Counsel further submitted that without prejudice to the<br \/>\nabove contention, the accused are  prepared to pay the entire amount<br \/>\nif so directed by the Court to put an end to the entire dispute.\n<\/p>\n<p>\tLearned<br \/>\ncounsel for the complainant, however, was not in a position to accept<br \/>\nsuch an offer as the final settlement.\n<\/p>\n<p>\tIn<br \/>\naddition to hearing the learned counsel for the parties, I have  also<br \/>\nperused the  documents on record. Undisputed fact is that in six<br \/>\ndifferent cheque bouncing complaints total amount involved is<br \/>\nRs.18,643\/-.   When the accused have offered to pay up the entire<br \/>\namount even keeping their contentions  that it was previously paid in<br \/>\ncash aside, I see no reason in burdening the learned Magistrate with<br \/>\nfurther trial in such cases.\n<\/p>\n<p>\tConsidering<br \/>\nthe above aspects of the matter, Criminal Case Nos.1748, 1749, 1750,<br \/>\n1751, 1752 and 1753 of 2005 pending in the  Court of 7th<br \/>\nCivil Judge and JMFC, Rajkot  are quashed on  condition that the<br \/>\npetitioner shall deposit a sum of Rs.18,643\/- before the Court of<br \/>\nJudicial Magistrate,  First Class, Rajkot latest by 9th<br \/>\nAugust 2010.  As already provided, this order is conditional and if<br \/>\nthe petitioner fails to  deposit the amount within the time<br \/>\npermitted, this order shall be  liable to be recalled  on a note<br \/>\nbeing filed by the complainant.
