DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/03\/2009 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Though<br \/>\n\tserved, no one appears for respondents nos.2 and 3.\n<\/p>\n<p>The<br \/>\n\tchallenge in this application filed by the applicant-Gujarat<br \/>\n\tPollution Control Board (for short  the Board ) is the order<br \/>\n\tdated 29.08.2007 passed by the learned Judicial Magistrate, First<br \/>\n\tClass, Jetpur below Exh.65 in Criminal case No.615 of 1993 by which<br \/>\n\tapplication of the respondents Nos.2 and 3 for recalling witnesses<br \/>\n\tcame to be allowed at a very belated stage without recording any<br \/>\n\tsatisfaction.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the applicant submits that even as per the application<br \/>\n\tsubmitted by the accused-applicant, the grounds for recalling<br \/>\n\twitnesses was only the change of advocate and on earlier occasion<br \/>\n\twhen cross-examination took place, certain relevant questions of law<br \/>\n\tand facts were not raised.  According to learned counsel for th<br \/>\n\tapplicant, same is not germane to exercise of powers under Section<br \/>\n\t311 of the Code of Criminal Procedure and no doubt a witness can be<br \/>\n\trecalled at any stage if the court is satisfied that the same was<br \/>\n\tnot essential or needed for just decision in the case.  But in the<br \/>\n\tpresent case, no sufficient ground or satisfaction was recorded by<br \/>\n\tthe learned Magistrate to recall the witnesses as prayed for by the<br \/>\n\trespondents No.2 and 3 and particularly an opportunity was already<br \/>\n\tgiven to cross-examine and final arguments were already submitted by<br \/>\n\tthe parties.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the applicant and considering the facts<br \/>\n\tand circumstances of the case and order passed by learned<br \/>\n\tMagistrate, what transpires is that no satisfaction is recorded by<br \/>\n\tthe learned Magistrate for exercising powers under Section 311 of<br \/>\n\tthe Code inasmuch as though objection was raised by the applicant<br \/>\n\therein by filing objection at Exh.66 and in view of the reliance<br \/>\n\tplaced on the decision of the High Court of Orissa in the case of<br \/>\n\tThomas Kujur v. Republic of India reported in 2007(2) Crimes 188<br \/>\n\tOrissa, above aspect is not considered at all.  It was specifically<br \/>\n\tsubmitted that so far as two witnesses viz. Jayesh Devkaran Kalyan<br \/>\n\tand Janardan Balakrishna Dave are concerned, they were<br \/>\n\tcross-examined vide Exhs.51 and 52 as early as in July and<br \/>\n\tSeptember, 2005.  Not only that but further statement of the<br \/>\n\taccused was also recorded on 01.10.2005.\n<\/p>\n<p>In<br \/>\n\tview of the above, it cannot be said that there was a satisfaction<br \/>\n\ton the part of the learned Magistrate to exercise power under<br \/>\n\tSection 311 of the Code.  The order impugned is de void of any merit<br \/>\n\tmuch less any justification and deserves to be quashed and set<br \/>\n\taside.  Accordingly, this application is allowed and order dated<br \/>\n\t29.08.2007 passed by the learned J.M.F.C., Jetpur below Exh.65 in<br \/>\n\tCriminal Case No.615\/93 is hereby quashed and set aside.  Rule is<br \/>\n\tmade absolute to the aforesaid extent only.\n<\/p>\n<p>Before<br \/>\n\tparting, this Court has passed order on 28.01.2009 encompassing<br \/>\n\tnegligence of the applicant-Board and its officers to pursue<br \/>\n\tcriminal cases filed under the provisions of Gujarat Water<br \/>\n\t(Prevention &amp; Control of Pollution) Act, 1974.  In view of the<br \/>\n\tdetailed affidavit filed by the concerned advocate,  I deem it just<br \/>\n\tand proper not to take any action against officers of the Board, at<br \/>\n\tthis stage.\n<\/p>\n<p>(ANANT S.
