The defendant<\/p>\n<p>V -vthexei\ufb01nf:  to be aggrieved by the mmunent<\/p>\n<p>   passed by the {hurts below is before this Court in<\/p>\n<p>&#8216;n<\/p>\n<p>2. The pzaintitif was beii31e z\ufb011e:   for<br \/>\njudwtent and decree  and for the<br \/>\nconsequential relief of  of the<br \/>\nsuit schedule    was that he is<\/p>\n<p>the absolute    property bearm&#8217; g<\/p>\n<p>&#8216;I&#8217;.S.No.3i%:  measuring 7357 sq.\ufb01:<br \/>\nsituate a\u00a3&#8221;Q1de%Marke%iA&#8217;eRaa{j;&#8217;  1 Bazaar, Bellary. The<\/p>\n<p>  &#8216;teat .f}1evst1it schedule property ozti\ufb01ally<\/p>\n<p> 3.3;; one Sm&#8217;t;\u00a7{.&#8217;Sund1an1ma the junior aunt of the<\/p>\n<p>  Slmdramma got the property throng}:<\/p>\n<p>the  of Madras on 13.2.1933. She is said to<\/p>\n<p> , Imve been  poasession and enjoyment of the 3uit_ mhetiule<\/p>\n<p>   since 13.22.1933 and on 13.11.1967&#8217;, she executed a<\/p>\n<p>  settiement deed in \ufb01nvour of the plaizntiff. The<\/p>\n<p> tlzexefoxe, claiming to have acquired title to the<\/p>\n<p>L<\/p>\n<p>&#8216;in:\n<\/p>\n<p>property under the sa1d&#8217; settlement deed dated    H<\/p>\n<p>claims to be in possession of the    &#8216;the<\/p>\n<p>municipal taxes in respect of the   c1T[1\u00bbi1\u00a3AiA\u00e9:&#8217;~f(J-1:? <\/p>\n<p>the suit by the plainti\ufb01f is 4136 \u00a7iVta;f\u00a2n\u20ac$..g;V:;:-$7<br \/>\nworking in the I-&#8220;choc d\u00a2f;)a1&#8217;tmon1.;:\u00a7\u00a7s 8.. &#8216;ca-nst\u00e9nble in<br \/>\nSandur Police Station   _right title or<br \/>\ninterest in the said    the<br \/>\npla1&#8217;11t:i\ufb01&#8217; and   to \ufb01le the<br \/>\nsuit.   }.  J    V<\/p>\n<p>4. ($n.f_l\u00a7o\ufb01ng&#8217;   summons, the dcfcmiant<\/p>\n<p>appealtxi gnd   oa  i;&#8217;.et.oiled written statement. The<\/p>\n<p>  \u00abi&#8221;ofc3i(i:i:i1ti&#8211;.&#8221;od.ci:soi\u00a7.d  \u00abthe plaintiff is the owner of the<\/p>\n<p>   on the other hand set up title to the<\/p>\n<p>&#8212;     that the property in question had been<\/p>\n<p> Eyihe Mummpa&#8217; &#8216; lcolmcil, Bcllaxy on 29.11.1932 in<\/p>\n<p>  o\u00a2fRcven3d J. Pinto. The sand&#8217; Resrcmd -J. Pinto &#8216;m said&#8217;<\/p>\n<p>  have executed a sale deed in flavour of the defendant on<\/p>\n<p> \u00b0.3l.8.I96l. The defcndatat contends that prior to the<\/p>\n<p>J,<\/p>\n<p>o<br \/>\nN<\/p>\n<p>execution of the sale deed, the vendor wasin   V&#8221;  V&#8217;<\/p>\n<p>thema\ufb01er the defendant has been,    V<\/p>\n<p>property and the municipal   <\/p>\n<p>de\ufb01endant thcrefare not oniy dii\ufb01i\ufb02tes  igi\ufb02e  * }&#8217;<\/p>\n<p>but sets up title in himself andi_1 \u00a7s 1sm;gh\u00a3&#8217;\u00a3c\u00bb:~_  of<br \/>\nthe suit. A  &#8216;V\n<\/p>\n<p>5. The trial    sgridcncc<br \/>\ntendered by the pal\ufb01ees  ?  u  contentions,<br \/>\nd\u20acC&#8217;.!BE=d the suit if;   and the<br \/>\nappeal \ufb01led    15$ judgment<br \/>\ndated RA&#8221;   &#8216;by judgment datnd<br \/>\n  is before this Court in<\/p>\n<p>this   &#8216; &#8216;  &#8221;  hereunder:\n<\/p>\n<p>.&#8217; V.  \u00abV   Grgurt  admitting the appeal on 19.9.2002<\/p>\n<p>  :e;2 &#8216;n;:(i   V&#8217; &#8216; _&#8217;_g substantial quemtians emf law which read<\/p>\n<p>  as he33:un(l\u00a21&#8243;[ AT<\/p>\n<p> i] &#8221; T~W1~;ether the Courts below eeuid have deemed<br \/>\nV &#8221; the plaintiff &#8216;s suit when eamiuedly the plahati\ufb02&#8221;<\/p>\n<p>who has come to the Court seeking declaration<\/p>\n<p>3:.\n<\/p>\n<p>judgment rendered by the tr1a&#8217; 1 Court would    M<\/p>\n<p>tzdal Court has assessed the evidence &#8220;available  <\/p>\n<p>that context.\n<\/p>\n<p>12. As noticed above, the   registered<br \/>\nsettlement deed dated&#8217;   :&#8217;  to Iaaae been<br \/>\nexecuted by VA  aunt of the<br \/>\nplairj\ufb01\ufb01 who Vbeizin   \u00abenjoyment of the<br \/>\nproperty   deed is marked<br \/>\nas  &#8221; 1    right under which<br \/>\n pmperty in favour of the<\/p>\n<p>p1ai11t;iff,_vit isLi$c-1V1 i:e31d:-edAVthe property was granted by the<\/p>\n<p> of Maaia;-you 13.2.1933 vide tara No.49(}8\/32.<\/p>\n<p>  g;ra:nt order nor any document executed by<\/p>\n<p>the  avaiiable at this juncture, the document:<\/p>\n<p> . &#8216;.911  plain\ufb01\ufb01 places Ieliazlce is the extract of the<\/p>\n<p>  &#8220;.Sur\u00a7rey Register which is marked as Ex.P2. The other<\/p>\n<p> =\u00abT.&#8217;aia(g1a1&#8217;1;enI3 at Ex.P3 to P11 are no doubt the zevenue<\/p>\n<p>  such as the other extraets and the tax paid&#8217;<\/p>\n<p>&lt; A receipts. Against the said case put forth by the plainti\ufb01; the<\/p>\n<p>J:\n<\/p>\n<p>I3<\/p>\n<p>defendant has contended that the pmpcrty in queetien:   M<\/p>\n<p>initially gamed in favour of Revelnd&#8217; &#8216;J.F&#8217;&#8211;inIA:o&#8221;_&lt;by_:  <\/p>\n<p>Municipality on 29.11.1932 and nmgma<\/p>\n<p>has said the pm-petty to the  a<br \/>\ndeed dated 31.8. 1961  is  \u00a7S_ EX..].)&quot;1;&quot;-I.\ufb02..\u20ac.;Id\u20ac}f&#039; to<br \/>\nstate that the pmpertyv   vendor, the<br \/>\ndefendant has  en    which &#039;E<br \/>\nat Ex.D4l.   the other<br \/>\n eeries are the extract<br \/>\nof the f receipts. The suit of the<\/p>\n<p>plain\ufb01\ufb02 im.&#039;:;:ee%p:ea\u00e9ui,&#039;-c\u00a7gi;sceV&quot;&#039;s\u00a7$as instituted on 2.11.1935.<\/p>\n<p>The1*eii:&amp;&#039;e, _the&#039; ti%3ve  reli\ufb01 on by the pLa1&#039;nti\ufb01&#039; as<\/p>\n<p>  vi?ell  \u00e9ie-Cttfje &amp;&#039;eienda1v1Him&#039;et Ex.P1 and D1 were nearly two<\/p>\n<p>file dete of institution of the suit and it is<\/p>\n<p>  not  document had come into existcmre<\/p>\n<p> just  the \ufb01\ufb01ng of the suit. in that bacl-rye-uxxd, no<\/p>\n<p>  &lt;iLe_t:13_tD4I would state that it is a memo wheleunder the<\/p>\n<p>  engineer is rinfcrmed that Revernd J.Pinto has<\/p>\n<p>  the amount and the engineer is lequesfed fa<\/p>\n<p>E.\n<\/p>\n<p>..,4.s<\/p>\n<p>handover the plots. However, there is no other  M<br \/>\nindicate that the property has themafter\u00e9  u<\/p>\n<p>the name of Revezmcl Pinto <\/p>\n<p>memo has been acted upoo.  Vot};1eAr&#8221;&#8216;:._;re:re\ufb01ue<br \/>\ndocuments relied on by the    of the<br \/>\nassessment register and &#8220;which are \ufb01ozm<br \/>\nthe year 1971 onwal\ufb02e.-&#8220;*  &#8220;Eix.D42 would<br \/>\ni:1d:iate that     the year 1971<br \/>\nthough the  fmhamd in the year<br \/>\n1961.  iejeveli though the revenue<br \/>\ndoemnelo\ufb01   had been aesessed in<\/p>\n<p>the name of  his purchase, there is: no<\/p>\n<p> V&#8217; to Show  to the document at Ex.