The respondent herein has notified<\/p>\n<p>L<\/p>\n<p>various posts is. 42 posts of Helper-B, 3 posts of AS! and<br \/>\n9 posts of AT] as per advertisement bearing No. 212003<br \/>\nvide Annexure-C. It is the case of the petitionereggthat,<\/p>\n<p>under me Classi\ufb01cation of vacancies, as <\/p>\n<p>vacancies are notified for the post of Henpergeahgs has <\/p>\n<p>Rules governing the recruitrnent, Le&#8230;&#8217;the~Kern*ataVk:a:_&#8217;__V$tate &#8216;<\/p>\n<p>Road Transport Corporation__. (Cadre and<\/p>\n<p>Regulations, 1982 re;eervatior\u00a7VV&#8217;jie1y_fe\\(our&#8217;e&#8217;f\u00abEieservice man<\/p>\n<p>and the members ef&#8221;their&#8221;fai\u00a7rij.i3r,-erexrided for and the<\/p>\n<p> that the percentage of<br \/>\nnumber:  apart for direct recruitment to<\/p>\n<p>any Ciass&#8221;!lV_|:Vcr.(3lassV&#8217;i&#8217;\u00a3n? posts in the Corporation shall be<\/p>\n<p>   by. &#8220;brby such number as is equai to 10% of<\/p>\n<p> &#8216;V the -viesaheies and the percentage or number was<\/p>\n<p>Aredtieed-shall be \ufb01lled by dirmt rmruitment amongst the<\/p>\n<p>V ~ 5:3:-servicemen and members of the families of persons<\/p>\n<p>erhiie serving in the armed forces of the Union who have<\/p>\n<p> either killed or permanently disabled. Fur\ufb01ier grievance<\/p>\n<p>of the petitioners is met, in View of the relevant provisions<\/p>\n<p>A<\/p>\n<p>as referred above, atieast, four posts ought .to\u00ab,phave<\/p>\n<p>been reserved in favour of Ex-servicemen, ge-:1 _\u00e9&#8217;eo_ntr_a&#8217;:&#8221;y,<\/p>\n<p>oniy one post has been reserved in&#8230;.\u00a7vA&#8217;ajvou\u00e9{:: of :<\/p>\n<p>servicemen in the noti\ufb01cation.  &#8216;<\/p>\n<p>candidate for recruitment vto&#8217;~\ufb011e  of  <\/p>\n<p>requisite quali\ufb01cation and also a<br \/>\ncandidate for &#8216;E18   inspector and<br \/>\nAssistant   the requisite<br \/>\n_fg&#8217;i:i_y::&#8221;quaiiiied and eligible to be<br \/>\nappointed  as noti\ufb01ed therein. Be<br \/>\nthat   respondent now pubiished e<\/p>\n<p>notit&#8221;i.oetion&#8217;  &#8216;Jihiaye Kamataka daily news paper dated<\/p>\n<p>   the cut off percentage of the<\/p>\n<p>    for the various posts. In the said<\/p>\n<p> tat Si.No.&#8217;i-4 die cut off percentage of persons<\/p>\n<p>  *  to the post of Helper-B is notified and as couid<\/p>\n<p>1&#8217;A&#8217;&#8211;!I:&#8217;:&#8221;e&#8217;AAseen, no person under the Ex-Military personnei has<\/p>\n<p>it  been seiected, eventhough die noti\ufb01cation stipuiated that<\/p>\n<p>one post is eer- marked for Ex&#8211;Miiitary personnei, and no<\/p>\n<p>\/4<\/p>\n<p>.5.\n<\/p>\n<p>Ex-Military personnel were selected for the post of<\/p>\n<p>Assistant Traf\ufb01c Inspector and for Assistant <\/p>\n<p>Inspector. In pursuance of me said provisiienieliwi&#8217; list,<\/p>\n<p>petitioners have \ufb01led their objeotions wider:<\/p>\n<p>and K. ln pursuance of the :ebje\u00a3ti.on4s..1iiAled&#8221;by&#8211;..