J.\n<\/p>\n<p>     This appeal  under Section 14 of the Terrorist Affected<br \/>\nAreas (Special\tCourts) Act,  1984 is  directed against\t the<br \/>\njudgment and  order dated May 18, 1985 in case No.76 of 1984<br \/>\nwhereby the Special Court, Ferozepur convicted and sentenced<br \/>\nthe four appellants under Sections 302\/34 and 307\/34 IPC and<br \/>\nfurther convicted  and sentenced  the appellant\t Nazar Singh<br \/>\nunder Section 25 of the Arms Act, 1959, while acquitting two<br \/>\nothers.\n<\/p>\n<p>2(a) Teja  Singh (the  deceased) was  the brother of accused<br \/>\nMajor Singh,Nazar  Singh (two  of the  appellants before us)<br \/>\nand  Charan   Singh  (since  acquitted).  According  to\t the<br \/>\nprosecution case  the  house  of  the  above  three  accused<br \/>\npersons is behind the house of Teja Singh. They had put that<br \/>\nhouse under  lock and key and constructed another house on a<br \/>\nplot which  was jointly\t owned by  them and Teja Singh. Teja<br \/>\nSingh and  his sons  had requested  them to  hand over their<br \/>\nhouse in  the village  abadi to\t them in lieu of their house<br \/>\nconstructed on the joint plot. The accused persons, however,<br \/>\ndid not\t agree to  the proposal\t and over  this issue  their<br \/>\nrelationship became strained.\n<\/p>\n<p>(b)  On March  22, 1984\t at or\tabout 6\t A.M.  Jalour  Singh<br \/>\n(P.W.4), Harnek\t Singh (P.W.9)\tand Joginder Singh (P.W.10),<br \/>\nthe three  sons of Teja Singh, were returning to their house<br \/>\nafter irrigating  their land.  When they were about to enter<br \/>\ntheir house the above named three accused persons along with<br \/>\nDaroga Singh,  Tara Singh  (the other  two  appellants)\t and<br \/>\nMohan  Singh  (Since  acquitted)  who  were  their  friends,<br \/>\nsuddenly came out of the deori, near the house of Teja Singh<br \/>\nand Madan Singh were armed with gandasas, Charan Singh had a<br \/>\npistol\tand  Nazar  Singh  a  barchha  with  him.  On  being<br \/>\ninstigated by  Charan Singh,  Nazar  opened  the  attack  by<br \/>\ngiving two  blows with the barchha on Harnek Singh whereupon<br \/>\nhe fell\t down. Then  Tara Singh\t and  Daroga  Singh  started<br \/>\nassaulting Joginder  Singh with\t their respective  gandasas.<br \/>\nNazar Singh  also gave\ta barchha  blow on  his forehead and<br \/>\nTara Singh  another on\this left  leg with  their respective<br \/>\ngandasas felling  him down.  Thereafter the accused persons,<br \/>\nexcept Charan  Singh, caused  further injuries\tto  all\t the<br \/>\nthree victims  with the\t weapons they  were carrying. Gurdev<br \/>\nKaur, wife  of Teja  Singh, then  came out  of the house but<br \/>\nseeing the  accused went back inside and closed the shutters<br \/>\nout of\tfear.  The  accused  persons  however  unhinged\t the<br \/>\nshutters, brought her out and started beating her with their<br \/>\nweapons resulting  in her  instantaneous death.\t The accused<br \/>\npersons then  fled away with their weapons. In the meantime,<br \/>\nTeja Singh had also succumbed to his injuries.\n<\/p>\n<p>(c)  Jalour Singh  then went to the house of Labh Singh, the<br \/>\nSarpanch of the village and informed him about the incident.<br \/>\nHe then\t came back  and took  his injured  brothers Joginder<br \/>\nSingh and  Harnek Singh\t to the Civil Hospital at Mansa in a<br \/>\ntractor trolley,  leaving behind  the village  Chowkidar  to<br \/>\nguard the  dead bodies\tof his\tparents. After\tgetting\t his<br \/>\nbrothers admitted  in the  Civil Hospital, Jalour Singh went<br \/>\nto Mansa  Police Station and lodged an information about the<br \/>\nincident.  Shri\t  Arun\tChand,\t (P.W.12),   Station   House<br \/>\nOfficer,recorded the  information and  after  registering  a<br \/>\ncase thereupon\tleft for  the  spot  accompanied  by  Jalour<br \/>\nSingh. Reaching\t there he  held inquest upon the dead bodies<br \/>\nof Teja\t Singh and  Gurdev Kaur and forwarded them for post-<br \/>\nmortem examination.  He seized some blood-stained earth from<br \/>\nthe spot  and prepared\ta sealed  parcel) in respect thereof<br \/>\nwhich was sent by him for Chemical Examination.\n<\/p>\n<p>(d)  In course of the investigation the accused persons were<br \/>\narrested and  pursuant to  the statement  of Nazar  Singh  a<br \/>\nbarchha was recovered. Similarly, pursuant to the statements<br \/>\nof accused  Major Singh,  Tara Singh  and Daroga Singh three<br \/>\ngandasas were  recovered. On conclusion of investigation the<br \/>\npolice submitted  a charge-sheet  against  the\tsix  accused<br \/>\npersons under  Sections 148, 302\/149 IPC and 307\/149 IPC and<br \/>\na separate  charge-sheet against  the appellant\t Nazar Singh<br \/>\nunder  Section\t25  of\tthe  Arms  Act,\t 1959  for  unlawful<br \/>\npossession of the barchha. Both the cases were tried jointly<br \/>\nand disposed of by the impugned judgment.