RTO, Rewa &amp; two others)\n\n17-09-2010\n\n       Heard Shri H.C.Kohli, learned counsel for the petitioner on the\nquestion of admission and interim relief.\n\n       Though the learned counsel for the petitioner has raised several\ngrounds in the petition and argued them extensively, the learned\ncounsel has ultimately limited the relief sought in the petition to issuance\nof a direction to the transport authorities to consider and decide the\npetitioner's application for grant of permanent permit which is pending\nbefore the authority.\n\n       In view of the limited direction prayed for by the petitioner, the\npetition filed by the petitioner is disposed of with a direction to the\nrespondent\/authorities consider and decide the application filed by the<\/pre>\n<p>petitioner for grant of permanent permit with a further stipulation that<br \/>\nwhile doing so, they will take into consideration all facts and facets of the<br \/>\ncase including the affidavit filed by the petitioner admitting his liability<br \/>\nregarding arrears of tax and the application filed by the petitioner dated<br \/>\n17-8-2010.\n<\/p>\n<p>       It is made clear that this Court has not expressed any opinion on<br \/>\nthe merits of the case and, therefore, the respondent\/authorities, while<br \/>\ndeciding the aforesaid application filed by the petitioner, would be at<br \/>\nliberty to take all facts and facets of the case into consideration and<br \/>\nthereafter take a decision by either accepting or rejecting the same.\n<\/p>\n<p>       With the aforesaid directions the petition filed by the petitioner<br \/>\nstands disposed of.\n<\/p>\n<p>       C.C. as per rules.\n<\/p>\n<p>                                                      (R.S.Jha)<br \/>\n                                                        Judge\n   <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Ramkant Mishra vs Regional Transport Authority &#8230; on 17 September, 2010 W.P.No. 12560 \/ 2010 (Ramakant Mishra.. v.
