Misra\n                                       ------\n2\/04.9.2009<\/pre>\n<p>          I have heard learned counsel for the petitioner.\n<\/p>\n<p>                     The petitioner is the defendant in the suit being Eviction Suit<br \/>\n              No.30 of 2001 instituted by the respondent Company for eviction of<br \/>\n              the petitioner from accommodation belonging to the plaintiff<br \/>\n              Company. The basis of suit, as spelt out by the plaintiff, was that<br \/>\n              the petitioner was an employee of the Company and in that<br \/>\n              capacity of such employee he was allotted the Company<br \/>\n              accommodation in the year 1990. The petitioner has ceased<br \/>\n              thereafter to be an employee of the Company and he has defaulted<br \/>\n              in payment of rent and the Company requires the accommodation<br \/>\n              for use of its other existing employees.\n<\/p>\n<p>                     The petitioner filed a written statement and later sought an<br \/>\n              amendment     in   the   written   statement.   In    subsistence   the<br \/>\n              amendment seeks to incorporate the fact that in the allotment<br \/>\n              letter dated 31.5.1990 the words &#8220;M.L.A.&#8221; have been subsequently<br \/>\n              interpolated by the employees of the Company and the petitioner<br \/>\n              has instituted a criminal case in respect of the alleged interpolation.\n<\/p>\n<p>                     It is quite obvious that these averments have absolutely no<br \/>\n              relevance to the material facts stated above upon which the suit is<br \/>\n              based.
