the accused incriminating<br \/>\ncircumstances appearing against him in the evidence of prosecution<br \/>\nand recorded his further statement under Section 313 of the Code of<br \/>\nCriminal Procedure, 1973. In his further statement, the accused<br \/>\ndenied the case of the prosecution.\n<\/p>\n<p>3.\t\tOn appreciation<br \/>\nof the evidence, the trial Court relying upon the evidence of<br \/>\ncomplainant Vaghjibhai Virsangbhai (P.W.-7), Investigating<br \/>\nOfficer? Ramjibhai Laljibhai Patel (P.W.-12) and the evidence of<br \/>\nrecovery of weapon of offence at the instance of the accused, found<br \/>\nthe charge against the accused as proved and convicted him for the<br \/>\noffence punishable under Section 302 IPC and imposed the sentence as<br \/>\nstated above.\n<\/p>\n<p>\t\tBeing aggrieved by<br \/>\nthe said decision, the appellant-convict has preferred this appeal.\n<\/p>\n<p>4.\t\tWe have heard<br \/>\nMr.Jaiprakash Umot, learned advocate appearing for the appellant and<br \/>\nMr.Maulik Nanavati, learned Additional Public Prosecutor for the<br \/>\nrespondent-State and with their assistance, we have perused the<br \/>\nrecord and proceedings of the trial Court.\n<\/p>\n<p>5.\t\tMr.Umot, learned<br \/>\nadvocate for the appellant, has submitted that the trial Court has<br \/>\nerred in convicting the appellant by relying upon the evidence of the<br \/>\nInvestigating Officer and the statements of witnesses recorded by the<br \/>\nPolice during the course of investigation, particularly when the said<br \/>\nwitnesses have denied having given such statements to the Police. He<br \/>\nhas submitted that the evidence of complainant &#8211; Vaghjibhai<br \/>\nVirsangbhai (P.W.-7), on whose evidence great reliance has been<br \/>\nplaced by the learned trial Judge, does not conclusively indicate or<br \/>\nsuggest the guilt of the accused.  As regards the evidence of<br \/>\ndiscovery of the weapon of offence, the learned advocate for the<br \/>\nappellant has submitted that the same has not been proved and,<br \/>\ntherefore, no reliance ought to have been placed on the same. On the<br \/>\nother hand, the learned Additional Public Prosecutor for the State<br \/>\nhas supported the judgment of the trial Court and submitted that the<br \/>\nfindings of the trial Court are correct and have been arrived at<br \/>\nafter proper appreciation of the evidence.\n<\/p>\n<p>6.\t\tIt appears from<br \/>\nthe evidence that there was no eyewitness to the incident and the<br \/>\nprosecution is launched on the basis of circumstantial evidence. On<br \/>\nscrutiny of the evidence, we find that the complainant (P.W.-7)<br \/>\nthough has narrated in the complaint lodged on 23.03.1998 that there<br \/>\nwas a quarrel between Premjibhai and Bhemjibhai about non-payment of<br \/>\nRs.300=00 on previous day, i.e. on 22.03.1998 and appellant<br \/>\nBhemjibhai had threatened to kill Premjibhai that night, he has<br \/>\nremained silent in his evidence before the Court about any quarrel<br \/>\nhaving taken place between the appellant and the deceased over issue<br \/>\nof non-payment of Rs.300=00 or that the appellant having given any<br \/>\nthreat to kill Premjibhai. On the contrary, he has deposed that on<br \/>\nthe deceased asking the appellant for money, the appellant told him<br \/>\nthat he would pay up the money next morning. This is an important<br \/>\ncontradiction, particularly when the prosecution story rests<br \/>\nprimarily on the events of the previous evening wherein the appellant<br \/>\nis alleged to have given a threat to the deceased to kill him in the<br \/>\nnight. We find that to this extent, the complainant has not stuck to<br \/>\nhis original statement given before the Police and in absence of him<br \/>\nhaving been declared hostile, his evidence must be held binding on<br \/>\nthe prosecution. The other witnesses, who according to the<br \/>\nprosecution, were present at the previous evening when alleged<br \/>\naltercation took place between the deceased and the appellant, have<br \/>\nnot supported the case of the prosecution and have been declared<br \/>\nhostile. Even in their cross-examination, nothing could be elicited<br \/>\nby the learned Prosecutor, which would lend credence or corroborate<br \/>\nthe evidence of the complainant (P.W.-7) or further the case of the<br \/>\nprosecution as regards motive to kill the deceased except to the fact<br \/>\nthat Premjibhai was giving his land for cultivation to others and for<br \/>\nthat particular year Bhemjibhai was cultivating the land of<br \/>\nPremjibhai. The evidence of all these witnesses does not prove even<br \/>\nremotely that a quarrel had taken place between the deceased and the<br \/>\nappellant in the evening on 22.03.1998 and that the appellant on<br \/>\ngetting infuriated had threatened to kill the deceased and in<br \/>\nfurtherance thereof committed the offence.\n<\/p>\n<p>7.\t\tThe other<br \/>\nevidence relied upon by the prosecution is the recovery of weapon of<br \/>\noffence at the instance of the accused. The panch witnesses<br \/>\nhave not supported the prosecution case and have been declared<br \/>\nhostile. The panch witnesses, Hareshbhai Babubhai Chaudhary<br \/>\n(P.W.-5, Exhibit 23) and Kanjibhai Haribhai (P.W.-6, Exhibit 27) have<br \/>\nonly identified their signatures on panchnama Exhibit 26. Even<br \/>\notherwise also alleged recovery is from a public place and, hence, it<br \/>\ncannot form the basis of conviction.\n<\/p>\n<p>8.\t\tOn perusal of<br \/>\nthe record, we find that there is no other evidence led by the<br \/>\nprosecution to prove the guilt of the accused. This being a case of<br \/>\ncircumstantial evidence, it is necessary for the prosecution to<br \/>\nestablish  conclusively the chain of events and circumstances, which<br \/>\npoint unerringly the guilt of the accused. As observed above, we find<br \/>\nthat the prosecution has not been able to prove the circumstances<br \/>\nestablishing conclusively the guilt of the accused.\n<\/p>\n<p>9.\t\tFor the<br \/>\nforegoing reasons, we are of the considered opinion that the<br \/>\nprosecution has failed to prove its case against the appellant and<br \/>\nthe learned trial Judge committed error in relying upon such evidence<br \/>\nin convicting the appellant. Therefore, the appellant is required to<br \/>\nbe acquitted.\n<\/p>\n<p>\t\tIn the result, the<br \/>\nappeal is allowed. The conviction of the appellant recorded under<br \/>\nSection 302 IPC and the sentence imposed by the learned Additional<br \/>\nSessions Judge, Banaskantha-Palanpur, vide judgment and order<br \/>\ndated 17.06.1999 in Sessions Case No.23 of 1999 is hereby quashed and<br \/>\nset aside. The appellant is ordered to be set at liberty forthwith if<br \/>\nnot required in any other case.
