SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India<br \/>\nthe petitioner-BSNL has prayed for an appropriate writ, order or<br \/>\ndirection directing the Junagadh Municipal Corporation to deliver<br \/>\n629.11  sq meter  of land out of land bearing Survey No. 359 as<br \/>\ndescribed in the registered sale deed no. 1124 dated 30\/03\/2004.\n<\/p>\n<p>2.\tIt<br \/>\nis also further prayed to quash and set aside the impugned letters<br \/>\ncum orders dated 05\/04\/2002, 11\/04\/2002 and 03\/11\/2008 issued by<br \/>\nrespondent no. 4 i.e. Administrator, Datar Estate &amp; Mamlatdar,<br \/>\nJunagadh.\n<\/p>\n<p>3.\tHaving<br \/>\nheard Shri Gaurang Bhatt, learned advocate appearing on behalf of the<br \/>\npetitioner, Ms. Jirga Jhaveri, learned AGP appearing on behalf of<br \/>\nrespondents nos. 1, 2 and 4 and Shri Nirav Sanghvi, learned advocate<br \/>\nappearing on behalf of respondent no. 3 admittedly  it appears that<br \/>\nthe petitioner has purchased 629.11 sq meters of land out of the land<br \/>\nbearing Survey No. 359 paiki situated at Junagadh by registered sale<br \/>\ndeed dated 30\/03\/1994.  It appears that when the petitioner started<br \/>\nputting up construction of the compound wall and gave advertisement<br \/>\nin the newspaper and invited tenders for the same the State<br \/>\nauthorities objected to the same vide communications dated<br \/>\n05\/04\/2002, 11\/04\/2002 and 03\/11\/2008 on the ground that the<br \/>\npetitioner is not the owner of the land in question.  It appears that<br \/>\nsubsequently after the present petition was filed the aforesaid<br \/>\ncommunications by respondent no. 4 are already withdrawn, and,<br \/>\ntherefore, as such, as on today, there is no dispute with respect to<br \/>\nthe ownership of the land bearing Survey No. 629.11 sq meters of land<br \/>\nout of the land bearing Survey No. 359 paiki.  However, it appears<br \/>\nthat there is some dispute with respect to the description of the<br \/>\nproperty purchased by the petitioner.  There is a dispute that which<br \/>\nportion of the land admeasuring 629.11 sq meter out of the land<br \/>\nbearing Survey No. 359 paiki was purchased by the petitioner.  From<br \/>\nthe communication dated 24\/12\/2010 by the Deputy Commissioner,<br \/>\nJunagadh Municipality addressed to the petitioner, it appears that,<br \/>\naccording to respondent no. 3 possession of the land as per the<br \/>\ndescription in the sale deed dated 30\/03\/1994 has already been handed<br \/>\nover to the petitioner.  From the communication dated 24\/12\/2010 it<br \/>\nappears that the description, which is given is about the entire land<br \/>\nof Survey No. 359 paiki and not with respect to the land bearing<br \/>\nSurvey No. 629.11 sq meter  out of the land bearing Survey No. 309<br \/>\npaiki.  It is to be noted that in fact it is not the case on behalf<br \/>\nof the petitioner that the petitioner had purchased the land bearing<br \/>\nSurvey No. 359 paiki.  Thus, the communication by the Deputy<br \/>\nCommissioner, Junagadh Municipality dated 24\/12\/2010 cannot be<br \/>\nconsidered.  In the facts and circumstances of the case, this Court<br \/>\nis of the opinion that if the joint meeting of the representative of<br \/>\nthe petitioner; Commissioner of respondent no. 3 Municipality and the<br \/>\nCollector is held only for the limited purpose of demarcation of the<br \/>\nland admeasuring 629.11 sq meter of land out of the land bearing<br \/>\nSurvey No. 359 paiki, which has been purchased by the petitioner by<br \/>\nregistered sale deed it will meet the ends of justice. The aforesaid<br \/>\nexercise  shall only be for the purpose of demarcation of 629.11 sq<br \/>\nmeter of land out of the land bearing Survey No. 359 paiki in favour<br \/>\nof the petitioner.  The Collector, Junagadh is hereby directed to see<br \/>\nthat the Joint meeting of the petitioner, Commissioner of respondent<br \/>\nno. 3 Municipality and the Collector  is held at the earliest and<br \/>\nappropriate decision is taken at the earliest but not later than<br \/>\nthree months from the date of receipt of the present order.<br \/>\nThereafter, it will be open for the petitioner to initiate<br \/>\nappropriate proceeding for getting peaceful and vacant possession,<br \/>\nwhich is demarcated and to remove the encroachment and\/or to get back<br \/>\npeaceful possession.\n<\/p>\n<p>4.\tWith<br \/>\nthis, the present petition is disposed of.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>siji<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Bharat vs State on 18 February, 2011 Author: M.R.
