{"id":63786,"date":"2011-03-25T00:00:00","date_gmt":"2011-03-24T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/devendra-mishra-vs-kameshwar-singh-darbhanga-sans-on-25-march-2011"},"modified":"2016-10-16T16:02:15","modified_gmt":"2016-10-16T10:32:15","slug":"devendra-mishra-vs-kameshwar-singh-darbhanga-sans-on-25-march-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/devendra-mishra-vs-kameshwar-singh-darbhanga-sans-on-25-march-2011","title":{"rendered":"Devendra Mishra vs Kameshwar Singh Darbhanga Sans on 25 March, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Devendra Mishra vs Kameshwar Singh Darbhanga Sans on 25 March, 2011<\/div>\n<pre>                         IN THE HIGH COURT OF JUDICATURE AT PATNA\n                                           CWJC No.1289 of 2003\nDevendra Mishra, son of Late Mahakal Mishra, village Pachahi, PS Madhepur, district Madhubani\n- Petitioner.\n                                            Vs.\n   1) Kameshwar Singh Darbhanga Sanskrit University, Darbhanga through its Registrar.\n   2) Vice Chancellor, Kameshwar Singh Darbhanga Sanskrit University, Darbhanga.\n   3) Registrar, Kameshwar Singh Darbhanga Sanskrit University, Darbhanga - Respondents.\n6        25.3.2011<\/pre>\n<p>                    Heard learned counsel for the petitioner and the counsel<\/p>\n<p>                           appearing on behalf of Kameshwar Singh Darbhanga Sanskrit<\/p>\n<p>                           University.\n<\/p>\n<p>                                         The petitioner has challenged the order, dated 31.10.2002<\/p>\n<p>                           contained in Annexure 3 by which he has been compulsorily retired<\/p>\n<p>                           from service by the Vice Chancellor of Kameshwar Singh Darbhanga<\/p>\n<p>                           Sanskrit University on the ground that his service was not satisfactory.<\/p>\n<p>                                         Counsel for the petitioner submits that the petitioner had<\/p>\n<p>                           rendered satisfactory service to the University and there was nothing<\/p>\n<p>                           against him except that in the year 2000 when he was punished in a<\/p>\n<p>                           departmental proceeding.\n<\/p>\n<p>                                         It is contended on behalf of the petitioner that the Vice<\/p>\n<p>                           Chancellor of the University does not have the power to pass the order<\/p>\n<p>                           impugned and the power vests with the University under section 67 of<\/p>\n<p>                           the Bihar Universities Act, 1976.\n<\/p>\n<p>                                         Counsel for the University, on the other hand, submits that<\/p>\n<p>                           the powers of the Vice Chancellor are mentioned in section 10 of the<\/p>\n<p>                           aforesaid Act. Referring specifically to sub-section (11) of section 10,<\/p>\n<p>                           it is submitted that it specifies as follows :\n<\/p>\n<p>                                         &#8220;The Vice Chancellor shall exercise general control over<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>the educational arrangement of University and shall be responsible for<\/p>\n<p>the discipline of the University. It shall be lawful for the Vice-<\/p>\n<p>Chancellor to take all steps which are necessary for maintaining the<\/p>\n<p>academic standard and administrative discipline of the University.&#8221;<\/p>\n<p>              Sub-section (5) of section 10 further indicates that the<\/p>\n<p>Vice Chancellor has been described as the \u201ePrincipal Executive\u201f and<\/p>\n<p>\u201eAcademic Officer\u201f of the University, the Chairman of the Syndicate<\/p>\n<p>and of the Academic Council. Sub-section (11) of section 10 on the<\/p>\n<p>other hand directs that the Vice Chancellor can exercise control over<\/p>\n<p>the general education as well as maintain administrative discipline in<\/p>\n<p>the University. The decision to compulsorily retire an employee has<\/p>\n<p>thus to be decided by the Vice Chancellor, who holds administrative<\/p>\n<p>control over the University by virtue of sub-section (11) of section 10<\/p>\n<p>and by virtue of the fact that he is the executive officer of the<\/p>\n<p>University.\n<\/p>\n<p>              The order impugned as contained in Annexure 3 would<\/p>\n<p>indicate that there was a meeting held and in the said meeting a<\/p>\n<p>decision was taken to compulsorily retire the petitioner. It is, thus,<\/p>\n<p>apparent that the decision was not taken solely by the Vice Chancellor<\/p>\n<p>but was taken by a duly constituted committee. Counsel for the<\/p>\n<p>petitioner relies on section 67(b) to submit that the power to retire an<\/p>\n<p>incumbent does not lie solely in the hands of the Vice Chancellor.<\/p>\n<p>Sub-section (b) of section 67 reads as follows :<\/p>\n<p>            &#8220;(b) The University may require any teaching or non-<br \/>\nteaching employee, who, reckoned from the date of his first<br \/>\nappointment, has completed the qualifying service of 23 years or a<br \/>\ntotal service of 27 years, to retire from the University service, if it<br \/>\nconsiders that his conduct or efficiency is such as does not justify his<br \/>\ncontinuation in the service.&#8221;\n<\/p>\n<p><span class=\"hidden_text\">                              3<\/span><\/p>\n<blockquote><p>                     It is emphasized on behalf of the petitioner that the power<\/p>\n<p>        give under section 67      has the over riding effect, inasmuch as it<\/p>\n<p>        requires that decision should be taken by the \u201eUniversity\u201f.<\/p>\n<\/blockquote>\n<blockquote><p>                     It is contended that the order should have been approved<\/p>\n<p>        by the Syndicate or Senate. Section 21 deals with the power of the<\/p>\n<p>        Senate. On perusal of sub-section (2) of section 21, it would appear<\/p>\n<p>        that the power of the Senate have been defined, the powers do not<\/p>\n<p>        relate to having any administrative control over the teaching and non-<\/p>\n<p>        teaching staff of the college. Similarly section 23 of the Act deals<\/p>\n<p>        with the powers of the Syndicate. The power of the Syndicate is<\/p>\n<p>        restricted to management of property, regulating statutes and<\/p>\n<p>        regulations, managing the funds placed under the disposal of the<\/p>\n<p>        University for specific purpose, transfer of property from one<\/p>\n<p>        University to another, repeal of ordinance and exercise all such duties<\/p>\n<p>        as prescribed under the Act and the Statutes.
