PUBLIC PROSECUTOR\nfor Respondent(s) : 1, \nRULE SERVED for Respondent(s) : 2, \nMR\nSATYAM Y CHHAYA for Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 08\/09\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npetitioners have challenged the warrant issued by the learned<br \/>\nMagistrate, under Section-97 of the Criminal Procedure Code, dated<br \/>\n18.08.2009. Respondent No.2, herein, is the original applicant before<br \/>\nthe learned Magistrate, who is the father of petitioner No.2, herein.<br \/>\nIt appears that there was an affair between the petitioner No.1 and<br \/>\nthe daughter of respondent No.2 and she had left her father&#8217;s house<br \/>\nand joined petitioner No.1, voluntarily.<br \/>\nAdmittedly, they have got married. They are both of marriageable age<br \/>\nand are stated to be aged about 22 years.\n<\/p>\n<p>2.\t\tThe<br \/>\nlearned Counsel for respondent No.2, however, stated that the order<br \/>\npassed by the learned Magistrate is perfectly legal.\n<\/p>\n<p>3.\t\tWhen<br \/>\nthe daughter of the original applicant, herself, has come forward<br \/>\nstating that she is not kept in the custody of petitioner No.1 or any<br \/>\nof his relatives, against her wish, there is no question of illegal<br \/>\ndetention or illegal custody of the daughter of the original<br \/>\napplicant.  Issuance of warrant, thus, must fail, on this limited<br \/>\nground.\n<\/p>\n<p>4.\t\tThe<br \/>\nlearned counsel for the petitioners, however, voiced his apprehension<br \/>\nthat the petitioners face hostilities from respondent No.2, herein,<br \/>\nand also face real threat to their safety.  The OFFICER<br \/>\nin-charge of the CONCERNED police station, shall ensure<br \/>\nthat no harm is caused to the petitioners, on account of petitioner<br \/>\nNo.2 having married against the wish of the original applicant,<br \/>\nrespondent No.2, herein.  For this purpose, if the petitioners file<br \/>\nan APPLICATION before the concerned police authorities,<br \/>\nthe same shall be considered and the steps may be taken, as found<br \/>\nnecessary.\n<\/p>\n<p>5.\t\tWith<br \/>\nthe above observations, the impugned warrant dated 18.08.2009, is<br \/>\nQUASHED.
