DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Learned APP waives service of notice of rule for respondent &#8211;<br \/>\nState of Gujarat.\n<\/p>\n<p>\tMr<br \/>\nSV Raju, learned Senior Advocate appearing with Mr. Narendra Jain for<br \/>\nthe applicant, submits that condition No.3 directing the applicant<br \/>\nto mark his presence in the police station on 1st 11th<br \/>\n&amp; 21st of every month till charge sheet is filed, of<br \/>\nthe order dated 01.02.2011 passed by the 2nd Additional<br \/>\nSessions Judge, Gandhidham, District Kachchh in Criminal Misc.<br \/>\nApplication No.19 of 2011  while enlarging the applicant on bail, is<br \/>\nonerous and no such condition is imposed on the other accused while<br \/>\nenlarging them  on bail.  It is further submitted that the above<br \/>\ncondition would cause undue harassment to the applicant and the<br \/>\napplicant shown his willingness to abide by all other conditions.\n<\/p>\n<p>\tHeard<br \/>\nlearned APP for the respondent &#8211; State of Gujarat.\n<\/p>\n<p>\tHaving<br \/>\nheard learned counsel for the parties and considering the facts and<br \/>\ncircumstances of the case and other attending circumstances, I am<br \/>\ninclined to delete condition No.3  of the order dated 01.02.2011<br \/>\npassed by the 2nd Additional Sessions Judge, Gandhidham,<br \/>\nDistrict Kachchh in Criminal Misc. Application No.19 of 2011.  Other<br \/>\nconditions of the order stand as they are.\n<\/p>\n<p>\tAccordingly,<br \/>\nthis application is allowed.
