Justice P.N.RAVINDRAN\n\n Dated :03\/11\/2009\n\n O R D E R\n                       P.N.RAVINDRAN, J\n                          .......................\n                       W.P.(C).30728\/2009\n                          .......................\n            Dated this the 3rd day of November, 2009\n\n                           JUDGMENT\n<\/pre>\n<p>      By Ext.P1 tender notice dated 12.6.2009, the 6th<\/p>\n<p>respondent    invited    tenders        from     registered &#8216;A&#8217;  class<\/p>\n<p>contractors. As per the tender notice, the petitioner submitted<\/p>\n<p>Pre-qualification bid and price bid. In paragraph 9.4 of the<\/p>\n<p>tender conditions it is stipulated that incomplete applications<\/p>\n<p>are liable to be rejected. In paragraph 9.14 (g) it is stipulated<\/p>\n<p>that the profit and loss statements, balance sheets and auditor&#8217;s<\/p>\n<p>report for the past five years should be produced along with the<\/p>\n<p>estimated financial projection for the next two years.            The<\/p>\n<p>petitioner   submitted     the profit and loss statements and<\/p>\n<p>balance sheets for only three years. On that ground, he was<\/p>\n<p>disqualified.  The petitioner contends, relying on the proforma<\/p>\n<p>in schedule B to the pre-qualification application that only<\/p>\n<p>three years&#8217; profit and loss statements have to be produced.<\/p>\n<p>He contends that in such circumstances,                the decision to<\/p>\n<p>disqualify him is arbitrary and is intended to favour the sole<\/p>\n<p>person who was pre-qualified.\n<\/p>\n<p>2.    I have considered the submission made at the Bar by the<\/p>\n<p>learned counsel appearing for the petitioner and learned<\/p>\n<p>W.P.(C).30728\/09<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>Government Pleader appearing for the official respondents.<\/p>\n<p>Paragraph 9.14(g) of Ext.P2 tender conditions reads as<\/p>\n<p>follows:-\n<\/p>\n<blockquote><p>         &#8220;Reports on the financial standing         of the<\/p>\n<p>         tenderer of such party to a joint ventures<\/p>\n<p>         including profit and loss statements balance<\/p>\n<p>         sheets and auditor&#8217;s for the past five years, on<\/p>\n<p>         estimated financial projection for the next two<\/p>\n<p>         years and on authority from the tenderer (or<\/p>\n<p>         authorized representative of a joint venture) to<\/p>\n<p>         seek reference from the tenderers bankers.&#8221;<\/p>\n<\/blockquote>\n<p>3.   Paragraph 9.4 reads as follows:-\n<\/p>\n<\/p>\n<p>         &#8220;Incomplete offers are liable to be rejected.&#8221;<\/p>\n<p>4.   Though in Schedule B Financial Statement in the Pre-<\/p>\n<p>qualification application against item No.3 reference is only to<\/p>\n<p>the audited balance sheets and profit and loss statement for<\/p>\n<p>the past three years, it is evident from column 5 thereof that<\/p>\n<p>the bidder is bound to furnish details of the works executed<\/p>\n<p>by him for the past five years. In the light of the stipulation in<\/p>\n<p>paragraph 9.14(g) and even in Schedule B appended to the<\/p>\n<p>W.P.(C).30728\/09<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>Pre-qualification application,    I am of the opinion that the<\/p>\n<p>petitioner who did not furnish the profit and loss statement<\/p>\n<p>and audited balance sheets for the past five years, was liable<\/p>\n<p>to be disqualified.   The petitioner&#8217;s    tender, which did not<\/p>\n<p>satisfy the tender conditions, was, in my opinion, liable to be<\/p>\n<p>rejected. I therefore, find no merit in the contention raised by<\/p>\n<p>the learned counsel for the petitioner that even if his tender<\/p>\n<p>was defective, he ought to have been afforded an opportunity<\/p>\n<p>to cure the defect.\n<\/p>\n<p>      I accordingly hold that there is no merit in the writ<\/p>\n<p>petition.
