SINHA\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<\/p>\n<p>2003 Supp(3) SCR 894<\/p>\n<p>The following Order of the Court was delivered :\n<\/p>\n<p>The respondent herein was recruited as a Constable on the rolls of Patiala<br \/>\nPolice, Punjab. His appointing authority was superintendent of Police,<br \/>\nPatiala. Subsequently, the respondent was promoted to the post of Head<br \/>\nConstable. Certain Misconduct committed by the respondent in the year 1984<br \/>\ncame to the notice of the appellants and as a result of which the<br \/>\nrespondent was placed under suspension in view of contemplated inquiry.<br \/>\nWhile the respondent was under suspension, he absented himself atleast on<br \/>\nthree occasions without any kind of leave from the Superintendent of<br \/>\nPolice. In view of unauthorised absence, the appellants herein initiated a<br \/>\ndepartmental inquiry against the respondent. The respondent was served with<br \/>\na charge-sheet to which he filed a reply. In his explanation, it was stated<br \/>\nthat he had gone to attend a court case at Patiala where he had learnt that<br \/>\nhis wife was ill and, therefore, he went to his home town and in such<br \/>\ncircumstances he could not take any permission. The Inquirying Officer<br \/>\nafter making inquiry found the charges to have been proved and he sent his<br \/>\nreport to the disciplinary authority. The disciplinary authority having<br \/>\nagreed with the finding of the Inquirying Officer issued a show cause<br \/>\nnotice to the respondent. After considering the explanation of the<br \/>\nrespondent, the disciplinary authority by an order dated 15.4.1985<br \/>\ndismissed him from service.\n<\/p>\n<p>The disciplinary authority, however, while dismissing the respondent from<br \/>\nservice held that the period of absence of respondent from duty shall be<br \/>\ntreated as leave without any pay. The respondent thereafter filed an appeal<br \/>\nbefore the appellate authority which was rejected and a revision filed<br \/>\nbefore the Inspector General of Police was also met with the same fate.\n<\/p>\n<p>It is under such circumstances, the respondent filed a suit for declaration<br \/>\nthat his dismissal from service is null and void. The trial court framed a<br \/>\nlarge number of issues. It had decreed the suit, inter alia, on the ground<br \/>\nthat the authority could have refused to grant leave of any kind to the<br \/>\nrespondent and then proceeded to punish him. It held that &#8220;Once the leave<br \/>\nhas been granted, it cannot be said that the employee had absented himself<br \/>\nfrom duty and thereby made himself liable to be punished. In this way, it<br \/>\nwould appear that the period of absence of the plaintiff having been<br \/>\ntreated as period spent on leave without pay, charge for which he was<br \/>\nproceeded against departmentally is knocked out.&#8221; In view of the aforesaid<br \/>\nfinding, the suit was decreed. Aggrieved, the appellants filed an appeal<br \/>\nbefore the appellate authority, but the same was dismissed. A second appeal<br \/>\npreferred by the appellants was also dismissed by the High Court. It is<br \/>\nagainst the said orders and judgments of the courts below, the appellants<br \/>\nare in appeal before us.\n<\/p>\n<p>Learned counsel appearing for the appellants, inter alia, urged that the<br \/>\nview taken by the courts below that since the disciplinary authority has<br \/>\ntreated the period of absence as leave without pay, therefore the<br \/>\nmisconduct stood condoned, is patently erroneous. Learned counsel also<br \/>\nrelied upon a decision of this Court in <a href=\"\/doc\/485325\/\">Maan Singh v. Union of India and<br \/>\nOrs.,<\/a> [2003] 3 SCC 464. Having heard the learned counsel for the<br \/>\nrespondent, we find that the argument raised by the learned counsel for the<br \/>\nappellants has merit.\n<\/p>\n<p><a href=\"\/doc\/475515\/\">In The State of Punjab and Ors. v. Bakshish Singh, JT<\/a> (1998) 7 SC 142 which<br \/>\nwas relied upon by the courts below in holding that the misconduct stood<br \/>\ncondoned, was explained in Maan Singh (supra). No law has been laid down in<br \/>\nBakshish Singh (supra) to the effect that only in the event, leave without<br \/>\npay is directed to be granted while passing an order of punishment, the<br \/>\nleave having been regularised the order of punishment also becomes bad in<br \/>\nlaw and void ab initio. While deciding Bakshish Singh (supra), this Court<br \/>\nhad not taken into consideration an earlier binding precedent in <a href=\"\/doc\/267959\/\">State of<br \/>\nMadhya Pradesh v. Harihar Gopal,<\/a> (1969) SLR 274 (SC) wherein it has clearly<br \/>\nbeen stated that such an order is passed only for the purpose of<br \/>\nregularising the leave and thereby the effect of punishment is not wiped<br \/>\nout. In Maan Singh (supra), it was held that the period of absence when<br \/>\ntreated as leave without pay, was with a view to regularise the leave and<br \/>\nnot for condonation of misconduct.\n<\/p>\n<p>The submission of the learned counsel appearing for the respondent that<br \/>\nsince the respondent was under suspension, therefore there was no occasion<br \/>\nfor him to seek permission for leave, is also erroneous. The order of<br \/>\nsuspension dated 24.11.1984 stipulated that the respondent shall remain<br \/>\npresent in Police Lines and will attend all the roll calls and parades and<br \/>\nhe was further ordered not to leave station without prior permission.\n<\/p>\n<p>In that view of the matter, the view taken by the courts below while<br \/>\ndecreeing the suit that since the respondent was under suspension he was<br \/>\nnot required to take leave, is erroneous.\n<\/p>\n<p>For the aforesaid reasons, we find that the appeal deserves to succeed. It<br \/>\nis allowed. The order and judgment under challenge is set aside. The suit<br \/>\nfiled by the respondent in the trial court shall stand dismissed.\n<\/p>\n<p>Before parting with the case, we may, however, observe that from the Record<br \/>\nof Proceedings dated 21.1.2002 it appears that the learned senior counsel<br \/>\nappearing for the appellants had suggested that the order of dismissal<br \/>\npassed against the respondent herein be converted into an order of<br \/>\ncompulsory retirement. Learned counsel now appearing for the appellants,<br \/>\nhowever, states that he does not have any instruction in this behalf.<br \/>\nKeeping in view the fact that at one point of time, a senior counsel<br \/>\nappearing on behalf of the appellants had given the aforementioned<br \/>\nsuggestion, we are of the opinion that in fitness of the matter, the<br \/>\nappellants may consider the same.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Punjab And Ors vs Charanjit Singh on 17 September, 2003 Bench: V.N.
