Appellant, the CPIO and the AA were present<br \/>\nat NIC VC facility at Kolkata. Commission conducted the hearing from<br \/>\nits New Delhi office.\n<\/p>\n<p>2.    At the outset, appellant stated that his second-appeal should be<br \/>\nlimited to queries in his RTI-application dated 20.07.2008, appearing at<br \/>\nSl.Nos.xvii, xxii and xxiii.\n<\/p>\n<p>Item at Sl.No.xvii: Copies of EERs\/PAR in respect of M.N. Ghosh for<br \/>\nthe years 2002-2003, 2003-2004, 2004-2005, 2005-2006, 2006-<br \/>\n2007, 2007-2008.\n<\/p>\n<p>3.     Respondents stated during hearing that they were not in a<br \/>\nposition to provide this information to the appellant because on<br \/>\nreviewing their records, they found that these reports for the years<br \/>\nmentioned by him were never written. As they do not hold this<br \/>\ninformation, they were not in a position to provide to the appellant any<br \/>\npart of it.\n<\/p>\n<p>Decision:\n<\/p>\n<p>4.     A public authority has to be in control of a requested information<br \/>\nin terms of Section 2(j) of the RTI Act read with Section 2(f) before its<br \/>\ndisclosure obligation can be considered under the provisions of the RTI<br \/>\nAct. Insofar as per the statement of the representatives of the public<br \/>\nauthority, the above-mentioned information was not in their control, it<br \/>\nis not possible to authorize its disclosure.\n<\/p>\n<p>5.     There shall be no obligation to disclose this item of information.\n<\/p>\n<p>AT-04122009-04.doc<br \/>\n<span class=\"hidden_text\">                                                                Page 1 of 4<\/span><br \/>\n Item at Sl.No.xxii: Copies of the note of CVO written to Disciplinary<br \/>\nAuthority in respect of M N Ghosh relating to initiation of Disciplinary<br \/>\nproceeding on the alleged plea of educational incompetence of<br \/>\nM N Ghosh.\n<\/p>\n<p>6.    It is the argument of the respondents that all internal<br \/>\ncommunication between the Vigilance Department and the Disciplinary<br \/>\nAuthority of the public authority in respect of any employee is by<br \/>\ndefinition confidential. No vigilance authority engages in discussion<br \/>\nabout the conduct and the behaviour of an employee through open<br \/>\ncorrespondence. If and when, following the report of the Vigilance<br \/>\nBranch, the Disciplinary Authority takes a view to start an enquiry or<br \/>\ndepartmental proceeding against a given employee, such an employee is<br \/>\nallowed access to all relevant records and documents including the<br \/>\ngrounds on which the proceedings against him were drawn up. The<br \/>\ninternal communications between the Vigilance Branch and the<br \/>\nDisciplinary Authority if allowed to be prematurely disclosed,<br \/>\nindependent of the departmental enquiry, it has every potentiality to<br \/>\nprejudice that enquiry and even impair its process due to intrusive<br \/>\ninterference by the interested parties.\n<\/p>\n<p>7.    Respondents, therefore, contended that all such communications<br \/>\nbetween the Vigilance Branch and the Disciplinary Authority were kept<br \/>\nconfidential in public interest under Section 124 of the Indian Evidence<br \/>\nAct.\n<\/p>\n<p>8.     They further pointed out that a respondent-public authority was<br \/>\nitself a third-party within the meaning of Section 2(n) of the RTI Act,<br \/>\nwhich read as follows:-\n<\/p>\n<p>       &#8216;&#8221;third party&#8221; means a person other than the citizen making a<br \/>\n       request for information and includes a public authority.&#8217;<\/p>\n<p>9.    In their contention, the respondent-public authority as a<br \/>\nthird-party was competent to hold vigilance-related information as<br \/>\nconfidential within the meaning of Section 11(1) of the RTI Act. These<br \/>\nshould be disclosed only if the public interest in its disclosure<br \/>\n&#8220;outweighs in importance any possible harm or injury to the interest of<br \/>\nsuch third-party&#8221;. Respondents have argued that there was absolutely<br \/>\nno public interest in disclosing of this information. They further argued<br \/>\nthat its disclosure at this stage, independent of the departmental<br \/>\nproceeding against the appellant, could be doubtless injurious to the<\/p>\n<p>AT-04122009-04.doc<br \/>\n<span class=\"hidden_text\">                                                              Page 2 of 4<\/span><br \/>\n protected interest \u23af confidentiality of a vigilance-related internal<br \/>\ncommunication between two officials of the public authority.\n<\/p>\n<p>10. Respondents have further submitted that a petitioner such as this<br \/>\nappellant should not be allowed to go &#8216;forum hunting&#8217; for documents he<br \/>\nmight be interested in. He will have every possibility to demand<br \/>\nspecific sets of records and documents from the Enquiry Officer or the<br \/>\nDisciplinary Authority in order to defend his interest and position in that<br \/>\ndisciplinary proceeding. There are specific channels of appeal if certain<br \/>\ndocument \/ record is denied to him. Disclosure of any document \/<br \/>\nrecord which may be related with an ongoing investigation or<br \/>\ndisciplinary proceeding, through RTI Act, would amount to interfering<br \/>\nand impeding that proceeding and, therefore, attract exemption under<br \/>\nSection 8(1)(h) of the RTI Act.\n<\/p>\n<p>Decision:\n<\/p>\n<p>11. I accept the reasons presented by the respondents for not<br \/>\ndisclosing the above information.\n<\/p>\n<p>12. This is in conformity with Commission&#8217;s earlier decision in U.R.M.<br \/>\nRaju Vs. Visakhapatnam Port Trust; Appeal Nos.CIC\/AT\/A\/2008\/01148<br \/>\n&amp; 01156; Date of Decision: 13.03.2009 and M.L. Kajodia Vs. Bank Note<br \/>\nPress, Dewas; Appeal No.CIC\/AT\/A\/2009\/000619 &amp; CIC\/AT\/C\/2009<br \/>\n\/000538; Date of Decision: 16.09.2009.\n<\/p>\n<p>13. There shall be no disclosure obligation for this item of<br \/>\ninformation.\n<\/p>\n<p>Item at Sl.No.xxiii: Note of Chairman, CIL containing                   his<br \/>\nrecommendation made to CVC dated 27th July, 2008.\n<\/p>\n<p>14. Respondents have argued that this information is also part of<br \/>\ninternal communication between the Disciplinary Authority and the<br \/>\nCentral Vigilance Commission and is covered by the reasons spelt-out<br \/>\nfor the preceding query.\n<\/p>\n<p>Decision:\n<\/p>\n<p>15. I&#8217;m in agreement with the respondents that this item of<br \/>\ninformation is also fully covered by the Commission&#8217;s earlier decisions<br \/>\nreferred at paragraph 12 above.
