Justice R.BASANT\n\n Dated :19\/03\/2008\n\n O R D E R\n                               R.BASANT, J\n                        ------------------------------------\n                         B.A.No.1720 of 2008\n                       -------------------------------------\n               Dated this the 19th day of March, 2008\n\n                                    ORDER\n<\/pre>\n<p>       Application for anticipatory bail. Petitioners are accused 3, 4<\/p>\n<p>and 7 to 9 in a crime registered alleging offences punishable,<\/p>\n<p>inter alia, under Sections 452 and 332 I.P.C and Section 3(2) of<\/p>\n<p>the P.D.P.P Act. The alleged incident took place on 19.02.08.<\/p>\n<p>That was a day of hartal declared by the opposition parties. It is<\/p>\n<p>alleged that the petitioners were members of an unlawful<\/p>\n<p>assembly of persons who in furtherance of the common object of<\/p>\n<p>the unlawful assembly marched into the K.S.E.B office and<\/p>\n<p>indulged in wanton acts of mischief and violence within the office<\/p>\n<p>of the K.S.E.B.     Investigation is in progress.             The petitioners<\/p>\n<p>apprehend imminent arrest. Some of the co-accused allegedly<\/p>\n<p>have specific overt acts raised against them. They surrendered<\/p>\n<p>before the learned Magistrate and they have been enlarged on<\/p>\n<p>bail.\n<\/p>\n<p>       2.   The learned counsel for the petitioners submits that<\/p>\n<p>the petitioners are innocent.                    They are active political<\/p>\n<p>functionaries. They have been unnecessarily brought on the array<\/p>\n<p>of accused. The petitioners may now be granted anticipatory bail,<\/p>\n<p>it is prayed.\n<\/p>\n<p>       3.   The learned Public Prosecutor opposes the application.<\/p>\n<p><span class=\"hidden_text\">B.A.No.1720 of 2008                2<\/span><\/p>\n<p>The learned Public Prosecutor        submits that wanton acts of<\/p>\n<p>violence and mischief were resorted to and damage and<\/p>\n<p>destruction were caused to the public office. In any view of the<\/p>\n<p>matter, the petitioners may be directed to surrender before the<\/p>\n<p>learned Magistrate having jurisdiction or the Investigating Officer<\/p>\n<p>and then seek regular bail. No circumstances exist justifying the<\/p>\n<p>invocation of the extraordinary equitable discretion under Section<\/p>\n<p>438 Cr.P.C, submits the learned Public Prosecutor .<\/p>\n<p>     4.    Having considered all the relevant inputs, I find merit<\/p>\n<p>in the opposition by the learned Public Prosecutor.         I find no<\/p>\n<p>features available in this case which can justify or warrant the<\/p>\n<p>invocation of the extraordinary equitable discretion under Section<\/p>\n<p>438 Cr.P.C. This, I agree with the learned Public Prosecutor, is a<\/p>\n<p>fit case where the petitioners must appear before the<\/p>\n<p>Investigating Officer or the learned Magistrate having jurisdiction<\/p>\n<p>and then seek regular bail.\n<\/p>\n<p>     5.
