COUNSEL with MR DHARMESH D NANAVATY\nfor\nApplicant(s) : 1, \nMS CHETNA SHAH, APP for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/11\/2011  \n \nORAL ORDER<\/pre>\n<p>1.\tThis is an application<br \/>\nfor anticipatory bail under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with the FIR bearing CR No. I-300 of<br \/>\n2011 registered with  Umra Police Station, Surat for the offences<br \/>\npunishable under Sections 406, 420, 120(B) and 114 of the IPC.\n<\/p>\n<p>2.\tHeard Mr.Prakash<br \/>\nThakkar, learned Senior Counsel appearing for Mr.D.D.Nanavaty, for<br \/>\nthe applicant. Mr.Thakkar has read complaint and documents and<br \/>\nvehemently argued that looking to the role of the present applicant<br \/>\nhe was never director of the Company. The main directors, who are<br \/>\nshown in Form No.32, which is produced at page 31 to 33 they are all<br \/>\nreleased on bail. He has submitted that to book present applicant in<br \/>\nthe offence of Sections 406 and 420 of the IPC entrustment and domain<br \/>\nover the property prima facie requires to be established. He has<br \/>\nprayed that applicant is required to be enlarged on bail.\n<\/p>\n<p>3.\tHeard Ms.Chetna Shah,<br \/>\nlearned APP for the respondent State. She has vehemently opposed the<br \/>\npresent application. She has read statements of witnesses Kalpeshbhai<br \/>\nGordhanbhai, Ashokbhai Dhanjibhai, Himmatbhai Devrajbhai and Nitin<br \/>\nSantlal Narang and contended that from the statement of Hetal N. Shah\n<\/p>\n<p>&#8211; co-accused prima facie it is established that present<br \/>\napplicant is a director. She has submitted that present applicant is<br \/>\nnot required to be granted anticipatory bail.\n<\/p>\n<p>4.\tFrom<br \/>\nthe Registrar of Companies list of directors is called for, which is<br \/>\nproduced on record and Investigating Officer &#8211; A.D.Chauhan has<br \/>\nstated in his report that present applicant is not director of the<br \/>\nsaid Company <\/p>\n<p>5.\tIt appears from the<br \/>\nrecord that at the time of offence committed by the co-accused<br \/>\npresent applicant was not director of the Company so entrustment and<br \/>\ndomain over the property prima facie is not established.\n<\/p>\n<p>6.\tHaving heard learned<br \/>\ncounsel for the parties and perusing the record of the case and<br \/>\ntaking into consideration the facts of the case, I am inclined to<br \/>\ngrant anticipatory bail to the applicant. This Court has also taken<br \/>\ninto consideration the law laid down by the Apex Court in the case of<br \/>\n<a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra &amp; Ors.,<\/a><br \/>\nreported in (2011) 1 SCC 694, wherein the Apex Court reiterated<br \/>\nthe law laid down by the Constitutional Bench in the case of Shri<br \/>\nGurubaksh Singh Sibbia &amp; Ors., reported in (1980) 2 SCC 565.\n<\/p>\n<p>7.\tThe application is<br \/>\nallowed. The applicant is granted anticipatory bail in the event of<br \/>\nhis arrest in connection with CR No. I-300 of 2011 registered<br \/>\nwith  Umra Police Station, Surat for the offences as alleged in FIR<br \/>\non his executing a bond of Rs.10,000\/- [Rupees Ten thousand only]<br \/>\nwith one surety of the like amount on the following conditions that<br \/>\nhe shall:\n<\/p>\n<p>[a]\tco-operate with the<br \/>\ninvestigation and make himself available for interrogation whenever<br \/>\nand wherever required.\n<\/p>\n<p>[b]\tshall remain present<br \/>\nat the concerned Police Station on 21.11.2011 at 11.00 AM ;\n<\/p>\n<p>[c]\tshall not hamper the<br \/>\ninvestigation in any manner nor shall directly or indirectly make any<br \/>\ninducement, threat or promise to any person acquainted with the facts<br \/>\nof the case so as to dissuade him from disclosing such facts to the<br \/>\nCourt or to any police officer;\n<\/p>\n<p>[d]\tat the time of<br \/>\nexecution of bond, furnish him residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]\tnot leave State of<br \/>\nGujarat without the permission of the Court and, if holding a<br \/>\npassport, he shall surrender the same before the Trial Court within a<br \/>\nweek;\n<\/p>\n<p>[f]\tnot obstruct or hamper<br \/>\nthe police investigation and not play mischief with the evidence<br \/>\ncollected or yet to be collected by the police;\n<\/p>\n<p>8.\tIt would be open to the<br \/>\nInvestigating Officer to file an application for remand if he<br \/>\nconsiders it proper and just;
