AGP for\nRespondent(s) : 1, \nNone\nfor Respondent(s) : 2 -\n3. \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/07\/2008 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npresent petition has been preferred against the order dated 19th<br \/>\nDecember, 2005 passed by the State Government, b y which the<br \/>\napplication of the petitioner has been rejected without giving an<br \/>\nopportunity of being heard.\n<\/p>\n<p>2.\t\tI<br \/>\nhave heard the learned counsel for the petitioner who has mainly<br \/>\nsubmitted that in pursuance of the policy\/resolution of the<br \/>\nrespondent authority dated 2nd August, 2004, (Annexure \u00fdSB\u00fd\u00fd<br \/>\nto the memo of the petition), there is a  provision of transfer of<br \/>\nfair price shop from one zone to another zone as per clause 11(4).<br \/>\nThe respondent authorities have not properly appreciated the policy<br \/>\nunder sub-clause and has, unilaterally decided the application<br \/>\npreferred by the petitioner for transfer of the fair price shop dated<br \/>\n16th July, 2007. Neither District Supply Advisory<br \/>\nCommittee nor the State Government has heard the petitioner before<br \/>\npassing the impugned order, whereby the application for transfer of<br \/>\nfair price shop was rejected. Thus, there is a violation of<br \/>\nprinciples of natural justice. Similarly situated another person&#8217;s<br \/>\napplication has been allowed which order is at Annexure \u00fdSE\u00fd\u00fd to<br \/>\nthe memo of the petition. Thus, arbitrary usage of power has led to<br \/>\ndiscrimination and hence the impugned order is violative of Article<br \/>\n14 of the Constitution of India and the same deserves to be quashed<br \/>\nand set aside. Had an opportunity of being heard been given to the<br \/>\npetitioner, the order like Annexure \u00fdSE\u00fd\u00fd would not have been<br \/>\npointed out to the respondent authorities. This opportunity has not<br \/>\nbeen given and therefore, the impugned order deserves to be quashed<br \/>\nand set aside.\n<\/p>\n<p>3.\t\tI<br \/>\nhave also heard the learned Assistant Government Pleader, who has<br \/>\nfairly submitted that opportunity of being heard shall be given to<br \/>\nthe petitioner and a fresh decision shall be taken by the respondent<br \/>\nauthorities.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of this submission, the impugned order dated 30th<br \/>\nMay, 2008 passed by the respondent no. 1 (Annexure \u00fdSD\u00fd\u00fd to the<br \/>\nmemo of the petition) is hereby quashed and set aside, as the same<br \/>\nhas been passed without affording any opportunity of being heard to<br \/>\nthe petitioner. Neither the committee as referred hereinabove nor the<br \/>\nrespondent no.1 has heard the petitioner. Thus, the petitioner shall<br \/>\nbe heard by the concerned respondent authority and thereafter, a<br \/>\nfresh order shall be passed after taking into consideration all the<br \/>\nnecessary documents including report\/opinion dated 26th<br \/>\nJuly, 2007 given by the Mamlatdar, Taluka Choryasi, Surat and other<br \/>\nother relevant documents which the petitioner shall present before<br \/>\nthe concerned respondent authorities. Rule made absolute to the<br \/>\naforesaid extent with no order as to costs. It is needless to say<br \/>\nthat the respondent authority empowered under Gujarat Essential<br \/>\nArticles (Licensing, Control and Stock Declaration) order, 1981 shall<br \/>\npass a fresh order. A grievance has been ventilated about the<br \/>\nauthority of the concerned officer like section officer. All care<br \/>\nshall be taken by the highest head that the designated authority<br \/>\nshould pass the order.
