Singh, Prakash Pd.\n            For the Opp. Parties:    M\/s Ananda Sen, Deepak, Roshan\n                                     ------\n\n4\/ 24.02.2009<\/pre>\n<p>     Reference may be made to the order dated 10.02.2009, which<br \/>\n            reads as under:-\n<\/p>\n<blockquote><p>                                &#8220;The petitioner&#8217;s husband, late Kaila Bhuiya, while<br \/>\n                         working in the respondents- Central Coalfields Limited,<br \/>\n                         died in harness on 30th July, 2004. After his death, the<br \/>\n                         petitioner-widow moved from pillar to post for getting her<br \/>\n                         death-cum-retiral benefits including arrears of salary,<br \/>\n                         gratuity, provident fund amount, etc, but nothing was<br \/>\n                         paid. She thereafter moved this Court by filing a writ<br \/>\n                         petition being W.P. (S) No.1122 of 2007. The writ petition<br \/>\n                         was disposed on 17.4.2007 with a direction to the<br \/>\n                         respondents including Coal Mines Provident Fund<br \/>\n                         Commissioner to complete all the process and pay the<br \/>\n                         admitted amount of C.M.P.F. within two months. In spite<br \/>\n                         of the aforesaid direction, the petitioner has not been paid<br \/>\n                         her C.M.P.F. amount only because of the fact that in the<br \/>\n                         records of the employer-C.C.L., her name is shown as<br \/>\n                         &#8220;Phulmatia&#8221;, whereas according to Regional Commissioner<br \/>\n                         Provident fund, her name has been shown as &#8220;Phulmati&#8221;.<br \/>\n                         For this minor discrepancy, both the authorities of C.C.L.<br \/>\n                         and the Commissioner are making correspondences, but<br \/>\n                         nothing positive has been done. As a result of inaction from<br \/>\n                         the side of the respondents, the petitioner-widow has not<br \/>\n                         yet been paid her C.M.P.F. amount.\n<\/p><\/blockquote>\n<blockquote><p>                                Put up this case on 24th February, 2009. On that<br \/>\n                         day, either the Opposite Parties shall produce before this<br \/>\n                         Court a cheque of P.F. amount together with interest till<br \/>\n                         the date of payment or, the Personnel Manager of the<br \/>\n                         concerned    Colliery   of   C.C.L.   and    the   Regional<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><br \/>\n                Commissioner Provident Fund shall appear in person and<br \/>\n                file show cause justifying their action for not paying the<br \/>\n                amount.&#8221;\n<\/p><\/blockquote>\n<p>         In compliance of the aforesaid order, learned counsel<br \/>\nappearing for the Regional Provident Fund Commissioner<br \/>\nproduced before me a cheque of Rs. 2,57,072\/- (Two lakhs fifty<br \/>\nseven thousand and seventy two) against full and final settlement<br \/>\nof Provident Fund amount.\n<\/p>\n<p>         Prima facie, therefore, it is clear that despite the order passed<br \/>\nby this Court in the Writ Petition and efforts made by the widow<br \/>\nthe amount of provident fund could not be paid to her. It was only<br \/>\nafter the aforesaid order was passed, the amount of provident fund<br \/>\nhas been paid by issuing cheque. It is a clear case of high<br \/>\nhandedness on the part of the respondents. It is, therefore, a fit case<br \/>\nwhere the widow-petitioner should be paid cost for the harassment<br \/>\nin getting the amount of provident fund although her husband<br \/>\ndied in harness in 2004. As noticed in the aforesaid order, only<br \/>\nbecause of some spelling mistake in the name of the petitioner i.e.<br \/>\n&#8220;Phulmatia&#8221; in place of &#8220;Phulmati&#8221; she was deprived of getting<br \/>\nprovident fund amount. The form submitted by the respondent-<br \/>\nC.C.L.      to the Regional Provident Fund Commissioner was<br \/>\nreturned for making necessary correction in the name of the<br \/>\npetitioner. This was done in the year 2007. Today show cause has<br \/>\nbeen filed by the Regional Provident Fund Commissioner annexing<br \/>\nletter dated 22.01.2009 issued by the Senior Personnel Officer<br \/>\naddressed to the Regional Commissioner. The relevant portion of<br \/>\nthe said letter dated 21.01.2009 is reproduced herein below:-\n<\/p>\n<blockquote><p>                              &#8220;In order to avoid legal complication the<br \/>\n                matter of CMPF refund claim in respest of Late Kaila<br \/>\n                Bhuiya, Ex. PRW, KUGP CMPF A\/C no. RMG\/5-1619 in<br \/>\n                favour of his wife Smt. Fulmatia Devi, to whom we have<br \/>\n                paid gratuity etc., we are re-submitting herewith the<br \/>\n                CMPF refund claim in original which were returned by<br \/>\n                your office to KUGP vide your office letter No.<br \/>\n                CPF\/16\/RMG\/12\/R-II\/324 dated 9.07.07. An attested copy<br \/>\n                of the Bank Pass Book as submitted to this office by the<br \/>\n                claimant wife of the deceased member, which she has<br \/>\n<span class=\"hidden_text\">                                              -3-<\/span><br \/>\n                            opened in the Bank of India, Charhi Branch is enclosed<br \/>\n                            herewith for needful. &#8221;\n<\/p><\/blockquote>\n<blockquote><p>                     It is evidently clear that after the death of late Kaila Bhuiya,<br \/>\n              the respondent-Central Coalfields Limited paid the gratuity and<br \/>\n              other amounts to her instead of the mistake in the name of the<br \/>\n              petitioner,   but   on   the     other   hand,   the   Provident      Fund<br \/>\n              Commissioiner without taking into consideration these facts, have<br \/>\n              returned the form to the C.C.L. and the C.C.L. in its turn delayed<br \/>\n              the matter despite the initiation of contempt proceeding. It is worth<br \/>\n              to mention here that the Bank Account was opened by the<br \/>\n              petitioner in the year 2006 to enable the respondent to pay the<br \/>\n              provident fund amount to her.\n<\/p><\/blockquote>\n<blockquote><p>                     Prima facie, I am of the view that both the officers of C.C.L.<br \/>\n              and the Regional Provident Fund Commissioner had taken the<br \/>\n              matter very lightly and did not even bother to pay the provident<br \/>\n              fund amount to the widow whose husband died in harness in the<br \/>\n              year 2004. If the respondents will pay the provident fund amount<br \/>\n              after five years from the date when the employee died in harness<br \/>\n              then nothing more have to say in this regard. It is, therefore, fit case<br \/>\n              of exemplary cost should be imposed upon both the respondents.\n<\/p><\/blockquote>\n<blockquote><p>                     Hence, the Contempt proceeding is disposed of on the<br \/>\n              deposit of cheque by the respondents, but they are directed to pay a<br \/>\n              cost of Rs. 25,000\/- (Twenty Five Thousand) to the petitioner, out of<br \/>\n              which half of the amount shall be paid by the C.C.L. and rest half of<br \/>\n              the amount shall be paid by the respondent-Regional Provident<br \/>\n              Fund Commissioner.<\/p><\/blockquote>\n<p>                                                                 (M.
