No.19827\/2010-C\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n\n            Dated this the 19th day of July, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>    The petitioner&#8217;s grievance appears to be that the third<\/p>\n<p>respondent who is conducting a hotel has encroached the<\/p>\n<p>footpath and is utilising it for cooking food items. It is<\/p>\n<p>also  contended  that   he  is  causing   nuisance to   the<\/p>\n<p>neighbouring shop owners by his activities also.<\/p>\n<p>    2.   Heard the learned counsel for the petitioner, the<\/p>\n<p>learned  Standing  Counsel  for  the  Corporation and  the<\/p>\n<p>learned  counsel   appearing  for   the  third  respondent.<\/p>\n<p>According to the learned counsel for the third respondent,<\/p>\n<p>he is only utilising the land appurtenant to the building<\/p>\n<p>and, therefore, the contention raised by the petitioner<\/p>\n<p>that there is encroachment to the footpath is not correct.<\/p>\n<p>The learned Standing Counsel for the Corporation submitted<\/p>\n<p>that after conducting a preliminary enquiry a direction was<\/p>\n<p>issued to the third respondent to remove the temporary<\/p>\n<p>constructions and cooking utensils.   The third respondent,<\/p>\n<p>it appears has filed an objection before the Corporation<\/p>\n<p>with regard to the notice issued to him.<\/p>\n<p>    3.   In that view of the matter, there will be a<\/p>\n<p>direction to the first and second respondents to take a<\/p>\n<p>W.P.(C). No.19827\/2010<br \/>\n<span class=\"hidden_text\">                            -:2:-<\/span><\/p>\n<p>decision in the matter with notice to the petitioner and<\/p>\n<p>the third respondent within a period of ten days.   Further<\/p>\n<p>action pursuant to the notice will be taken after the final<\/p>\n<p>order is passed.\n<\/p>\n<p>     The writ petition is disposed of as above.
