DEPOT     SUPERINTENDENT,        BIHAR     STATE ROAD\n                      TRANSPORT CORPORATION, BIHAR SHARIF, NALANDA.\n\n                   For the petitioner : Mr. Nand Kumar Singh, Advocate.\n                   For the respondent : Mr. Shree Ganesh, Advocate.\n                                                 -----------------\n<\/pre>\n<p>02.   21.10.2011                      Heard learned counsel for the Bihar State<\/p>\n<p>                        Road Transport Corporation(hereinafter referred to as<\/p>\n<p>                        the Corporation) and the counsel for the writ<\/p>\n<p>                        petitioner.\n<\/p>\n<p>                                      By filing the review petition Corporation is<\/p>\n<p>                        seeking review of the order dated 24.09.2010 passed<\/p>\n<p>                        by this Court in C.W.J.C. No.14186 of 2010,<\/p>\n<p>                        whereunder punishment order dated 18.11.2002<\/p>\n<p>                        withholding his leave salary and gratuity amount has<\/p>\n<p>                        been quashed holding that the said order was passed<\/p>\n<p>                        without serving on him any charge memo as also<\/p>\n<p>                        without giving him any opportunity to defend<\/p>\n<p>                        himself. Review of the said order is being sought on<\/p>\n<p>                        the ground that before retirement of the petitioner on<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>31.12.2000 he was himself appearing in the<\/p>\n<p>proceeding and in support of such fact representation<\/p>\n<p>dated 13.06.1996 filed by the petitioner before the<\/p>\n<p>Special Officer has been placed on record of the<\/p>\n<p>review petition as Annexure-6 and with reference to<\/p>\n<p>the same and the other notices referred to in<\/p>\n<p>paragraph 5G of the review petition it is submitted<\/p>\n<p>that even after retirement of the petitioner notice<\/p>\n<p>dated 9.11.2000 10.1.2001, 23.3.2001 and 12.5.2001<\/p>\n<p>was served on the petitioner to participate in the<\/p>\n<p>departmental proceeding but he failed to appear in the<\/p>\n<p>proceeding, the Enquiry Officer submitted report<\/p>\n<p>dated 25.7.2001, Annexure-9 on the basis of which<\/p>\n<p>punishment order dated 18.11.2002 was passed.<\/p>\n<p>Aforesaid submission has been noted for being<\/p>\n<p>rejected for the reason that from the review petition it<\/p>\n<p>does not appear that either the notices referred to in<\/p>\n<p>paragraph-5G or the enquiry report dated 25.7.2001<\/p>\n<p>was ever served on the petitioner before passing the<\/p>\n<p>punishment order dated 18.11.2002. Further aspect<\/p>\n<p>which has come to light is that petitioner was not paid<\/p>\n<p>salary for the period 23.7.1994-26.7.1994 the date<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>          between the alleged misconduct and suspension. He<\/p>\n<p>          was also not paid subsistence allowance from the date<\/p>\n<p>          of suspension, thereby seriously prejudiced to<\/p>\n<p>          participate in the proceeding. The enquiry report<\/p>\n<p>          dated 25.7.2001 having also not been served on the<\/p>\n<p>          petitioner he had no opportunity at all to defend<\/p>\n<p>          himself. In the circumstances, I do not see any reason<\/p>\n<p>          to review the order dated 24.09.2010 passed in<\/p>\n<p>          C.W.J.C. No.14186 of 2010. The review petition is<\/p>\n<p>          dismissed with cost assessed at Rs.5,000\/-.<\/p>\n<p>                                ( V. N.
