DENESAN, J.\n\n\n\n                 = = = = = = = = = = = = = = =\n\n                  W.P.(C) No. 10346 OF 2007 F\n\n                 = = = = = = = = = = = = = = =\n\n\n\n                 Dated this the 31st May, 2007\n\n\n\n                          J U D G M E N T\n<\/pre>\n<p>     This   writ   petition   is   preferred   against   the   order<\/p>\n<p>of   the   Subordinate   Judge,   Mavelikkara   in   E.A.   No.<\/p>\n<p>775\/03   in   E.P.   No.   140\/90   in   O.S.   No.   24\/80.     The<\/p>\n<p>petitioner   is   the   2nd     judgment   debtor   in   the   suit<\/p>\n<p>against   the   counter   petitioner.     It   is   seen   from   the<\/p>\n<p>order   that   there   was   a   litigation   with   respect   to   17<\/p>\n<p>cents   of   property   for   specific   performance   of   the<\/p>\n<p>contract.   The contention of the petitioner is that he<\/p>\n<p>is a bonafide purchaser for valuable consideration of 3<\/p>\n<p>cents   of   land.     This   Court   did   not   hold   in   favour   of<\/p>\n<p>the   petitioner.     Therefore,   he   preferred   a   Special<\/p>\n<p>Leave   Petition   before   the   Hon&#8217;ble   Supreme   Court   of<\/p>\n<p>India   and   the   Apex   Court   ordered   status   quo.\n<\/p>\n<p>Thereafter   an   application   was   filed   by   the   decree<\/p>\n<p>holder   for   delivery   of   the   remaining   14   cents   of<\/p>\n<p>property.     It   was   contended   in   that   case   that   the<\/p>\n<p>status   quo   order   relates   to   the   entire   property   and<\/p>\n<p>therefore   delivery  cannot  be  ordered.    The  matter  came<\/p>\n<p>up before this Court on earlier occasion also and this<\/p>\n<p><span class=\"hidden_text\">WPC No. 10346\/2007                -2-<\/span><\/p>\n<p>Court   had   opined   that   the   status   quo   at   the   most   can<\/p>\n<p>relate   to   the   3   cents   of   property   over   which   the<\/p>\n<p>petitioner   claims   right.     Overruling   the   objections   of<\/p>\n<p>the   judgment   debtors   the   court   ordered   delivery   of   14<\/p>\n<p>cents   of   property   and   it   is   for   redelivery   of   that<\/p>\n<p>property   the   present   writ   petition   is   filed.   The<\/p>\n<p>petitioner   has   moved   the   court   for   restoration   of<\/p>\n<p>possession   of   14   cents   of   land   which   had   already   been<\/p>\n<p>delivered by the order of the court.  It has to be held<\/p>\n<p>that   the  interest  which  the  petitioner  claims  over  the<\/p>\n<p>property is of 3 cents which he had acquired by virtue<\/p>\n<p>of an assignment deed.   Though this Court had repelled<\/p>\n<p>his   contention,  the  Apex  Court  had  admitted  his  S.L.P.\n<\/p>\n<p>and   ordered   status   quo.              So   far   as   the   present<\/p>\n<p>petitioner   is   concerned   the   subject   matter   of   the<\/p>\n<p>appeal can only be with respect to 3 cents of property<\/p>\n<p>over   which   he   claims   right.     The   executing   court   has<\/p>\n<p>understood the order of the Apex Court only in that way<\/p>\n<p>and had excluded the 3 cents of property claimed by the<\/p>\n<p>petitioner and had ordered delivery of the remaining 14<\/p>\n<p>cents of property.   It is to restore that 14 cents now<\/p>\n<p>the   present   application   is   filed.     As   stated   earlier,<\/p>\n<p><span class=\"hidden_text\">WPC No. 10346\/2007                -3-<\/span><\/p>\n<p>since   the   petitioner   can   have   right   only   over   3   cents<\/p>\n<p>of property and that 3 cents of property is kept intact<\/p>\n<p>and   the   balance   land   is   ordered   to   be   delivered   and<\/p>\n<p>that   had   been   delivered.             The   prayer   for        the<\/p>\n<p>restoration   with   respect   to   that   14   cents   had   been<\/p>\n<p>negatived.     I   feel,   the   court   below   had   only   acted   in<\/p>\n<p>accordance   with   law   and   in   tune   with   the   direction   of<\/p>\n<p>the   Supreme   Court   of   India   and   therefore   the   order<\/p>\n<p>passed does not suffer from any infirmity and therefore<\/p>\n<p>the writ petition is dismissed.\n<\/p>\n<p>                                                   M.N.
