Justice R.BASANT\n\n Dated :27\/11\/2007\n\n O R D E R\n                                R.BASANT, J\n                        ------------------------------------\n                       Crl.M.C.No.3471 of 2007\n                        -------------------------------------\n             Dated this the 27th day of November, 2007\n\n                                  O R D E R\n<\/pre>\n<p>      Petitioners are accused 1 and 2 in an F.I.R registered alleging<\/p>\n<p>offences punishable under Sections 447 and 427 I.P.C.                  The 1st<\/p>\n<p>petitioner is an elderly person aged about 88 years. The petitioners<\/p>\n<p>have come to this Court with a prayer that the F.I.R registered against<\/p>\n<p>them, a copy of which is produced as Annexure-3, may be quashed<\/p>\n<p>invoking the extraordinary inherent jurisdiction under Section 482<\/p>\n<p>Cr.P.C.\n<\/p>\n<p>      2.    What is the ground ? Obviously the dispute is about the lie<\/p>\n<p>of the boundary between 2 properties.                      A compound wall was<\/p>\n<p>admittedly constructed.        That compound wall admittedly stands<\/p>\n<p>demolished.      The petitioners would contend that the defacto<\/p>\n<p>complainant had demolished the compound wall constructed by him<\/p>\n<p>voluntarily on his own. The defacto complainant in the F.I statement<\/p>\n<p>alleged that it was the petitioners who took law into their hands and<\/p>\n<p>demolished the compound wall.\n<\/p>\n<p>      3.    According to the learned counsel for the petitioners, the<\/p>\n<p>petitioners are respectable persons. They are not people who would<\/p>\n<p>indulge in such a criminal conduct. In these circumstances it is prayed<\/p>\n<p>that the F.I.R registered may be quashed.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3471 of 2007             2<\/span><\/p>\n<p>      4.    The extraordinary inherent jurisdiction available to this<\/p>\n<p>Court under Section 482 Cr.P.C does certainly clothe this Court with<\/p>\n<p>jurisdictional competence to set aside an F.I.R in an appropriate case.<\/p>\n<p>There can be no doubt on that proposition. But disputed questions of<\/p>\n<p>fact cannot normally and ordinarily be attempted to be resolved in<\/p>\n<p>proceedings under Section 482 Cr.P.C. I repeat that it is admitted that<\/p>\n<p>a compound wall stood there. It is the case of the petitioners that the<\/p>\n<p>said compound wall was constructed recently and the defacto<\/p>\n<p>complainant was persuaded to demolish the said compound wall. The<\/p>\n<p>defacto complainant&#8217;s version is that the petitioners had taken law into<\/p>\n<p>their hands and had demolished the compound wall.<\/p>\n<p>      5.    Certainly the disputed question can be resolved now only<\/p>\n<p>by a proper investigation to be conducted by the police. I am unable<\/p>\n<p>to agree that any circumstances exist justifying or warranting the<\/p>\n<p>invocation of the jurisdiction under Section 482 Cr.P.C.<\/p>\n<p>      6.    The learned counsel for the petitioners then contends that<\/p>\n<p>the Circle Inspector of Police, Kottarakkara, the 2nd respondent is<\/p>\n<p>taking undue interest in the matter and it is at his instance that the<\/p>\n<p>F.I.R was registered. Admittedly the investigation is being conducted<\/p>\n<p>by the 3rd respondent. I do not find any reason to issue any direction<\/p>\n<p>regarding the personnel who is to conduct the investigation now.<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3471 of 2007             3<\/span><\/p>\n<p>      7.   The learned counsel for the petitioners then contends that<\/p>\n<p>subsequent events have taken place and a barbed wire fencing<\/p>\n<p>constructed by the petitioners has been demolished. Against that, a<\/p>\n<p>private complaint has admittedly been filed before the Magistrate and<\/p>\n<p>action is pending before the Magistrate. No directions regarding that<\/p>\n<p>also need be issued in the matter.           The upshot of the above<\/p>\n<p>discussions is that there is no necessity to invoke the jurisdiction under<\/p>\n<p>Section 482 Cr.P.C in this matter now.\n<\/p>\n<p>      8.
