Learned Advocate Mr. CL Soni for the claimants submits<br \/>\n\tthat the applicant insurance company was praying for interim relief<br \/>\n\tin terms of para 6(A) by praying to stay pending admission, hearing<br \/>\n\tand final disposal of the appeal, the execution, operation and<br \/>\n\timplementation of the impugned award and, therefore, entire award<br \/>\n\tpassed by the claims tribunal on 31st March, 2008 in each<br \/>\n\tclaim petition has been stayed by this Court which is coming in the<br \/>\n\tway of the claimants to execute the impugned award against the<br \/>\n\tOriental Insurance Co. Ltd. which is held 70% responsible for<br \/>\n\tpayment of compensation by the claims tribunal.\n<\/p>\n<p>Therefore,<br \/>\n\tconsidering the submissions made by the learned advocates for the<br \/>\n\tparties, it is clarified that the impugned award dated 31st<br \/>\n\tMarch, 2008 shall remain stayed qua applicant New India Assurance<br \/>\n\tCo.Ltd. and stay granted by this Court will not come in the way of<br \/>\n\tthe claimants to execute the award against the another Insurance<br \/>\n\tCompany namely Oriental Insurance Company Ltd.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Thakker for the applicant insurance company submits<br \/>\n\tthat the applicant insurance company has already deposited the 30%<br \/>\n\tamount of compensation together with proportionate interest and<br \/>\n\tcosts before the claims tribunal concerned.\n<\/p>\n<p>Therefore,<br \/>\n\tit is directed to the claims tribunal to pay 30% of the total amount<br \/>\n\tdeposited by the appellant Insurance CO. to the respondents<br \/>\n\tclaimants by account payee cheque in the name of the respondents<br \/>\n\tclaimants and rest of the 70% amount, out of the total amount<br \/>\n\tdeposited by the appellant insurance company is ordered to be<br \/>\n\tinvested in any nationalized bank initially for a period of five<br \/>\n\tyears with cumulative interest with periodical renewal in the name<br \/>\n\tof the respondents claimants till the appeals are finally decided by<br \/>\n\tthis Court.
