SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npresent application under Section 24 of of the Code of  Civil<br \/>\nProcedure has been preferred by the applicant herein-original<br \/>\nopponent-wife of the opponent to transfer the proceedings of Family<br \/>\nSuit No. 1013\/2008 pending in the Court of learned Family Court No. 3<br \/>\nat Ahmedabad to the learned Family Court at Surat.\n<\/p>\n<p>2.\tHaving<br \/>\nheard Shri Vyas, learned advocate appearing on behalf of the<br \/>\napplicant and Ms. Shilpa Shah, learned advocate appearing on behalf<br \/>\nof the opponent and considering the allegations made by the opponent<br \/>\nherein against the applicant made in the divorce petition with<br \/>\nrespect to the illness of the applicant, this Court is of the opinion<br \/>\nthat looking to the distance between Surat and Ahmedabad the<br \/>\nproceedings  pending at Family Court, Ahmedabad is required to be<br \/>\ntransferred to Family Court, Surat where the applicant is residing.\n<\/p>\n<p>3.\tMs.\n<\/p>\n<p>Shilpa Shah, learned advocate appearing on behalf of the opponent<br \/>\ndoes not invite any further reasoned order while transferring the<br \/>\nproceedings to the learned Family Court at Surat. However, she has<br \/>\nrequested that looking to the marriage life of four months only and<br \/>\nthe allegations made by the opponent, proceedings before the learned<br \/>\nFamily Court, Surat be ordered to be expedited.  Hence, this Court is<br \/>\nnot issuing any further reasoned order while transferring  the<br \/>\nproceedings from the learned  Family Court, Ahmedabad to the learned<br \/>\nFamily Court, Surat.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above and without expressing anything on merits with<br \/>\nrespect to the allegations made by the opponent against the applicant<br \/>\nmade in the divorce petition, the present application is allowed and<br \/>\nthe proceedings of Family Suit No. 1013\/2008 pending in the Court of<br \/>\nlearned Family Court No. 3, Ahmedabad is hereby ordered to be<br \/>\ntransferred to the learned Family Court, Surat. The learned Family<br \/>\nCourt, Ahmedabad is hereby directed to transfer the proceedings to<br \/>\nthe learned Family Court, Surat at the earliest but not later than 15<br \/>\ndays from the date of receipt of the present order.\n<\/p>\n<p>5.\tIn<br \/>\nthe facts and circumstances of the case, the learned Family Court,<br \/>\nSurat is hereby directed to expedite the hearing of the aforesaid<br \/>\nsuit and see to it that the same is decided and disposed of finally<br \/>\nwithin a period of one year from the date of such transfer of the<br \/>\nproceedings to that Court.  The learned advocate appearing on behalf<br \/>\nof the applicant has assured the Court that the applicant and her<br \/>\nadvocate shall fully cooperate with the learned Family Court in early<br \/>\ndisposal of the Family Suit and within the stipulated time stated<br \/>\nhereinabove and they shall not take any unnecessary adjournment.\n<\/p>\n<p>6.\tWith<br \/>\nthis, the present application is allowed. Rule is made absolute to<br \/>\nthe aforesaid extent.
