Murali Sankar\n- - - - - --\n:ORDER\n<\/pre>\n<p>\t\t The petitioner has invoked the writ jurisdiction of this Court,<br \/>\nunder Article 226 of the Constitution of India, for issuance of a Writ, in the<br \/>\nnature of Certiorari, to quash the order dated 15.09.2010, passed by the<br \/>\nEmployees&#8217; Provident Fund Appellate Tribunal, New Delhi.\n<\/p>\n<p>\t\t2. The impugned order reads as under:-\n<\/p>\n<p>\t\t&#8220;The record reveals that the matter was listed today for hearing on<br \/>\nrestoration of restoration application. However, there is no provision of<br \/>\nrestore the restoration application. Since there is not provision to restore a<br \/>\nrestoration application the same stands rejected. Copy of the order be sent to<br \/>\nthe parties and the file be consigned to record room&#8221;.\n<\/p>\n<p>\t\t3. The impugned order cannot be sustained, as the application moved<br \/>\nby the petitioner has not decided on merit, but has been dismissed, for want of<br \/>\njurisdiction. It is well settled law, that under inherent jurisdiction, Court<br \/>\ncan always restore an application filed, for restoration of the Appeal, which<br \/>\nwas dismissed for default.\n<\/p>\n<p>\t\t4. The impugned order therefore is set aside, and the application<br \/>\nfiled for restoration of application for restoration of Appeal is allowed. The<br \/>\nlearned Tribunal is directed to decide the application for restoration of<br \/>\nAppeal, on merits, and in accordance with law.\n<\/p>\n<p>\t\t5.
