No. 7857 of 2011.\n<\/p>\n<p>                                        This application under Section 5 of the Limitation<br \/>\n                      Act is filed by the appellant for condonation of delay of 145 days<br \/>\n                      occurred in filing the Letters Patent Appeal.\n<\/p>\n<p>                                        It appears that against the order of the learned single<br \/>\n                      judge, the appellant first approached the Hon&#8217;ble Supreme Court.<br \/>\n                      He withdrew the proceedings before the Hon&#8217;ble Supreme Court<br \/>\n                      and filed the present Letters Patent Appeal on 17 th November<br \/>\n                      2011.\n<\/p>\n<p>                                        On the facts and in the circumstances of the case, the<br \/>\n                      delay is condoned.\n<\/p>\n<p>                                        Interlocutory Application stands disposed of.<br \/>\n                                        Re. LPA No. 1709 of 2011.\n<\/p>\n<p>                                        Feeling aggrieved by the order dated 30th March<br \/>\n                      2011 made by the learned single Judge in CWJC No. 12426 of<br \/>\n                      2010, the writ petitioner has preferred this Appeal under Clause 10<br \/>\n                      of the Letters Patent.\n<\/p>\n<p>                                        It appears that the appellant was first appointed in<br \/>\n                      1975 as a Lecturer under the respondent Ram Jaipal College,<br \/>\n                      Chapra, then a private college. The management of the said<br \/>\n                      college was taken over as a constituent college under the then<br \/>\n                      Bihar University. At that time, the service of the appellant was not<br \/>\n                      absorbed as an employee of the University. Feeling aggrieved, the<br \/>\n                      appellant raised the dispute as late as in 1994 in CWJC No. 8670<br \/>\n                      of 1994. The said petition came to be dismissed on 1st September<br \/>\n<span class=\"hidden_text\"> 3        Patna High Court LPA No.1709 of 2011 (3) dt.22-11-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                               3\/3<\/span><\/p>\n<p>                  1995. The order of the learned single Judge was confirmed on 31 st<br \/>\n                  July 1996 by the Division Bench in LPA No. 1346 of 1995.<br \/>\n                  Challenge to the said order before the Hon&#8217;ble Supreme Court also<br \/>\n                  failed. The petition for Special Leave to Appeal (Civil) No. 21180<br \/>\n                  of 1996 came to be dismissed on 4th November 1996.\n<\/p>\n<p>                                    Although the appellant lost the first round of<br \/>\n                  litigation up to the Hon&#8217;ble Supreme Court, he was not satiated.<br \/>\n                  He raised the issue again after eight years in CWJC No. 15846 of<br \/>\n                  2004. The learned single Judge by order dated 18 th April 2008<br \/>\n                  allowed the appellant to withdraw the writ petition to approach His<br \/>\n                  Excellency the Chancellor. It appears that His Excellency the<br \/>\n                  Chancellor having considered the representation made by the<br \/>\n                  appellant rejected the same under order dated 4th June 2010.<br \/>\n                  Feeling aggrieved, the appellant filed the above CWJC No. 12426<br \/>\n                  of 2010. The same is rejected by the learned single Judge under<br \/>\n                  the impugned order dated 30th March 2011. Therefore, the present<br \/>\n                  Appeal.\n<\/p>\n<p>                                    It is apparent that the appellant has abused the<br \/>\n                  process of law by filing repeated writ proceedings in the same<br \/>\n                  subject matter. The learned single Judge has rightly dismissed the<br \/>\n                  writ petition. Further the appellant has been out of service since<br \/>\n                  1980 till the date and he is now nearing the age of superannuation.<br \/>\n                  The appellant&#8217;s claim could not have been entertained at this<br \/>\n                  belated stage.\n<\/p>\n<p>                                    For the aforesaid reasons, the Appeal is dismissed in<br \/>\n                  limine.<\/p>\n<pre>\n                                                        (R.M.
