Civil Judge<br \/>\n(S.D.), Mehsana in L.A.R. Nos.391\/2001 to 407\/2001, whereby, the said<br \/>\nreference cases were partly allowed and the original claimants were<br \/>\nawarded total compensation @ Rs.30.50 per sq. metre for their<br \/>\nacquired lands.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that the appellant-State proposed to acquire the<br \/>\nlands belonging to the original claimants, situated at Village<br \/>\nAdundara, Taluka Kadi, District Mehsana, for the purpose of<br \/>\nconstructing the Narmada Canal, under the Land Acquisition Act, 1894.<br \/>\nNecessary procedure was initiated and on completion of all the legal<br \/>\nformalities, the S.L.A.O. passed an award granting compensation @<br \/>\nRs.4.50 per sq. metre for the acquired lands.\n<\/p>\n<p>3.\tBeing<br \/>\naggrieved by the said award, the original claimants filed<br \/>\napplications before the authority requesting to refer the issue to<br \/>\nthe competent Court for adjudication, which, ultimately, came to<br \/>\nnumbered as references. The Court below, after appreciating the<br \/>\nevidence on record, partly allowed the references by awarding total<br \/>\ncompensation of Rs.30.50 for the acquired lands. Against the said<br \/>\naward, the appellant has approached this Court by way of these<br \/>\nappeals.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It is well-settled that a previous award of a reference<br \/>\nCourt relating to a Village, which has attained finality, can be<br \/>\nconsidered to be a good piece of evidence, for the purpose of<br \/>\ndetermining the market value of similar lands, acquired subsequently,<br \/>\nfrom the adjoining village. A group of reference cases pertaining to<br \/>\nlands belonging to the same village, i.e. Village Adundara being<br \/>\nL.A.R. Nos.353\/2001 to 363\/2001 disposed of on 27.11.2001, has been<br \/>\nconfirmed by this Court in First Appeal Nos.2959\/2004 to 2966\/2004<br \/>\ndated 23.03.2005, wherein, this Court has confirmed the award passed<br \/>\nby the reference Court awarding compensation @ Rs.30.50 per sq. metre<br \/>\nfor the acquired lands. Hence, the claimants in these appeals shall<br \/>\nalso be entitled for the same amount of compensation, as has been<br \/>\nawarded in the aforesaid reference cases. In the present case, since<br \/>\nthe claimants have been awarded compensation @ Rs.30.50 per sq. metre<br \/>\nfor their acquired lands, no modification is required to be made in<br \/>\nthe impugned award.\n<\/p>\n<p>5.\tIn<br \/>\nthe result, the appeals are dismissed.
