M No. 3164 of 2009\n                                Date of Decision:March 16, 2009\n\nDr.Neena Gupta                                     ...........Petitioner\n                           Versus\n\n\n\nState of Punjab and another                         ..........Respondents\n\n\n\nCoram:        Hon'ble Mrs. Justice Sabina\n\nPresent:      Mr.S.S.Gill, Advocate\n             for the petitioners.\n             Petitioner present in person\n             Mr.Amandeep Singh Rai,Assistant Advocate\n             General, Punjab\n             Mr.K.S.Sandhu, Advocate for respondent No.2\n             Respondent No. 2 in person.\n                    **\n\nSabina, J.\n<\/pre>\n<p>               Petitioner-Dr.Neena Gupta     has filed this petition        under<\/p>\n<p>Section 482 of the Code of Criminal Procedure seeking quashing of FIR No.<\/p>\n<p>96   dated 20.3.2006 under Section 304-A of the Indian Penal Code (`IPC&#8217;<\/p>\n<p>for short) registered at Police Station Civil Lines, Patiala, District Patiala<\/p>\n<p>as well as the subsequent proceeding arising therefrom on the basis            of<\/p>\n<p>compromise between the parties dated 15.1.2009 (Annexure P2).<\/p>\n<p>               Learned counsel for the petitioner has submitted that it is a<\/p>\n<p>case of cross-version.       Petitioner had also lodged FIR against the<\/p>\n<p>complainant. Now, with the intervention of the respectables, parties have<\/p>\n<p>arrived at a compromise.\n<\/p>\n<p>               Respondent No.2 is present in person along with his counsel<\/p>\n<p>and has admitted the contents of the compromise              dated 15.1.2009<\/p>\n<p>(Annexure P2), wherein, it has been agreed between the parties that both the<\/p>\n<p>parties have resolved their disputes and would get both the FIRs i.e. FIR<br \/>\n<span class=\"hidden_text\"> Crl. Misc. M No. 3164 of 2009               -2-<\/span><\/p>\n<p>No.96 dated 20.3.2006 under Section 304-A IPC of Police Station Civil<\/p>\n<p>Lines, Patiala against Dr. Neena Gupta, wife of Dr.S.P.Gupta registered by<\/p>\n<p>party No.1 and FIR No. 97 dated 20.3.2006 under Sections 452, 323, 427,<\/p>\n<p>506, 148, 149 IPC of Police Station Civil Lines, Patiala was registered<\/p>\n<p>against party No.1 by party No.2 quashed by filing petition under Section<\/p>\n<p>482 of the Code of Criminal Procedure.\n<\/p>\n<p>              As per the Full Bench judgment of this Court in Kulwinder<\/p>\n<p>Singh and others vs. State of Punjab, 2007 (3) RCR (Criminal) 1052,<\/p>\n<p>High Court has power under Section 482 Cr.P.C. to allow the compounding<\/p>\n<p>of non-compoundable offence and quash the prosecution where the High<\/p>\n<p>Court felt that the same was required to prevent the abuse of the process of<\/p>\n<p>any Court or to otherwise secure the ends of justice.          This power of<\/p>\n<p>quashing is not confined to matrimonial disputes alone.<\/p>\n<p>              Hon&#8217;ble the Apex Court in the case of Nikhil Merchant vs.<\/p>\n<p>Central bureau of Investigation and another JT 2008 (9) SC 192 in para<\/p>\n<p>Nos. 23 and 24 has held as under:-\n<\/p>\n<blockquote><p>                   &#8220;23. In the instant case, the disputes between the<\/p>\n<p>                   Company and the Bank have been set at rest on the<\/p>\n<p>                   basis of the compromise arrived at by them whereunder<\/p>\n<p>                   the dues of the Bank have been cleared and the Bank<\/p>\n<p>                   does not appear to have any further claim against the<\/p>\n<p>                   Company. What, however, remains is the fact that<\/p>\n<p>                   certain documents were alleged to have been created by<\/p>\n<p>                   the appellant herein in order to avail of credit facilities<\/p>\n<p>                   beyond the limit to which the Company was entitled.<\/p>\n<p>                   The dispute involved herein has overtones of a civil<br \/>\n<span class=\"hidden_text\"> Crl. Misc. M No. 3164 of 2009              -3-<\/span><\/p>\n<p>                   dispute with certain criminal facets. The question which<\/p>\n<p>                   is required to be answered in this case is whether the<\/p>\n<p>                   power which independently lies with this court to quash<\/p>\n<p>                   the criminal proceedings pursuant to the compromise<\/p>\n<p>                   arrived at, should at all be exercised?\n<\/p><\/blockquote>\n<blockquote><p>                   24.On an overall view of the facts as indicated<\/p>\n<p>                   hereinabove and keeping in mind the decision of this<\/p>\n<p>                   Court in B.S.Joshi&#8217;s case (supra) and the compromise<\/p>\n<p>                   arrived at between the Company and the Bank as also<\/p>\n<p>                   clause 11 of the consent terms filed in the suit filled by<\/p>\n<p>                   the Bank, we are satisfied that this is a fit case where<\/p>\n<p>                   technicality should not be allowed to stand in the way in<\/p>\n<p>                   the quashing of the criminal proceedings, since, in our<\/p>\n<p>                   view, the continuance of the same after the compromise<\/p>\n<p>                   arrived at between the parties would be a   futile<\/p>\n<p>                   exercise.&#8221;<\/p><\/blockquote>\n<p>                 Since the parties have arrived at a compromise, in order to<\/p>\n<p>live in peace, no useful purpose would be served by proceeding further<\/p>\n<p>with the criminal proceedings.\n<\/p>\n<p>                 Accordingly, this petition is allowed.
