Sri Surendra Jha son of not known, the Superintendent of Engineer, Rural\n                 Development Department, Special Division (Pra-Aa) Munger\n                                                                    ....Opposite Parties\n                                                 -----------\n<\/pre>\n<p>3    15-09-2010                   Heard learned counsel for the petitioner and<\/p>\n<p>                      learned counsel for the State.\n<\/p>\n<p>                                  Pursuant to order of Division Bench in LPA<\/p>\n<p>                      no. 297\/2010 dated 15-2-2010, the petitioner made a<\/p>\n<p>                      prayer through annexure-2 dated 27-2-2010 requesting<\/p>\n<p>                      the various authorities to pay him balance amount of a<\/p>\n<p>                      particular project along with interest. That representation<\/p>\n<p>                      in annexure-2 mentions the place of posting of the<\/p>\n<p>                      petitioner as Junior Engineer on deputation in block<\/p>\n<p>                      Haveli Kharagpur (in anticipation of orders). The<\/p>\n<p>                      direction of the Division Bench was that the petitioner<\/p>\n<p>                      should prefer an explanation by giving the details to the<\/p>\n<p>                      competent authority within six weeks and thereafter the<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>said authority, which is Executive Engineer in this case,<\/p>\n<p>was to afford an opportunity of hearing to the petitioner<\/p>\n<p>and then to determine whether the work in question had<\/p>\n<p>been undertaken, the amount had been spent and whether<\/p>\n<p>the amount has fallen due for being realized from the<\/p>\n<p>petitioner. Such exercise was to be completed within 8<\/p>\n<p>weeks.\n<\/p>\n<p>          According to the petitioner the prayer made in<\/p>\n<p>annexure-2 was sufficient explanation and thereafter the<\/p>\n<p>concerned authority was free to decide the matter but<\/p>\n<p>before that petitioner should have been afforded an<\/p>\n<p>opportunity of hearing.\n<\/p>\n<p>          In the show cause filed on behalf of Executive<\/p>\n<p>Engineer, Opposite Party no.4, a stand has been taken<\/p>\n<p>that inspite of letter written to the petitioner at his<\/p>\n<p>permanent address because of non availability of his<\/p>\n<p>present address, and inspite of notice published in two<\/p>\n<p>prominent Hindi newspapers published from Patna, that<\/p>\n<p>is, Prabhat Khabar and Aaj,      the petitioner did not<\/p>\n<p>submit any explanation nor he appear before Opposite<\/p>\n<p>Party no.4 and in such circumstances Opposite Party<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>no.4 has passed the final order ex parte on the basis of<\/p>\n<p>available materials. That order annexed as annexure-E to<\/p>\n<p>the show cause bears letter no.966 dated 14-8-2010.<\/p>\n<p>          Although there is no specific denial that<\/p>\n<p>annexure-2 was not filed by the petitioner but on perusal<\/p>\n<p>of the same, we do not find any explanation with regard<\/p>\n<p>to the issues noted in the order of the Division Bench for<\/p>\n<p>final determination. Although the petitioner has claimed<\/p>\n<p>to have visited the office of Opposite Party no.4 on<\/p>\n<p>several occasions but he has never sought any<\/p>\n<p>appointment from Opposite Party no.4 and never claimed<\/p>\n<p>for any right of hearing. In fact there appears substance<\/p>\n<p>in the stand of Opposite Party. no.4 that no explanation<\/p>\n<p>was submitted in terms of the Division Bench order and<\/p>\n<p>apparently petitioner avoided to appear in person inspite<\/p>\n<p>of notice published in the newspapers.\n<\/p>\n<p>          In the aforesaid facts and circumstances, the<\/p>\n<p>order passed by Opposite Party no.4, as contained in<\/p>\n<p>annexure-E, amounts to sufficient compliance with the<\/p>\n<p>order of the Division Bench.