&#8217;__tl&#8217;zsse &#8221;<\/p>\n<p>petitioners, respondent&#8217; &#8216;   &#8216;now it   V   &#8220;another: &#8221;<\/p>\n<p>advertisement on 23_.9.20(}3&#8230;ili(l:.erein, itihesobueen notified<br \/>\nthat reservation .tE:c+serviceman has<\/p>\n<p>been converted   voategory. The said<\/p>\n<p> has been done solely<br \/>\nto seized&#8217; the  by the respondent and the<\/p>\n<p>same is\u00b0&#8217;ill\u00a7gel&#8217;;  bonafide and contrary to the<\/p>\n<p>  _reieve&#8221;nt  ..__ResguVl\u00e9tions of the respondent-Corporation.<\/p>\n<p>   peti\ufb01oners are conseained to redress their<\/p>\n<p>;gi*ieve;nce5&#8243;hy way of presenting this writ petition, assailing<\/p>\n<p> r~ the  of the impugned advertisement issued<\/p>\n<p> published vide Annexure-L dated 23.9.2003 and<\/p>\n<p>it  seeking necessary relief as statw supra.<\/p>\n<p>A<\/p>\n<p><span class=\"hidden_text\">-6-<\/span><\/p>\n<p>3. After careful perusal of the grounds urged by the<br \/>\npetitioners and other materials available on file, what has<\/p>\n<p>been assailed in this writ petition is the edverttsemem<\/p>\n<p>dated 23.9.2003 vide Annexure-L isstgedf <\/p>\n<p>respondent, so far as it relatfw to_&#8211;~&#8217;eEeseitieat\u00abiott<\/p>\n<p>vacancies in respect of Post Heipet*-B&#8217;.and:&#8221;&#8216;de4reeeteittg i&#8217;<\/p>\n<p>the vacancy ear marked i\ufb01_&#8217;iayour&#8221;of:  and&#8217;<\/p>\n<p>treating it as belonging to ,,c3tefr=ererMerrt\u00aboatet3ory. It is<\/p>\n<p>significant to note eel,teeetgeeeeltee  rnade out by the<\/p>\n<p>   it &#8220;ptediv nor it is a ground for<br \/>\nimerferehee eye thielVG.o\u00a3itt:,: the advertisement team by the<br \/>\nrespontzlent, it  epeoi\ufb01eiilly referred that, there was a mistake<\/p>\n<p>&#8216;\u00a7&#8217;t~htgf.f..:eer_iier notitieet&#8217;ion and it has been corrected by way of<\/p>\n<p>i rerlgwtng,ifcerrtttertctum and it shouid be read as sl.No.t and 2<\/p>\n<p>&#8221; ettd th_e.i;t\u00a7&#8217;1i$.i:hO noti\ufb01cation as such has been issued modifying<\/p>\n<p>the reservation. The contents of the advertisement is crystal<\/p>\n<p>&#8221;  iolear that, there was a mistake and that has been rectified by<\/p>\n<p>i  way of issuing another advertisement. The competent<\/p>\n<p>authorities who have issued the noti\ufb01cation, found some error<\/p>\n<p>or mistake committed by them inadvertently, they are entitled<\/p>\n<p>to ciarify the same by way of issuing corrigendum and it<br \/>\nshould be read as clarifying the mistake committed earlier in<br \/>\nthe noti\ufb01cation. It is not a ground for questioning the<\/p>\n<p>advertisement issued by respondent itseif, Mthegrtye\ufb01eeiirenang<\/p>\n<p>the original noti\ufb01cation. The petitioners cannetr\ufb01ermashtesnwe <\/p>\n<p>writ petition and therefore, the  &#8220;eetitren&#8221;..\ufb01led:A\u00a7y\u00ab.eet\ufb01i&#8217;onLere &#8216; T. <\/p>\n<p>is liable to be dismissed as mis conceived.<\/p>\n<p>4.
