Justice V.RAMKUMAR\n\n Dated :16\/07\/2010\n\n O R D E R\n                       V.RAMKUMAR, J.\n                 -------------------------------------\n                 W.P(C) No. 17283 of 2010\n                --------------------------------------\n            Dated this the 16th day of July, 2010\n\n                        J U D G M E N T\n<\/pre>\n<p>      Petitioner, who was conducting grocery and stationery<\/p>\n<p>business at Parappul, seeks a direction to the 1st respondent<\/p>\n<p>Dy.S.P, CBCID (Crime Branch) to take over the investigation<\/p>\n<p>of the Crime No.65\/2010 of Taliparamba Police Station<\/p>\n<p>registered for offences punishable under Sections 143, 147,<\/p>\n<p>448 and 436 read with 149 IPC. The occurrence forming the<\/p>\n<p>subject matter of the above crime took place at 2.30 AM on<\/p>\n<p>16.1.2010. The accused formed themselves into an unlawful<\/p>\n<p>assembly and trespassed into the shop of the petitioner by<\/p>\n<p>breaking the lock of shutter, set fire to the shop and had<\/p>\n<p>blasted the merchandise using explosives. The petitioner has<\/p>\n<p>sustained a loss of Rs.8 Lakh. According to the petitioner, the<\/p>\n<p>investigation by the local police (Taliparamba) has not made in<\/p>\n<p>headway and except the 1st accused namely one Muhammed<\/p>\n<p>Sali rest of the culprits have not been apprehended.<\/p>\n<p>      2.    The Circle inspector of Police, Taliparamba, who is<\/p>\n<p>in-charge of the investigation has filed a statement in which it<\/p>\n<p>is inter alia stated as follows:-\n<\/p>\n<p>W.P(C) No. 17283of 2010<br \/>\n<span class=\"hidden_text\">                                : 2 :<\/span><\/p>\n<p>            &#8220;Recently there was series of incidents at<br \/>\n      Koranpeedika, Pariyaram, Onaparamba, Echilmotta,<br \/>\n      Adipalam, Chithapilepoil etc. of Pariyaram and Ezhome<br \/>\n      Panchayats. Several houses were damaged and several<br \/>\n      persons sustained injuries.      All together 31 crimes<br \/>\n      were registered against hundreds of people for<br \/>\n      committing riots, unlawful assembly, attempt to<br \/>\n      murder, house breaking, dacoity, theft, robbery etc. At<br \/>\n      the time and after the above said incident, the police<br \/>\n      officers of Taliparamba, Pazhayangadi, Pariyaram<br \/>\n      Police Stations and officers of the nearby Police<br \/>\n      stations were used to control the situation. Moreover,<br \/>\n      Armed force personnels from AR Camp, Kannur as well<br \/>\n      as from Armed Battalion such as KIP-IV, MSP,<br \/>\n      Malappuram etc. were used.            The situation in<br \/>\n      Pariayaaram was very tense and to tackle the same, I<br \/>\n      and Sub Inspectors of Taliparamba Police Station was<br \/>\n      fully engaged and therefore, for some days, I could not<br \/>\n      thoroughly purse the investigation of this crime. Now<br \/>\n      the situation is fully under control and investigation in<br \/>\n      this case is going on, on a full swing. Now the crime is<br \/>\n      pending for want of arrest of the remaining persons<br \/>\n      and for examination report from the Government<br \/>\n      Regional Chemical Examiner&#8217;s Laboratory, Kozhikkode.<br \/>\n      The police force will try for their level best to<br \/>\n      apprehend the remaining accused persons and to book<br \/>\n      them properly.&#8221;\n<\/p>\n<p>      3.    The culprits who are yet to be arrested as per the<\/p>\n<p>said statement are Sajeer.M.K, Noushad.K, Noushad.P,<\/p>\n<p>K.Thajudheen @ Thaju, Ismail, Musammal.K and Hameed.M.K.<\/p>\n<p>      4.    The learned Public Prosecutor submitted that<\/p>\n<p>investigation is being conducted with all earnestness and<\/p>\n<p>vigilance and that the police will soon complete the<\/p>\n<p>investigation.\n<\/p>\n<p>W.P(C) No. 17283of 2010<br \/>\n<span class=\"hidden_text\">                              : 3 :<\/span><\/p>\n<p>      5.    I am of the view that some more time can be given<\/p>\n<p>to the Circle Inspector of Police to complete the investigation<\/p>\n<p>within a time frame, failing which, the petitioner can move the<\/p>\n<p>J.F.C.M Court, Taliparamba for entrusting the investigation<\/p>\n<p>with the Crime Branch Police. Accordingly, this writ petition<\/p>\n<p>is disposed of directing the Circle Inspector of Police,<\/p>\n<p>Taliparamba to complete the investigation within three<\/p>\n<p>months from today and file a final report before the J.F.C.M<\/p>\n<p>Court, Taliparamba immediately thereafter.         In case the<\/p>\n<p>investigation is not completed and a final report is not filed<\/p>\n<p>as aforesaid, the petitioner shall be entitled to move the<\/p>\n<p>J.F.C.M Court, Taliparamba for appropriate orders including<\/p>\n<p>one for further investigation by the Crime Branch Police in the<\/p>\n<p>light of Sakkiri Vasu v.
