Interlocutory Application No. 6434 of 2011.\n<\/p>\n<p>                             The applicant &#8211; writ petitioner is one of the applicants<br \/>\n                 for the 27th Bihar Judicial Service (Preliminary) Competitive<br \/>\n                 Examination, 2009. Admittedly, she has taken the Preliminary<br \/>\n                 Examination but has failed to secure the minimum qualifying<br \/>\n<span class=\"hidden_text\"> 2   Patna High Court CWJC No.10461 of 2011 (4) dt.20-09-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                         2\/3<\/span><\/p>\n<p>            marks for admission to the Competitive Examination. She, being a<br \/>\n            physically handicapped person, has filed the above CWJC No.<br \/>\n            10461 of 2011 to claim reservation for the Physically Handicapped<br \/>\n            persons. The petition is admitted to final hearing.\n<\/p>\n<p>                         Admittedly, in the advertisement in question there was<br \/>\n            no reference to reservation for Physically Handicapped persons.<br \/>\n            The applicant has now sought relief that pending the writ petition<br \/>\n            she be allowed to take the Competitive Examination.\n<\/p>\n<p>                         We do not think expedient to grant the interim relief as<br \/>\n            prayed for the reason that the recruitment process commenced in<br \/>\n            2009 has, after crossing many hurdles, now reached to the stage of<br \/>\n            Competitive Examination. The Hon&#8217;ble Supreme Court is seized<br \/>\n            of the matter and is monitoring the recruitment process. As the<br \/>\n            advertisement did not stipulate reservation for the Physically<br \/>\n            Handicapped persons, if we allow this applicant to take the<br \/>\n            Competitive Examination as Physically Handicapped person<br \/>\n            though she has failed to secure the minimum qualifying marks at<br \/>\n            the Preliminary Examination, we will not do justice to the other<br \/>\n            Physically Handicapped persons, who have not approached this<br \/>\n            Court. The applicant did not approach this Court at the time of<br \/>\n            advertisement seeking reservation for the Physically Handicapped<br \/>\n            persons.\n<\/p>\n<p>                         We are alive to the provisions contained in Sections 32<br \/>\n            and 33 of the Persons with Disabilities (Equal Opportunities,<br \/>\n            Protection of Rights and                 Full Participation),   Act   1995.<br \/>\n            Nevertheless, we would not like to create impediment in the<br \/>\n            Competitive Examination scheduled to commence from 30 th<br \/>\n            September 2011.\n<\/p>\n<p>                         In the event the applicant succeeds in the writ petition,<br \/>\n<span class=\"hidden_text\"> 3        Patna High Court CWJC No.10461 of 2011 (4) dt.20-09-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                              3\/3<\/span><\/p>\n<p>                 the Court may issue direction to the respondents to hold special<br \/>\n                 examination for the              Physically Handicapped persons   for<br \/>\n                 recruitment to at least 3% of the posts advertised in 2009.\n<\/p>\n<p>                              For the aforesaid reason, Interlocutory Application is<br \/>\n                 rejected.\n<\/p>\n<p>                                                         (R.M.
