Justice V.K.MOHANAN\n\n Dated :24\/04\/2009\n\n O R D E R\n                         V.K.MOHANAN, J.\n                    ---------------------------------------\n                   W.P.(C) No.12701 OF 2009\n                    ---------------------------------------\n              Dated this the 24th day of April, 2009\n\n\n                             JUDGMENT\n<\/pre>\n<p>      The petitioner is the owner of the shop in the name and<\/p>\n<p>style &#8216;Santhivision Optics&#8217; in the building No.C.C.XXX\/1010<\/p>\n<p>(Old No.XXX\/227 2-A). According to the petitioner, for starting<\/p>\n<p>a cycle shop in the said premises, he had applied for licence<\/p>\n<p>from the Corporation for which he had remitted licence fee<\/p>\n<p>and the professional tax as evidenced by Ext.P1. The grievance<\/p>\n<p>of the petitioner is that thereafter, no licence has issued by the<\/p>\n<p>Corporation. Therefore, he approached this court with a<\/p>\n<p>prayer to issue a writ of mandamus directing the Corporation<\/p>\n<p>to issue licence as prayed for.\n<\/p>\n<p>      2. I have heard the learned counsel for the petitioner as<\/p>\n<p>well as the learned Standing Counsel for the Cochin<\/p>\n<p>Corporation.\n<\/p>\n<p>      3.    As the request for licence is pending before the<\/p>\n<p>second respondent, who is the authority to consider the<\/p>\n<p>request on merit and to grant the same if the petitioner is<\/p>\n<p>otherwise entitled, I am not proposed to enter into the finding<\/p>\n<p>W.P.(C) No.12701 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>on merit. On the other hand, I am of the view that this writ<\/p>\n<p>petition can be disposed of directing the second respondent to<\/p>\n<p>dispose of Ext.P6.\n<\/p>\n<p>       4.    In the result, this writ petition is disposed of<\/p>\n<p>directing     the     second respondent    to  take  up Ext.P6<\/p>\n<p>representation after giving an opportunity of being heard to<\/p>\n<p>the petitioner as well as the respondents 3 and 4.
