(1)\tThe
\npresent appeal arises against the judgment and order dated 21.04.2011
\npassed by Commissioner for the Workmen Compensation Act, Labour Court
\nNo.1, Bharuch in Workmen Compensation (Fatal) Application
\nNo.8 of 2009 whereby the authority has found that the application is
\nbarred in view of the benefits available under the Employee’s State
\nInsurance Act, 1948 (the ESI Act) and the application
\nis dismissed.\n<\/p>\n
(2)\tThe
\nrelevant facts are that deceased-Rameshbhai Chandubhai Prajapati
\nwhile working with respondent No.2 as a contractor, who was
\nperforming the work of respondent No.1-Company, had expired on
\n17.02.2009. Therefore, an  application was made under the Workmen’s
\nCompensation Act, 1923 for receiving compensation before the Labour
\nCourt, which is ex-officio the Commissioner under the Workmen’s
\nCompensation Act. In response to the process issued, the application
\nwas made by respondent No.2 herein before the authority to decide the
\npreliminary issue of maintainability of the main application
\non the ground that the case of the deceased was\u00a0already covered
\nby the ESI Act and the compensation was fixed and, therefore, by
\nvirtue of Section 53 of the ESI Act, the application
\nwas barred. The competent authority decided to hear the matter on
\npreliminary issue and ultimately passed the impugned order. Under
\nthese circumstances, the present\u00a0appeal
\nbefore this Court.\n<\/p>\n
(3)\tWe
\nhave heard Ms.Shah for the appellants, Mr.Thakker for respondent No.1
\nand Ms.Rupal Thakore for respondent No.2.\n<\/p>\n
(4)\tLearned
\nadvocate for the appellants initially contended that the membership
\nwith ESI was got enrolled by the respondents after the death of the
\nemployee concerned and, therefore, she submitted that the appellants
\ncannot be deprived of the benefit of such grant. She thereafter
\nsubmitted that even if it is there on record that the deceased was
\nmember of the ESI while working with the other company unless the
\nproper formality by way of requisite declaration was made at the time
\nwhen he entered the service of the respondents, it cannot be said
\nthat he will continue to be the member of ESI and under these
\ncircumstances, the bar under Section 53 of the ESI Act would not
\noperate and hence, the authority has committed error and, therefore,
\nthis Court may interfere.\n<\/p>\n
(5)\tIt
\nis not the matter where claim of the deceased  was not at all
\nprocessed under the ESI Scheme but it is an admitted position that
\nthe claim of the deceased was processed under the ESI Act, the same
\nwas examined by the ESI authority and it was also sanctioned. Based
\non the same, the pension of the dependent members of the family were
\nalso sanctioned. The appellants, who are the original applicants,
\nhave received the amount and are receiving the amount of pension
\nregularly. However,
\nthe case of the appellants, as contended by the learned advocate for
\nthe appellants during course of hearing, is that the appellants are
\nilliterate and they have no knowledge
\nabout the legal position and, therefore, they should not have been
\ndeprived of the rights for compensation under the Workmen
\nCompensation Act.\n<\/p>\n
(6)\tIn
\nour view the competent authority has examined the aspect of fixation
\nof the pension under the ESI Scheme. Therefore, as such, once the
\nbenefit is accepted and is being accepted continuously under the ESI
\nScheme, it cannot be said that the appellants-original claimants
\nwould be entitled to the additional benefit. Further, on the aspect
\nof membership, unless a person was member at the relevant point of
\ntime, the claim will not be accepted nor the  pension would be fixed.
\nThe additional aspect is that prior to joining service with the
\nrespondents, the deceased was in employment\u00a0with the other
\ncompany, namely, A.B.Steel Fabricators and at that time he was
\nalready member of ESI. Regulation 12 of the Employee’s State
\nInsurance (General) Regulations, 1950 provides\u00a0that if one is
\nalready a member of the ESI and identity card is issued, when the
\nemployee joins the other company he has to give particulars and the
\nemployer has to enter the details in the Declaration Form. It is an
\nadmitted position that after leaving the said company, namely,
\nA.B.Steel Fabricators the deceased was engaged with the respondents.
\nUnder the circumstances, his membership continued of ESI. The attempt
\nto contend that if the Declaration Form is not completed well in time
\nat the time of joining the duty, the liability under the Workmen
\nCompensation Act cannot be avoided, in our view, cannot be
\ncountenanced for the two reasons – one is that such formality
\nof submitting declaration cannot be held to be mandatory so as to
\ndeprive the employee concerned to get the benefit of the Scheme, if
\nhe is already a member of ESI and has joined the other company. The
\nanother reason is that in the present\u00a0case
\ncontinuation of the membership of the deceased has been accepted by
\nthe ESI authority, the pension is fixed accordingly, the amount is
\nsanctioned and actually paid, which has been received by the
\nappellants. Under these circumstances, we find that the contention
\ncannot be accepted.\n<\/p>\n
(7)\tIf
\nthe deceased was member of ESI and the benefit under the ESI Act are
\nalready sanctioned, the bar of Section 53 of the ESI Act would
\noperate for claiming compensation under the Workmen Compensation Act.
\nSection 53 of the ESI Act for ready reference reads as under:\n<\/p>\n
“53.\tBar
\nagainst receiving or recovery of compensation or damages under any
\nother law. — An insured person or his dependents shall not be
\nentitled to receive or recover, whether from the employer of the
\ninsured person or from any other person, any compensation or damages
\nunder the Workmen’s Compensation Act, 1923 (8 of 1923), or any other
\nlaw for the time being in force or otherwise, in respect of an
\nemployment injury sustained by the insured person as an employee
\nunder this Act.”\n<\/p>\n
(8)\tThe
\naforesaid section is clear on its own language and, at this stage, we
\nmay refer to the decision of the Apex Court in case of  A.Trehan
\nVs. Associated Electrical Agencies & Anr., 1996 (74) F.L.R.
\n1886, wherein the Apex Court has also observed that bar would operate
\nunder Section 53 of the Act for claiming compensation under the
\nWorkmen Compensation Act and, therefore, the application
\nunder the Workmen Compensation Act could be said as not maintainable.
\nThe authority, by the impugned order has taken the same view. Hence,
\nwe find that the appeal is meritless and, therefore, dismissed. There
\nshall be no order as to costs.\n<\/p>\n
