         The petitioner is working as a Lay Secretary and<\/p>\n
Treasurer of the General Hospital, Alappuzha in the Kerala<\/p>\n
Government Health Services Department. He attained the age<\/p>\n
of 55 years as on 16.9.2007 and is due to retire on<\/p>\n
superannuation on 30.9.2007.\n<\/p>\n
         2. The VIIIth Pay Revision Commission appointed by<\/p>\n
the Government submitted a report on 22.2.2006. One of the<\/p>\n
recommendations made by the said Pay Commission was<\/p>\n
extension of retirement age of the employees by another three<\/p>\n
years.  Apparently,    the    recommendations       have    been<\/p>\n
considered by the Government and Ext.P1 order has been<\/p>\n
passed. The petitioner specifically refers to Clause 4 of Ext.P1,<\/p>\n
which reads as follows:\n<\/p>\n
              “4. The commission submitted its final report<\/p>\n
         to Government on 22.2.2006. After examining the<\/p>\n
         recommendations       of    the    Pay     Revision<\/p>\n
         Commission, the Government are pleased to<\/p>\n
         accept these in toto without any modification.”<\/p>\n<\/blockquote>\n

                             :: 2 ::\n<\/p>\n<\/p>\n
          3.   Learned counsel for the petitioner Sri.Shaji<\/p>\n
contends    that   on   the    Government      accepting   the<\/p>\n
recommendations of the Pay Revision Commission in toto,<\/p>\n
essentially, the Government has, therefore, proposed to<\/p>\n
enhance the retirement age of the employees from 55 years<\/p>\n
to 58 years. Relying on Ext.P1 order, the petitioner sent a<\/p>\n
representation to the Chief Minister. Apparently, it was<\/p>\n
forwarded to the Government and it was dismissed by Ext.P2<\/p>\n
order, in which it is stated that no decision, as such, has<\/p>\n
been taken by the Government hitherto regarding the<\/p>\n
enhancement of the retirement age and therefore, it is not<\/p>\n
possible to accede to the request of the petitioner. Ext.P3 is<\/p>\n
another reply given from the Finance Department, which<\/p>\n
reads as follows:\n<\/p>\n
               “With reference to the above, I am to inform<\/p>\n
          you that State Government have no intention to<\/p>\n
          enhance retirement age of employees.      Hence<\/p>\n
          Government regrets its inability to consider your<\/p>\n
          request.”<\/p><\/blockquote>\n
          4. The petitioner has filed Ext.P4 representation to<\/p>\n
the Chief Secretary to the Government, in which referring to<\/p>\n
W.P.(C).No.28463 of 2007<\/p>\n
                            :: 3 ::\n<\/p>\n
\nthese factors, he requested the chief Secretary to look into<\/p>\n
the matter and to take necessary action to issue orders<\/p>\n
enhancing     the  pension  age     of  the  employees    as<\/p>\n
recommended by the Pay Revision Commission.<\/p>\n
          5. Mr.Nandakumar, Senior Government Pleader<\/p>\n
brought to my notice the judgment of a learned single Judge<\/p>\n
of this court in W.P.(C)No.8863\/06 dated 24.3.2006 and the<\/p>\n
judgment of a Division Bench in W.A.No.656\/06 dated<\/p>\n
30.3.2006, which inter alia, affirms the decision of the<\/p>\n
learned single Judge. A contention was raised in the said<\/p>\n
case that in the light of Ext.P1 Government Order, which<\/p>\n
purportedly accepts the recommendations of the Pay<\/p>\n
Revision Commission in toto, there is now, in force, a<\/p>\n
decision of the Government which contemplates to extend<\/p>\n
the retirement age from 55 years to 58 years.            This<\/p>\n
contention was considered and the Division Bench held as<\/p>\n
follows:\n<\/p>\n
               “The recommendations of the Pay Revision<\/p>\n
         Commission remains as recommendations and<\/p>\n
         even though the Government has accepted it in<\/p>\n
         toto, unless consequential changes are brought in<\/p>\n

                              :: 4 ::\n<\/p><\/blockquote>\n
\n          the Service Rules, it may not be possible for the<\/p>\n
          petitioners  to  contend   that  automatically the<\/p>\n
          retirement age of an employee is to be deemed as<\/p>\n
          different than that was laid down by the statutory<\/p>\n
          rules. The Government Pleader also points out that<\/p>\n
          any other view may not be possible to be adopted.”<\/p><\/blockquote>\n
           6. In my view, the substantial question raised in<\/p>\n
this writ petition, based on Clause (4) of the Government<\/p>\n
Order, stands covered by the decision of the Division Bench.<\/p>\n
Learned counsel for the petitioner Sri.Shaji further contends<\/p>\n
that a decision taken by the Government to accept the<\/p>\n
recommendations of the Pay Revision Commission should<\/p>\n
be translated into an amendment in the statutory rules,<\/p>\n
especially Rule 60(a) of Part I Kerala Service Rules. After all,<\/p>\n
it is for Government to amend the said Rule. According to<\/p>\n
him, this aspect has not been correctly understood by the<\/p>\n
Government while passing Exts.P2 and P3, wherein the<\/p>\n
petitioner’s    request   was     rejected.   Essentially,  the<\/p>\n
government has not taken a policy decision as such.<\/p>\n
           7. I am unable to accept this contention. In my<\/p>\n
view, even if Ext.P1 order reflects that the recommendations<\/p>\n
of the Pay Revision Commission inter alia, as regards the<\/p>\n
W.P.(C).No.28463 of 2007<\/p>\n
                              :: 5 ::\n<\/p>\n
\nenhancement of the retirement age of the employees is to be<\/p>\n
accepted by the Government, it does not ipso facto result in<\/p>\n
enforcement of the decision to enhance the age from 55 to<\/p>\n
58 years. The prescription of the age of retirement in the<\/p>\n
statutory provision, obviously, must have preceded the<\/p>\n
decision of the Government to fix the age of retirement at 55.<\/p>\n
The prescription of the retirement age must have also been<\/p>\n
preceded by recommendations made by appropriate<\/p>\n
authorities and consideration of the same and deliberate<\/p>\n
decision by the Government to prescribe the retirement age<\/p>\n
of 55 years.    The acceptance of the report of the Pay<\/p>\n
Revision Commission by itself cannot be treated as a final<\/p>\n
decision taken by the Government to enhance the retirement<\/p>\n
age from 55 to 58 years. If Ext.P1 is, therefore, not treated<\/p>\n
as a final decision by the Government deciding to enhance<\/p>\n
the age from 55 to 58 years, there is no other material to<\/p>\n
indicate that there is a decision of the Government which will<\/p>\n
afford an enforceable right to the employees.<\/p>\n
          8. No doubt, Exts.P2 and P3 proceeded on the<\/p>\n
premise that the Government has not taken a policy decision<\/p>\n

                             :: 6 ::\n<\/p>\n
\nto enhance the age from 55 to 58 years. In my view, the<\/p>\n
absence of felicity of expression in the order issued by a<\/p>\n
Deputy Secretary, obviously, cannot be laid at the door step<\/p>\n
of the Government.\n<\/p>\n
          For all these reasons, I find that there is no merit in<\/p>\n
the writ petition and the same stands dismissed.<\/p>\n