\n<\/p>\n<p>3.   The  accused\/appellants   pleaded\tnot  guilty  to\t the<br \/>\ncharges levelled  against them\tand their  defence was\tthat<br \/>\nthey had been falsely implicated.\n<\/p>\n<p>4.   To\t prove\t its  case   against  the   appellants,\t the<br \/>\nprosecution examined  Harnek Singh  (P.W.9), Joginder  Singh<br \/>\n(P.W.10) and  Jalour Singh (P.W.4) to give an ocular version<br \/>\nof the\tincident. Besides,  Dr. Janak  Raj Goal (P.W.2), who<br \/>\nhad attended  to the  injuries of  Harnek Singh and Joginder<br \/>\nSingh, Dr.  C.P. Bansal (RW 8), who had performed autopsy on<br \/>\nthe dead  bodies of  Gurdev Kaur  and Teja  Singh,  the\t two<br \/>\ninvestigating Officers\t(P.W. 6\t and 12)  and  other  formal<br \/>\nwitnesses were\texamined by  the prosecution. The reports of<br \/>\nthe Chemical  Examination and Serologist were also exhibited<br \/>\non its behalf.\n<\/p>\n<p>5.   On perusal\t of the\t impugned judgment  we find that the<br \/>\nSocial Court  placed strong  reliance upon  the evidence  of<br \/>\nHarnek Singh  and Joginder  Singh,  two\t of  the  three\t eye<br \/>\nwitnesses as,  according to  it, injuries  on their persons,<br \/>\nspoke volume  about their  presence at the spot. The Special<br \/>\nCourt next  observed that  their evidence  as to  manner  in<br \/>\nwhich their  parents were killed and  they were beaten up by<br \/>\nthe  accused-appellants\t stood\tamply  corroborated  by\t the<br \/>\nmedical evidence.\n<\/p>\n<p>6.   We have  heard the\t learned counsel  appearing for\t the<br \/>\nparties at  length and\tcarefully gone\tthrough\t the  entire<br \/>\nevidence on  record, to ascertain whether the above findings<br \/>\nrecorded by  the trial\tCourt can  be  sustained.  Our\tsuch<br \/>\nexercise persuades  us to unhesitatingly answer the question<br \/>\nin the\taffirmative. Both  P.Ws 9  and 10  have detailed the<br \/>\nentire prosecution  case including the specific roles played<br \/>\nby the\tfour accused-appellants\t in  the  killing  of  their<br \/>\nparents as  also  in assaulting them. Though they were cross<br \/>\nexamined at  length nothing could  be elicited to contradict<br \/>\nthem. It  is, of  course, true\tthat both  of them  tried to<br \/>\nsuppress the  fact that their father was earlier involved in<br \/>\nsome criminal  cases but  their deviation from truth in that<br \/>\nmatter\tdoes   not,  in\t our  view,  any  way  affect  their<br \/>\ncredibility as\tregards their version of the incident having<br \/>\nregard to  the unimpeachable  evidence of  Dr. Goel (P.W. 2)<br \/>\nwho examined  them within  three hours\tof the\tincident and<br \/>\nfound as many as 35 and 16 injuries on the persons of P.W. 9<br \/>\nand P.W.  10 respectively.  The presence  of these  injuries<br \/>\ngoes a\tlong way  to corroborate their claim that along with<br \/>\ntheir parents  they were  the victims  of attack. We further<br \/>\nfind that Dr. Bansal (P.W. 8) who held autopsies on the dead<br \/>\nbodies of  their parents  found 30 injuries on the person of<br \/>\nGurdev Kaur  and 18  on the person of Teja Singh which again<br \/>\ncorroborated their  evidence. Since  the evidence of P.Ws. 9<br \/>\nand 10\tfully supports\tthe prosecution\t case, we  need\t not<br \/>\ndiscuss the   evidence of Jalour Singh (P.W.4) nor deal with<br \/>\nthe criticism made by the learned counsel for the appellants<br \/>\nabout his evidence.\n<\/p>\n<p>7.   In assailing  the prosecution  case it was submitted on<br \/>\nbehalf of the appellants that though a number of people live<br \/>\nin and\taround the  alleged placed  of incident none of them<br \/>\nwas examined.  We do  not find\tany merit in this contention<br \/>\nfor the\t incident took\tplace in the early morning and there<br \/>\nis no  evidence that  they of  the neighbors were present at<br \/>\nthe time of the incident.\n<\/p>\n<p>8. Another  contention that  was raised\t on  behalf  of\t the<br \/>\nappellants was that as Teja Singh had bad antecedents it was<br \/>\nnot unlikely  that he  was killed  by some  others  and\t the<br \/>\nappellants were\t falsely  implicated  due  to  enmity.\tThis<br \/>\ncontention is  to be  stated only  to be rejected in view of<br \/>\nthe overwhelming evidence on record pointing to the guilt of<br \/>\nthe appellants.\n<\/p>\n<p>     On the  conclusions as above we dismiss the appeal.
