No.1697 of 2002\n          ------------------------------------------------\n           Dated this the 28th day of May, 2009\n\n                            ORDER\n<\/pre>\n<p>    Accused Nos.2 and 7 in Crime No.166\/91 of<\/p>\n<p>Oachira Police Station who were charge sheeted<\/p>\n<p>for offence under Sections 143, 147, 447, 427,<\/p>\n<p>149 and 506(1) IPC and who were convicted for<\/p>\n<p>offence under Sections 143, 447, 427 and 506<\/p>\n<p>(1) IPC and sentenced to R.I. for one month<\/p>\n<p>each under Section 143 and 447 IPC and to R.I.<\/p>\n<p>for six months each under Sections 427 and 506<\/p>\n<p>(1) IPC with benefit of concurrency are the<\/p>\n<p>petitioners,     the        conviction              and    sentence<\/p>\n<p>passed against them by the learned Magistrate<\/p>\n<p>having been confirmed also by the Sessions<\/p>\n<p>Court, Kollam in Criminal Appeal No.18\/99.<\/p>\n<p>    2. It is contended by the learned counsel<\/p>\n<p>for the petitioners that though there are<\/p>\n<p>circumstances emanating from the totality of<\/p>\n<p>the evidence and the circumstances available<\/p>\n<p><span class=\"hidden_text\">Crl. R. P. No.1697 of 2002          -2-<\/span><\/p>\n<p>        in      the      case  which   would exonerate   the<\/p>\n<p>        petitioners from the guilt, she would canvass<\/p>\n<p>        only for the conversion of the sentence into<\/p>\n<p>        one of fine and submits that the petitioners<\/p>\n<p>        were all in their twenties at the time of the<\/p>\n<p>        occurrence in 1991; that the occurrence has<\/p>\n<p>        taken place on a bandh day on account of<\/p>\n<p>        political animosity and after 17 years of the<\/p>\n<p>        occurrence the petitioners are settled in life<\/p>\n<p>        with no politics and there is no ill-will or<\/p>\n<p>        animosity subsisting between the witnesses and<\/p>\n<p>        the     petitioners     and  that  therefore, as   a<\/p>\n<p>        gesture of mercy to enable the petitioners to<\/p>\n<p>        be     good      citizens  hereafter the   sentences<\/p>\n<p>        awarded to them be converted to fine as the<\/p>\n<p>        petitioners are not habitual offenders nor is<\/p>\n<p>        there any other case against them.<\/p>\n<p>                3. Considering the entire circumstances<\/p>\n<p>        of the case, I am of the view that this is a<\/p>\n<p>        case wherein this Court would be justified in<\/p>\n<p><span class=\"hidden_text\">Crl. R. P. No.1697 of 2002          -3-<\/span><\/p>\n<p>        converting the sentence of imprisonment to one<\/p>\n<p>        of fine.\n<\/p>\n<p>                4. In the result, while confirming the<\/p>\n<p>        concurrent conviction of the petitioners for<\/p>\n<p>        offence under Sections 143, 447, 427 and 506<\/p>\n<p>        (1) IPC read with Section 149 thereof, I set<\/p>\n<p>        aside the sentence of imprisonment awarded to<\/p>\n<p>        the petitioners and impose a sentence of fine<\/p>\n<p>        of Rs.500\/- each for offences under Sections<\/p>\n<p>        143 and 447 IPC and a fine of Rs.2,000\/- each<\/p>\n<p>        for offences under Sections 447 and 427 IPC on<\/p>\n<p>        each of the petitioners. They shall pay the<\/p>\n<p>        fine       and     report  the  matter before  the<\/p>\n<p>        concerned         Magistrate positively within one<\/p>\n<p>        month from today. In case of default they are<\/p>\n<p>        to suffer simple imprisonment for one month<\/p>\n<p>        each for offences under Sections 143 and 447<\/p>\n<p>        IPC and simple imprisonment of six months each<\/p>\n<p>        for offences under Sections 427 and 506(1) IPC<\/p>\n<p>        and to suffer the said sentence they shall<\/p>\n<p><span class=\"hidden_text\">Crl. R. P. No.1697 of 2002         -4-<\/span><\/p>\n<p>        surrender         before the  concerned   Magistrate<\/p>\n<p>        positively on 30\/06\/09.\n<\/p>\n<p>                5.
