CHINNAPPA (J)\nMISRA RANGNATH\n\nCITATION:\n 1984 AIR 1586\t\t  1985 SCR  (1) 349\n 1984 SCC  (4) 370\t  1984 SCALE  (2)232\n\n\nACT:\n     Constitution of  India, Article  136-Discretion of\t the\nCourt  to   grant  Special   Leave  to\tAppeal\tin  criminal\nproceedings-Whether  in\t the  absence  of  necessary  papers\ngiving full facts, the Court may refuse leave.\n     Supreme Court  Rules,  1966,  Order  XXI-Special  Leave\nPetitions in  Criminal proceedings  must  contain  necessary\npapers giving full facts.\n\n\n\nHEADNOTE:\n     In\t the  petitions\t for  special  leave  to  appeal  in\ncriminal proceedings,  the petitioner annexed only a copy of\nthe judgment  of the High Court but did not file any papers,\nsuch as,  copies of the charge-sheets or the judgment of the\nTrial Court which could give full picture of the facts.\n     Dismissing the petitions,\n^\n     HELD :  1. The  Supreme Court  in the  exercise of\t its\njurisdiction under  Article 136\t may not  propose to proceed\nfurther in the matter in which the petitioner has not chosen\nto file\t any papers  in the court apart from the judgment of\nthe High  Court. Therefore,  in the  instant case, the Court\nwill not  be justified in issuing a show cause notice to the\nrespondent when\t no attempt  has been  made to place all the\nfacts before it by filing the necessary documents. [350C-D]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CRIMINAL  APPELLATE   JURISDICTION\t :   Special   Leave<br \/>\nPetition (Crl.) Nos. 1288 to 1301 of 1983.\n<\/p>\n<p>     From the Judgment and Order dated 31st January, 1983 of<br \/>\nthe Karnataka  High Court  in Crl. Appeal Nos. 461 to 474 of<br \/>\n1981.\n<\/p>\n<p>     K.L. Sharma and M. Veerappa for the petitioner.<br \/>\n     The Order of the Court mas delivered by<br \/>\n<span class=\"hidden_text\">350<\/span><br \/>\n     CHINNAPPA REDDY,  J. On pleas of guilty, the respondent<br \/>\nwas convicted of several charges under Sections 408 and 477A<br \/>\nand sentenced  in each\tcase, by  the Trial  Magistrate,  to<br \/>\nsuffer imprisonment  till the rising of the Court and a fine<br \/>\nof either  Rs. 50 or Rs. 100. The State preferred appeals to<br \/>\nthe High Court for enhancement of the sentences. The appeals<br \/>\nwere dismissed\ton the\tground that  the accused was a young<br \/>\nman who\t had already  been punished sufficiently by the loss<br \/>\nof his\tjob and\t also in  view of the circumstance that more<br \/>\nthan ten years had elapsed since the date of offence. We are<br \/>\nprima facie  satisfied that the sentences are inadequate and<br \/>\nthat the  lenient sentences  are  the  result  of  misplaced<br \/>\nsympathy. We  do not  however propose  to proceed further in<br \/>\nthe matter in the exercise of our jurisdiction under Article<br \/>\n136 as\tthe State  of Karnataka who is the petitioner before<br \/>\nus has\tnot chosen  to file  any papers before us apart from<br \/>\nthe  judgment\tof  the\t High  Court.  The  least  that\t the<br \/>\npetitioner could  have done to give us a full picture of the<br \/>\nfacts was  to file  copies  of\tthe  charge-sheets  and\t the<br \/>\ncharges and  copies of\tthe judgments  of the Trial Court in<br \/>\nthe different  cases. We  do  not  think  that\twe  will  be<br \/>\njustified in  issuing a show-cause notice to the respondents<br \/>\nwhen no\t attempt has been made to place all the facts before<br \/>\nus by filing the necessary documents. Apparently there is no<br \/>\npurposefulness in  the filing  of these\t petitions.
