  of a Garage, a truck bearing No.KA~–17\/A-<\/p>\n
 being driven in a rash and negligent manner<\/p>\n

came behind the motor cycle and dashed against<\/p>\n
the same. Due to the said accident, the piliion<\/p>\n
rider Dhareppa fell down and died at the s\u00a7c\u00a3,*e<\/p>\n
The claimant, who was riding the motor*eyciehat=w<\/p>\n
the relevant point of time, s\ufb01stained_gfievousi<\/p>\n
injuries on his shoulder &esu1tine~ in ztheit<\/p>\n
fracture cf scapula and, aiso “snffetegf other

respondentsd [by * filing written statement.<\/p>\n

himself as Q\ufb01.1 and also got PW.2 examined to<\/p>\n
hsubstantiate his milk vending business and<\/p>\n
ige\ufb01aminedi Doctor S.B.patil as PW.3 to<\/p>\n

any evidence but, the third respondent filed thel<\/p>\n

4. Based on the pleadings and evidence en
\nrecord, the Tribunalspartiail\u00a7 allowed the claim
\nof the appellant herein and \u00e9gggu\u00e9a Compensation<\/p>\n
in a sum of Rs;39,636;;fgL\u00a2ng with interest at<\/p>\n
‘6% pa-. payable \ufb01rom the date of petition till<\/p>\n
date of realisation;, \u00bb_”\n<\/p>\n
,.\u00a7rV’~Beino=e:aggrieved by the same, the<\/p>\n
l* appellant ,herein has preferred this appeal<\/p>\n
seeking” enhancement of the esompensation on the<\/p>\n
id _ground that the Tribunal has not considered the<\/p>\n
dl”seyidenced’of PW.3, the Doctor, regarding the<\/p>\n
“fdiSahility that he has suffered due to the<\/p>\n
ad”. accident, which resulted in loss of income to<\/p>\n
‘”W<\/p>\n
him, that the Tribunal has failed to award<\/p>\n
compensation for the pain and suffering that he i,<\/p>\n
has suffered and loss of amenities and”loaS~of”<\/p>\n

while computing the compenaation under the head<\/p>\n

6. In this appeal; the respondents are duly<\/p>\n
served, they entered_anpearnce’and contested the<\/p>\n
appeal on meritei’ Heard the learned Counsel for<\/p>\n
the paf\ufb01iesilh<\/p>\n
7. Vbni verification of the judgment and<\/p>\n
w_ award, passed “by _the Tribunal and also looking<\/p>\n
VH_into_the oral and documentary evidence recorded<\/p>\n
hy the Tribunal in support of the claim of the<\/p>\n
appellant herein, it is seen that the Tribunal<\/p>\n
.u*_Qhile Vcalculating the loss of future income<\/p>\n
l.ithough has taken Rs.150\/- as income of the<\/p>\n
kg.\n<\/p>\n
7<\/span><\/p>\n
claimant per day, it deducted 1\/3″ of the income<\/p>\n
as his personal expenses, which is improper.<\/p>\n
Hence, the compensation of Rs.31,200\/~ awarded,<\/p>\n
to the claimant is required to be reassessed and%_”<\/p>\n
the same should be enhanced to Rswi\ufb01y\ufb01\ufb01d\/ed<\/p>\n
Though the Tribunal has awarded \u00a2amp\u00e9asarion:f\u00a7\u00a3,i’<\/p>\n
medical expenses at Rs,55,930fj ‘and isttendantl<\/p>\n
and diet expenses at Rs.2}5\u00a7O\/-, which is just
\nand proper, it has not tahen into account the<\/p>\n
loss of income that the dciaimanrdxhas suffered<\/p>\n
during” the._periEx$ when he ~was under treatment<\/p>\n
and therefore; ftherWclaimant is entitled to<\/p>\n
compensation on th*t”$\u00a7nnt at Rs.6,000\/*.<\/p>\n
nih.;JIt, is xseen” that the Tribunal has also<\/p>\n
tanot awarded any amount towards the injury that<\/p>\n
he.has suffered and also the pain and suffering<\/p>\n
‘Vhe has undergone and no amount of compensation<\/p>\n
ris’awarded towards loss of amenities. Hence, a<\/p>\n
.1}sunr of” Rs.15,000\/- is awarded towards loss of<\/p>\n

amenities and another sum of RS.15,000\/~ towaros_<\/p>\n
injuries and pain and suffering. Taking fall; *<\/p>\n
