SHAH\n\t\t\n\t\n\n \n\nDate\n: 15\/09\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India<br \/>\nthe petitioner has prayed for an appropriate writ, order or direction<br \/>\nquashing and setting aside the impugned order dated 28\/01\/2010 passed<br \/>\nby respondent no. 2 by which respondent no. 2 has refused to refer<br \/>\nthe dispute to the concerned Court\/Tribunal  in connection with the<br \/>\ndemand   notice dated 14\/05\/2007.\n<\/p>\n<p>2.\tFrom<br \/>\nthe impugned order it appears that after the demand was raised by the<br \/>\npetitioner vide demand notice dated 14\/05\/2007 there is a further<br \/>\ndevelopment and the District Panchayat has decided to the get work<br \/>\ndone through outsourcing and all the workmen are considered as the<br \/>\nemployees of the Contractor and considering the same, respondent no.<br \/>\n2 has refused to make the reference by observing that the concerned<br \/>\nworkmen have accepted the same.\n<\/p>\n<p>3.\tShri<br \/>\nDeepak Dave, learned advocate appearing on behalf of the petitioner<br \/>\nhas submitted that as such the aforesaid was not the case on behalf<br \/>\nof respondent no. 3 before the Conciliation Officer.  However the<br \/>\nfact remains that subsequently there is a further development and<br \/>\nchange in the system and after the demand notice dated 14\/05\/2007 it<br \/>\nhas been decided to get the work through outsourcing and all the<br \/>\nconcerned workmen are considered to be the employees of the<br \/>\nContractor.  Shri Deepak Dave, learned advocate appearing on behalf<br \/>\nof the petitioner has submitted that in that case it can also be said<br \/>\nthat such a contract is sham and bogus.  However, as such the<br \/>\npetitioner has to raise a fresh dispute and demand.  Shri Deepak<br \/>\nDave, learned advocate appearing on behalf of the petitioner has<br \/>\nsubmitted that in that case suitable observation be made that as and<br \/>\nwhen fresh dispute is raised and\/or fresh demand notice is given the<br \/>\nsame shall be considered in accordance with law on its own merits,<br \/>\nwithout, in any way, being influenced by the impugned order.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above subsequent development, if the petitioner is still<br \/>\naggrieved by any subsequent action and\/or development it will be open<br \/>\nfor the petitioner to raise a fresh dispute  by fresh demand notice<br \/>\nand as and when the same is raised the same may be considered in<br \/>\naccordance with law on its own merits by the appropriate authority,<br \/>\nwithout, in any way, being influenced by the impugned order.\n<\/p>\n<p>5.\tWith<br \/>\nthis, the present Special Civil Application is disposed of.\n<\/p>\n<p>\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>siji<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Gujarat vs State on 29 November, 2010 Author: M.R.
