(C) No.23723 of 2008)\n\n\nDevarasu                                                                ...Appellant(s)\n\n                                             Versus\n\nVeerasekaran &amp; Anr.                                                 ...Respondent(s)<\/pre>\n<pre>                                    O    R     D   E    R\n\n\n             Leave granted.\n<\/pre>\n<p>             The suit filed by the appellant for declaration of<br \/>\ntitle and permanent injunction was decreed by the trial<br \/>\nCourt vide judgment dated 31.1.1995.                           The appeal preferred<br \/>\nby     the    respondents          was        dismissed        by       District      Judge,<br \/>\nVillupuram but the second appeal filed by them has been<br \/>\nallowed       by    the     High    Court       and     suit       of    the    plaintiff-<br \/>\nappellant dismissed.               Hence, this appeal by special leave.\n<\/p>\n<p>             We have heard learned counsel for the parties and<br \/>\nscrutinized the records.                      In our opinion, the impugned<br \/>\njudgment is liable to be set aside only on the ground of<br \/>\nviolation of Section 100 of the Code of Civil Procedure.<br \/>\nSub-section(1) of Section 100 lays down that an appeal<br \/>\nshall lie to the High Court from every decree passed in<br \/>\nappeal by any court subordinate to the High Court, if the<br \/>\nHigh     Court       is     satisfied          that         the     case       involves   a<br \/>\nsubstantial question of law. Sub-section(4) lays down that<br \/>\nwhere    the       High     Court       is    satisfied           that    a     substantial<br \/>\nquestion       of     law    is     involved           in    any        case,    it   shall<br \/>\nformulate          that    question.          In terms of sub-section 5, the<br \/>\n                                                                                      &#8230;2\/-\n<\/p>\n<p>                                      &#8211; 2 &#8211;\n<\/p>\n<p>appeal     is    required      to     be     heard    on     the       question      so<br \/>\nformulated and respondent at liberty to argue that the<br \/>\ncase does not involve such question.                             Proviso to sub-<br \/>\nsection(5)       empowers     the     High    Court,       for    reasons       to   be<br \/>\nrecorded,       to   hear    the    appeal     on    any    other       substantial<br \/>\nquestion of law which may not have been formulated in<br \/>\nterms    of     sub-section(4).              In     the    present        case,      no<br \/>\nsubstantial question of law was framed by the High Court<br \/>\ntill     the    commencement          of    hearing.             The    substantial<br \/>\nquestion enumerated in para 8 of the impugned judgment was<br \/>\nformulated only during the course of argument.                                 This is<br \/>\nlegally impermissible.              Unless the question is formulated<br \/>\nand the respondent is put to notice in relation to such<br \/>\nquestion, he\/she is deprived of the opportunity to make<br \/>\nsubmissions with reference to the substantial question of<br \/>\nlaw formulated by the High Court and also show that the<br \/>\ncase does not involve such question.\n<\/p>\n<p>          Accordingly,         the     appeal        is    allowed,        impugned<br \/>\njudgment is set aside and the matter is remitted to the<br \/>\nHigh Court.          Now, the High Court shall consider whether<br \/>\nany    substantial         question    of    law     arises       in     the    second<br \/>\nappeal or not.             If it comes to the conclusion that the<br \/>\nsame    arises,      in     that    eventuality,          the     same    shall      be<br \/>\nformulated.
