By this petition filed under Articles 226 &amp; 227<br \/>\nof the Constitution of India, the petitioner is<br \/>\nchallenging the order dated 13-8-2001 passed by the<br \/>\nSub-Divisional Magistrate, Yavatmal in Criminal Case No.<br \/>\n421\/01 and the order dated 11-10-2001 passed by the<br \/>\nAppellate Authority, i.e. Principal Secretary (Appeals<br \/>\nand Security) to the Government of Maharashtra, Home<br \/>\nDepartment in Appeal No. EXT\/04\/2001\/129\/SPL-5.\n<\/p>\n<p> 2. Heard Shri U.A. Gosawi, the learned Counsel for<br \/>\nthe petitioner and Shri Mirza, the learned Additional<br \/>\nPublic Prosecutor for the respondents.\n<\/p>\n<p> 3. The petitioner was externed under Sections 56<br \/>\n&amp; 59 of the Bombay Police Act, 1952 by an order dated<br \/>\n13-8-2001 passed by the respondent no.2. By the said<br \/>\norder, the petitioner was externed for two years from<br \/>\nYavatmal and five neighbouring districts, namely, Nanded,<br \/>\nAkola, Wardha, Chandrapur and Washim. The petitioner<br \/>\nchallenged the said order of externment before the<br \/>\nGovernment of Maharashtra, Home Department, Mumbai in<br \/>\nappeal. The Appellate Authority, namely, the Principal<br \/>\nSecretary (Appeals and Security) to the Government of<br \/>\nMaharashtra, Home Department vide his order dated<br \/>\n11-10-2001 rejected the appeal and confirmed the<br \/>\nexternment order passed by Sub-Divisional Magistrate.<br \/>\nThe petitioner challenges both the aforesaid orders on<br \/>\nthe ground that in show-cause notice there is no averment<br \/>\nthat witnesses are not coming forward to depose or that<br \/>\nthey have not lodged the complaint against the petitioner<br \/>\ndue to fear as also on the ground that though the<br \/>\nactivity of the petitioner is stated to be restricted to<br \/>\nYavatmal town, yet by the externment order in question,<br \/>\nthe petitioner has been externed from not only the<br \/>\ndistrict Yavatmal, but also 5 other districts, namely,<br \/>\nNanded, Akola, Wardha, Chandrapur and Washim. According<br \/>\nto the petitioner, it is in excess of the power conferred<br \/>\nunder Sections 56 &amp; 59 of the Bombay Police Act. Besides<br \/>\nthis, there are other grounds on which the order of<br \/>\nexternment has been challenged.\n<\/p>\n<p> 4. Shri Gosawi, the learned Counsel for the<br \/>\npetitioner, relying upon the decision of this Court in<br \/>\nPunjaji Dagdu Gaikwad .vs. State of Maharashtra and<br \/>\nothers reported in 2001(3) Mh.L.J. 926 contended that<br \/>\nthe order of externment suffered from vice of excessive<br \/>\nexternment from 5 districts in respect of which no data<br \/>\nwas placed and, therefore, the entire order of externment<br \/>\nis liable to be quashed.\n<\/p>\n<p> 5. Shri Mirza, the learned Additional Public<br \/>\nProsecutor, though supported the impugned orders conceded<br \/>\nthat the activity of the petitioner was restricted to<br \/>\nYavatmal town only. However, by the externment order in<br \/>\nquestion, the petitioner has been externed not only from<br \/>\nYavatmal town but also from 5 other districts, namely,<br \/>\nNanded, Akola, Wardha, Chandrapur and Washim.\n<\/p>\n<p> 6. In Punjaji Dagdu Gaikwad .vs. State of<br \/>\nMaharashtra and others reported in 2001(3) Mh.L.J. 926<br \/>\nrelied upon by the learned Counsel for the petitioner,<br \/>\nthis Court relying upon the decision in Pandharinath<br \/>\nShridhar Rangnekar .vs. Dy. Commissioner of Police,<br \/>\nState of Maharashtra , observed in paragraph no.6 as below :-<br \/>\n  &#8220;6. In Pandharinath Shridhar Rangnekar .vs.<br \/>\nDy. Commissioner of Police, State of<br \/>\nMaharashtra , upon which reliance was<br \/>\nplaced by learned A.P.P., it was held that it<br \/>\nis the externment authority which must decide<br \/>\nthe period for which the order is to operate<br \/>\nand the territories to which it should extend.<br \/>\nNevertheless, it is pertinent to note that the<br \/>\nApex Court had observed that it depends upon<br \/>\nthe nature of data collected in each case and<br \/>\nno general formulation is possible, but there<br \/>\nshould not be greater restraint on personal<br \/>\nliberty than is reasonable in the<br \/>\ncircumstances of the case. The Apex Court had<br \/>\nreferred to judgment of this Court in Balu<br \/>\nShivling Domble .vs. The Divisional<br \/>\nMagistrate and held that an excessive order<br \/>\ncan undoubtedly be struck down because no<br \/>\ngreater restraint on personal liberty can be<br \/>\npermitted than is reasonable in the<br \/>\ncircumstances of the case. Nevertheless, it<br \/>\nwas pointed out that the larger area may<br \/>\nconceivably have to be comprised within the<br \/>\nexternment order so as to isolate the externee<br \/>\nfrom his moorings. However, for that purpose<br \/>\ndata is required. In the case under<br \/>\nconsideration, there does not appear to be any<br \/>\nsuch data with relation to the five districts<br \/>\nfrom where also the petitioner has been<br \/>\nexterned along with the area of the<br \/>\nactivities, i.e. district Buldana.\n<\/p>\n<p>Therefore, the impugned order suffers from the<br \/>\nvice of excessive externment from the five<br \/>\ndistricts in respect of which no data was<br \/>\nplaced and the entire externment order is<br \/>\nliable to be quashed.&#8221;\n<\/p>\n<p> 7. The aforesaid observations made by this Court<br \/>\nclearly indicate that an excessive order can undoubtedly<br \/>\nbe struck down since no greater restraint of personal<br \/>\nliberty can be permitted than is reasonable in the<br \/>\ncircumstances of the case. However, larger area may<br \/>\nconceivably have to be comprised within the externment<br \/>\norder so as to isolate the externee from his moorings but<br \/>\nfor that purpose data is required. In the case in hand,<br \/>\nthere does not appear to be any such data with relation<br \/>\nto the five districts from where also the petitioner has<br \/>\nbeen externed along with the area of activities, i.e.<br \/>\nYavatmal town. This clearly indicates that the<br \/>\nexternment order in question suffers from vice of<br \/>\nexcessive externment from the five districts mentioned as<br \/>\nabove and, therefore, both the impugned orders dated<br \/>\n13-8-2001 passed by the Sub-Divisional Magistrate,<br \/>\nYavatmal and 11-10-2001 passed by the Principal Secretary<br \/>\n(Appeals &amp; Security) to the Government of Maharashtra,<br \/>\nHome Department, Mumbai are liable to be quashed.\n<\/p>\n<p> 8. In the result, the Writ Petition is allowed.<br \/>\nThe impugned orders dated 13-8-2001 and 11-10-2001 are<br \/>\nhereby quashed and set aside. The petitioner\/externee<br \/>\nshall be set at liberty forthwith in case he is not<br \/>\nrequired in any matter.
