Manjha, District Gopalganj.\n<\/p>\n<p>                                                                            &#8230;&#8230;..Opposite Parties<\/p>\n<p>02\/-    12-10-2010                    Heard learned counsel for the petitioner and<\/p>\n<p>                          Additional Public Prosecutor for the State.<\/p>\n<p>                                      Learned counsel for the petitioner is permitted to insert<\/p>\n<p>                          the name of husband and present address of complainant-<\/p>\n<p>                          informant during course of the day.\n<\/p>\n<p>                                      This is an application under Section 482 of the Code<\/p>\n<p>                          of Criminal Procedure seeking quashing of order dated 07-11-<\/p>\n<p>                          2003 passed by Chief Judicial Magistrate, Gopalganj in<\/p>\n<p>                          connection with Manjhagarh P.S. Case No. 237 of 2001 for the<\/p>\n<p>                          offences under Sections 498(A), 406, 307 and 323 of the Indian<\/p>\n<p>                          Penal Code and Section 4 of the Dowry Prohibition Act.<\/p>\n<p>                                      It is submitted by learned counsel for the petitioner<\/p>\n<p>                          that after cognizance taken in the case the same has been<\/p>\n<p>                          committed to the Court of Session, matter is pending there bearing<\/p>\n<p>                          Sessions Trial No. 318 of 2006.\n<\/p>\n<p>                                      It is further pointed out that the petitioner being<\/p>\n<p>                          original husband of the complainant-informant was made accused<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>          in this case, but the parties have already settled their dispute<\/p>\n<p>          amicably. In pursuance thereof the complainant-informant has<\/p>\n<p>          already performed the second marriage and is blessed with<\/p>\n<p>          children from him.         On basis of compromise, petitioner was<\/p>\n<p>          granted privilege of bail by the Court, who during pendency of<\/p>\n<p>          bail application got examined complainant-informant on such<\/p>\n<p>          issue.\n<\/p>\n<p>                      In view of the facts and circumstances stated above,<\/p>\n<p>          petitioner is granted liberty to agitate all his points before the trial<\/p>\n<p>          court at appropriate stage preferably at the time of hearing on the<\/p>\n<p>          point of charge, if trial is yet to be commenced. Simultaneously,<\/p>\n<p>          petitioner is further granted liberty to request the trial court to<\/p>\n<p>          expedite hearing, if trial has commenced and ensure appearance of<\/p>\n<p>          complainant-informant as witness, so that truth may come into<\/p>\n<p>          light and appropriate order may be passed at the earliest.