{)41<\/p>\n<p> 2.12.1932, the vendor of the defendant<\/p>\n<p>woe&#8217;   possession as indicated therein and the<\/p>\n<p>Vvv\u00e9as assessed in his name  . If these<br \/>\n   are kept in view, the document relied on by the<br \/>\n  at Ex.P2 to complement the aettlelnent deed at<\/p>\n<p> &#8220;uEx.P1 would assume certain evidenlziary value even though<\/p>\n<p>J3<\/p>\n<p><span class=\"hidden_text\">15<\/span><\/p>\n<p>no title deed as such of S:mt.K.Su11da:ramma   <\/p>\n<p>This is so because the contention Zctfw\ufb02zze. &#8216;:t}i_tttt&#8217;<br \/>\nproperty was allotted in favour of<br \/>\nbe fortzi\ufb01ed by the entzy jg<br \/>\nrecerds whemin the   73<br \/>\nfound in Ex.P&#8217;2. Though&#8217;   \u00abi3 an extract of<br \/>\nthe register    &#8220;a&#8217;:lli;hO1&#8217;ity, it is<br \/>\nnot a case    been obtained<br \/>\nsubsequent    &#8216;m favmlr of the<br \/>\nplain\ufb01\ufb01   around the date of \ufb01ling of<br \/>\nthe suit.   wouid indicate that the saw<br \/>\nextraet has &#8216;isguad&#8217;~\u00a7\ufb01&#8217;~:a;6.1o.1967 which is pliin&#8217; to the<\/p>\n<p>-&#8220;\ufb01tititc     deed which was executed on<\/p>\n<p> fl\ufb01teiefore, the said document at Ex.P2 not only<\/p>\n<p>  V cstab\ufb021iahes&#8217;tt;\u00a7-ittttthenticity but would also itzdicaiie that the<\/p>\n<p>   was aequ1red&#8217; by Szztt.K.Sundam1nma as<\/p>\n<p>  entaezed in the land survey records. which<\/p>\n<p> &#8216;iindieate that the grant as claimed has been ac-ted<\/p>\n<p>Vt  and the settler of the plainti\ufb02&#8217; had acquired title and<\/p>\n<p>is<\/p>\n<p><span class=\"hidden_text\">16<\/span><\/p>\n<p>was in posscsslon&#8217; of the pmperty. Though  Iemned_     H<\/p>\n<p>counsel for the appellant relied on E;(&#8216;.B-\u20ac20, aft  <\/p>\n<p>sa1d&#8217; to have been issued by the om <\/p>\n<p>dispute the said document at  __&#8221;to {he<br \/>\nlearned counsel when 1333!?&#8217; Iicf1&#8243;:V;&#8217;?l$hlV:-T\u00a7iv-_$&#8217;0&#8243;&#8216;\u00bb&#8217;L,311t. &#8216;fbI&#8217;vvfh\u00a2.3 \u00a7cxuact<br \/>\nas at Ex.P2, he was not    same. This<br \/>\ncontention cannot\ufb02gsttqy&#8217;   Ex.P2 since<br \/>\n\ufb01rst and famg\u00e9wg\ufb02   issued by the<br \/>\no\ufb01ice of the   states is that it is<br \/>\nnot avaiIf;#blc_!  a\u00e9qi\ufb01i-..V_\u00a7uch endomcment was issued<br \/>\non 17.4.1 9a9&#8242;  :\u00a71;\u00a7=;1&#8243;&#8216;az:\u00a7\u00a2:i\u00a7.uent at Ex.P2 as already<\/p>\n<p>139-\ufb01csedj. *a&#8217;oxavc 1&#8217;a.   cgttract which was issued in or<\/p>\n<p>  \ufb01fe; of  thc suit but as far back as in the<\/p>\n<p>Va,:\u00a7_i.~such the said endorsement cannot take<\/p>\n<p>  aevxiy  of Ex.P2. These being the relevant<\/p>\n<p> in a case of this nature, it would have to be<\/p>\n<p>  .;g;uc:u.aed that the pla&#8217;mti\ufb02&#8217; has established a better title<\/p>\n<p>  3}} crther documents as ahead}: observed are the<\/p>\n<p>A<\/p>\n<p>7:\n<\/p>\n<p>exlracts of the tax paid receipts which are  .   <\/p>\n<p>both in the case ofthc plaintitfmad t}:&#8217;;t\u00e9&#8221;&#8216;ti\u00a2:f4=:1&amp;1(i&#8217;\u00a7111t_V;.&#8221;   A:  <\/p>\n<p>13.
