SHAH\n\t\t\n\t\n\n \n\nDate\n: 02\/09\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tRule.\n<\/p>\n<p>Mr.K.P.Rawal, learned<br \/>\nAdditional Public Prosecutor waives service of notice of Rule<br \/>\non behalf of respondent No.1 &#8211; State and Mr.Rushabh Shah,<br \/>\nlearned advocate waives service of notice of Rule on behalf of<br \/>\nrespondent No.2 &#8211; original complainant.\n<\/p>\n<p>2.\t\tIn<br \/>\nthe facts and circumstances of the case and with the consent of the<br \/>\nlearned advocates appearing on behalf of the respective parties and<br \/>\nas it is reported that the dispute is settled between the parties,<br \/>\nrespondent No.2 &#8211; original complainant does not want to proceed<br \/>\nfurther with the complaint and does not want to prosecute the<br \/>\npetitioner and it is reported that even otherwise accused persons<br \/>\nwere tried and came to be acquitted by learned Judicial<br \/>\nMagistrate, First Class,  Mansa by declaring original<br \/>\ncomplainant as hostile and she did not support the case of the<br \/>\nprosecution, the present petition is taken up for final hearing<br \/>\ntoday.\n<\/p>\n<p>3.\t\tThe<br \/>\npresent application under Section 482 of the Code of Criminal<br \/>\nProcedure has been preferred by the applicant &#8211; original<br \/>\naccused No.1 to quash and set aside the FIR culminating in Criminal<br \/>\nCase No.1307 of 2010 in the Court of learned Judicial Magistrate,<br \/>\nFirst Class, Mansa as well as charge-sheet filed against the<br \/>\napplicant quashing the impugned FIR being C.R.No.II-93 of 2010<br \/>\nregistered with Mansa Police Station lodged against the applicant &#8211;<br \/>\noriginal accused  for the offences punishable under Sections 498-A,<br \/>\n506(1) of the Indian Penal Code and under Sections 3 and 7 of the<br \/>\nDomestic Violence Act and further proceedings, if any arising out of<br \/>\nimpugned FIR.\n<\/p>\n<p>4.\t\tMr.Shah,<br \/>\nlearned advocate appearing on behalf of respondent No.2 &#8211;<br \/>\noriginal complainant has submitted that an affidavit is also filed,<br \/>\nwhich is affirmed by respondent No.2 &#8211; original complainant<br \/>\nconfirming settlement entered into between the parties and by<br \/>\nsubmitting that she has no objection, if the impugned complaint\/FIR<br \/>\nis quashed and set aside.\n<\/p>\n<p>5.\t\tLearned<br \/>\nadvocates appearing on behalf of the respective parties have relied<br \/>\nupon the decision of the Hon&#8217;ble Supreme Court in the case of Madan<br \/>\nMohan Abbot V\/s. State of Punjab reported in 2008(4) SCC 582;<br \/>\nin the case of  Nikhil Merchant V\/s. Central Bureau of<br \/>\nInvestigation and another reported in 2009(1) GLH 31 as<br \/>\nwell as in the case of Manoj Sharma V\/s. State and others reported<br \/>\nin 2009(1) GLH 190.\n<\/p>\n<p>6.\t\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties and considering the facts as stated hereinabove and as the<br \/>\nparties have amicably settled the dispute and consent terms have been<br \/>\narrived at between the parties and considering the aforesaid<br \/>\ndecisions of the Hon&#8217;ble Supreme Court, it appears to the Court that<br \/>\nthe impugned FIR be quashed and set aside in exercise of power under<br \/>\nSection 482 of the Code of Criminal Procedure and to continue<br \/>\ncriminal proceedings against the applicant &#8211; original accused<br \/>\nwill be unnecessary harassment to the applicant and the same shall<br \/>\nnot be in the interest of the parties.\n<\/p>\n<p>7.\t\tIn<br \/>\nview of the above and for the reasons stated hereinabove, the<br \/>\nimpugned FIR culminating in Criminal Case No.1307 of 2010 in the<br \/>\nCourt of learned Judicial Magistrate, First Class, Mansa as well as<br \/>\ncharge-sheet filed against the applicant quashing the impugned FIR<br \/>\nbeing C.R.No.II-93 of 2010 registered with Mansa Police Station<br \/>\nlodged against the applicant &#8211; original accused  for the<br \/>\noffences punishable under Sections 498-A, 506(1) of the Indian Penal<br \/>\nCode and under Sections 3 and 7 of the Domestic Violence Act and<br \/>\nfurther proceedings, if any arising out of impugned FIR are hereby<br \/>\nquashed and set aside.
