Mehta, Actg CJ)<br \/>\n     The Gujarat State Road Transport Corporation<br \/>\n     (hereinafter referred to as &#8220;GSRTC&#8221; for brevity) is<br \/>\n     aggrieved by the judgment and order dated 1.7.1996 of the<br \/>\n     learned Single Judge, granting full back wages subject to<br \/>\n     deduction of Rs.150\/- per month from the date          of<br \/>\n     dismissal till the date of reinstatement of the workman.<br \/>\n     According to the learned counsel for the appellant this<br \/>\n     award of full back wages is not justified.\n<\/p>\n<p>     2.The workman-driver was     dismissed   from   the<br \/>\n     services   on   the   alleged ground of misconduct of<br \/>\n     negligence by which a head-on collision between two GSRTC<br \/>\n     buses took place. In Motor Accident case this driver has<br \/>\n     been exonerated and found &#8216;not negligent&#8217; and the sole<br \/>\n     negligence was fixed on the driver of the other bus of<br \/>\n     GSRTC involved in the accident.   In the criminal case<br \/>\n     also he has been found not guilty. The Panchnama and<br \/>\n     scene of the accident clearly show that the bus of the<br \/>\n     respondent\/ driver was on the extreme left of the road<br \/>\n     and was on correct side of the road, whereas the other<br \/>\n     bus had gone on the wrong side and dashed against the bus<br \/>\n     driven by the respondent.\n<\/p>\n<p>       3.In view of this evidence the learned Single Judge<br \/>\n      came to the conclusion that the Inquiry Officer of the<br \/>\n      Labour Court was utterly wrong in finding the driver\/<br \/>\n      respondent herein guilty of negligence.\n<\/p>\n<p>      4.The   Labour   Court   had,   however,   directed<br \/>\n      reinstatement of the respondent herein, but without back<br \/>\n      wages.   The learned Single Judge has awarded back wages.<br \/>\n      However, on the basis of evidence on record that the<br \/>\n      respondent\/ driver was earning Rs.150\/- per month, the<br \/>\n      said amount is directed to be deducted and the balance<br \/>\n      amount of back wages was directed to be paid.\n<\/p>\n<p>      5.When the workman has been found not to have<br \/>\n      committed any misconduct, there is no question of any<br \/>\n      punishment. On the question of back wages, only the said<br \/>\n      amount of Rs.150\/- per month can be deducted about which<br \/>\n      there is no evidence of his having gainfully employed.<br \/>\n      In the present case, the only evidence is the admission<br \/>\n      made by the respondent\/ workman himself about         his<br \/>\n      earning. There is no other evidence. Therefore, on the<br \/>\n      basis of the evidence, the learned Single Judge has<br \/>\n      rightly passed the order.       No interference is called<br \/>\n      for. Hence the Appeal is dismissed.     No order as to<br \/>\n      costs.\n<\/p>\n<p>      6.No orders on Civil Application.\n<\/p>\n<p>(R.A.
