Gupta, Adv.\n<\/p>\n<p>                                 &#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>3.   08.11.2011             Heard learned counsel for the petitioner and<\/p>\n<p>                   the Court.\n<\/p>\n<p>                            The petitioner is a Class-IV employee in the<\/p>\n<p>                   Civil Court at Aurangabad aggrieved by denial of<\/p>\n<p>                   promotion to a Class-III post in pursuance of a<\/p>\n<p>                   process of selection held against the promotional<\/p>\n<p>                   quota.   No counter affidavit had been filed since<\/p>\n<p>                   July, 2010.     Rather than to have kept the matter<\/p>\n<p>                   pending for that purpose the Court requested the<\/p>\n<p>                   counsel for the Court to place the original records<\/p>\n<p>                   itself so that if possible the matter may be disposed<\/p>\n<p>                   off. The original records have been placed before the<\/p>\n<p>                   Court during submissions.\n<\/p>\n<p>                            The fact of the matter is that the petitioner<\/p>\n<p>                   has secured 43.25 marks in the written examination.<\/p>\n<p>                   The   counter    affidavit   of   the   Registrar   in   the<\/p>\n<p>                   judgeship of Aurangabad states that the qualifying<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>marks fixed for reserved category candidates, to<\/p>\n<p>which the petitioner also belongs, was fixed at 40 by<\/p>\n<p>the appointment committee as distinct from 45<\/p>\n<p>meant for general category candidates.                 His name<\/p>\n<p>was recommended to the Court which did not<\/p>\n<p>approve and observed that the petitioner may again<\/p>\n<p>appear in the ensuing examination after six months.<\/p>\n<p>        The Bihar Civil Court Staff (Class-III &amp;<\/p>\n<p>Class-IV)   (Amendment)            Rules,      2001    visualizes<\/p>\n<p>appointment       on       Class-III   post    both    by    direct<\/p>\n<p>recruitment and by promotion.                 The procedure for<\/p>\n<p>direct recruitment is provided for in Rule -5.                 The<\/p>\n<p>procedure for appointment by promotion is provided<\/p>\n<p>for in Rule-6. 20% of Class-III vacancies have to be<\/p>\n<p>kept reserved for promotion from Class-IV.                       A<\/p>\n<p>separate examination for appointment against the<\/p>\n<p>promotional quota is required to be held.<\/p>\n<p>        Rule      5(d)      regulating      direct    recruitment<\/p>\n<p>provides    for   qualifying       marks       in    the    written<\/p>\n<p>examination as 45%, but permits relaxation in case<\/p>\n<p>of reserved category candidates. Rule 6 dealing with<\/p>\n<p>promotional vacancies shall be governed by the same<\/p>\n<p>qualifying marks in absence of any indication to the<\/p>\n<p>contrary. But relaxation cannot be granted in<\/p>\n<p>absence of any specific statutory provision.<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>                   The provisions of Rule 5(d) for relaxation in<\/p>\n<p>           the   qualifying       marks   for    reserved   category<\/p>\n<p>           candidates applicable to the process of direct<\/p>\n<p>           recruitment cannot be imported into Rule-6 with<\/p>\n<p>           regard to promotional quota vacancies as the latter<\/p>\n<p>           contains no such provisions.         On the contrary Rule<\/p>\n<p>           52 of the Bihar Civil Court Staff (Class-III &amp; Class-IV)<\/p>\n<p>           Rules, 1992 specifically provides that the reservation<\/p>\n<p>           policy shall not be applicable in case of appointment<\/p>\n<p>           by promotion.\n<\/p>\n<p>                   For the aforesaid reason the High Court did<\/p>\n<p>           not approve of the reduced relaxation in the<\/p>\n<p>           qualifying marks of the written examination to 40%<\/p>\n<p>           by the appointment committee with regard to the<\/p>\n<p>           promotional post.       The Court finds no infirmity in<\/p>\n<p>           the same.\n<\/p>\n<p>                   The application is dismissed.\n<\/p>\n<\/p>\n<pre>P.
