DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/03\/2009 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tHeard<br \/>\nthe learned  Advocates appearing for the  parties.\n<\/p>\n<p>\t\tThe<br \/>\npetition  is directed against the order of detention dated 12.11.2008<br \/>\npassed by respondent No. 1, in exercise of powers  conferred  under<br \/>\nsub-section 3(2)  of the  Gujarat Prevention of Anti Social<br \/>\nActivities Act, 1985 (for short, &#8216;PASA Act&#8217;)  by detaining the detenu<br \/>\nas  a bootlegger as defined under section 2 (b) of the Act.\n<\/p>\n<p>2.\t\tLearned<br \/>\nadvocate for the detenu restricted his argument to the extent of<br \/>\norder of detention and submits that registration of one FIR itself<br \/>\ncannot lead to disturbance of even tempo of public life and<br \/>\ntherefore, the public order.  The order of detention is assailed by<br \/>\nthe detenu on various grounds mentioned in the memo of the petition.<br \/>\nHowever, learned counsel for the detenu has focussed his arguments<br \/>\nmainly on the ground that except one FIR<br \/>\nregistered under the Bombay Prohibition Act, there was no other<br \/>\nmaterial before the detaining authority whereby it  could be inferred<br \/>\nreasonably that the detenu is a &#8216;bootlegger&#8217; within the meaning of<br \/>\nsection 2(b) of the Act and required to be detained as the detenu&#8217;s<br \/>\nactivities are prejudicial to the maintenance of public health and<br \/>\npublic order.  In  support of the above submission, learned counsel<br \/>\nfor the detenu has placed reliance on relevant observations made by<br \/>\nthe Apex Court in the case of <a href=\"\/doc\/1239835\/\">Piyush Kantilal Mehta  vs.<br \/>\nCommissioner of Police,<\/a> reported in AIR 1989 SC 491 and the<br \/>\njudgment and order dated 22.8.2000 of the Division Bench of this<br \/>\nCourt (Coram : M.R. Calla &amp; R.R. Tripathi, JJ.), in Letters<br \/>\nPatent Appeal No.223 of 2000 in Special Civil Application No.554 of<br \/>\n2000 (Ashok Balabhai Makwana  v. State of Gujarat) which would<br \/>\nsquarely help the detenu.\n<\/p>\n<p>3.\t\tLearned<br \/>\nadvocate for the detenu further submits that no affidavit-in-reply is<br \/>\nfiled by the State Government.\n<\/p>\n<p>4.<br \/>\n   In view of the above, subjective satisfaction of the detaining<br \/>\nauthority that antisocial activities carried out by the detenu are<br \/>\ndetrimental to public order stands vitiated and order of detention<br \/>\nbased on such satisfaction deserves to be quashed and set aside.\n<\/p>\n<p>5.<br \/>\n      \tLearned Assistant Government Pleader submitted that<br \/>\nregistration of the complaint would go to show that the detenu had,<br \/>\nin fact, indulged into such activities, which can be said to be<br \/>\ndisturbing the public health and public order.  Learned Assistant<br \/>\nGovernment Pleader further submitted that there was sufficient<br \/>\nmaterial before the detaining authority to pass the order of<br \/>\ndetention and no interference is called for by this Court in exercise<br \/>\nof its power under Article 226 of the Constitution of India.\n<\/p>\n<p>6.\t\tHaving<br \/>\nheard the rival submissions of the parties and perused the record of<br \/>\nthe case, I am of the view that a single complaint registered under<br \/>\nthe Bombay Prohibition Act alone cannot be said to be sufficient<br \/>\nenough to arrive at subjective satisfaction to the effect that the<br \/>\nactivities, as alleged, are prejudicial to the public order. The<br \/>\nregistration of one  FIR under Bombay Prohibition Act ipso facto<br \/>\ndoes not lead to disturbance of public order. There has to be nexus<br \/>\nand link for such activities with disturbance of the public order.<br \/>\nThe activities of the detenu must, in the backdrop of the facts,<br \/>\nreflect that such activities disturbed or likelihood of disturbing<br \/>\nthe tempo of normal life of society or general peace and  tranquility<br \/>\nor create a sense of alarm and insecurity in the locality.  The<br \/>\nimpugned order suffers from vice of non-application of mind inasmuch<br \/>\nas the case  in which the detaining authority has placed reliance on<br \/>\nthe above registered offence and statements of unnamed witnesses.  In<br \/>\nthe opinion of this court, the activities of the detenu can, by no<br \/>\nstretch of reasoning, be said to be disturbing the public order.\n<\/p>\n<p>7.\t\tOn<br \/>\ncareful perusal of the material available on record and the ratio<br \/>\nlaid down by the Apex Court in the case of Piyush Kantilal<br \/>\nMehta (supra) and the<br \/>\nJudgment and order dated 22.8.2000 of the Division Bench of this<br \/>\nCourt (Coram: M.R. Calla &amp; R.R. Tripathi, JJ.), in Letters Patent<br \/>\nAppeal No.223 of 2000 in Special Civil Application No.554 of 2000<br \/>\n(Ashok Balabhai Makwana vs. State of Gujarat), I<br \/>\nam of the view that the activities of the detenu cannot be said to be<br \/>\nin any manner prejudicial to the public order and therefore, the<br \/>\norder of detention  passed by the detaining authority cannot be<br \/>\nsustained and is required to be quashed and set aside.\n<\/p>\n<p>8.\t\tIn<br \/>\nthe result, the petition is allowed. The order of detention dated<br \/>\n12.11.2008 passed by the respondent<br \/>\nNo. 1 is quashed and set aside. The detenu, is ordered to be<br \/>\nset at liberty forthwith if he is not  required in connection with<br \/>\nany other case. Rule is made absolute accordingly.
